ROAD TOWN, Tortola, VI - While many in the Coalition Government of Premier Dr. the Honourable Natalio D. Wheatley (R7) will not admit that the Virgin Islands (VI) is under direct rule with the appointed Governor John J. Rankin as the ‘strong man’, more and more evidence has emerged.

Coming out of the over 45 recommendations of the Commission of Inquiry’s (CoI) report, is the recommendation for the undemocratic practices of granting the courts wider powers to hear judge-only criminal trials.

Was VI sold out?

This means the VI should prepare for one-man justice like the one-man Commissioner in the Commission of Inquiry, who will get to decide justice in the Territory on criminal matters.  

The Dr Wheatley administration stated publicly that, “it is committed to the implementation of all the recommendations in the CoI report” which means that the Government has already signed off an agreement with the Governor and UK, without any consultation with the people.

Another area of concern is that coming out of the framework implementation agreement, is a revised Constitutional Review Committee, thereby scrapping the committee already set up with nominations from the local political parties.

The ‘strong man’ Governor Rankin will have the final say on membership and he is to consult with the Premier.

The framework already states the terms of reference for those nominated, ahead of no consultation from the people of the VI. The predetermined terms of reference included among others, powers that need to be reserved for the Governor. 

Additionally, there should now be a regime in relation to election expenses in the form of a requirement for election candidates to submit a breakdown of expenses, including donations above a specific sum and/or a cap on such expenses.

Further, without prejudice to earlier legislative action, required is the clarification of the circumstances in which persons seeking election to the House of Assembly, who did contracts with the Government of the Virgin Islands (either personally or through a dba, a partnership, or a company with which he or she is associated). These individuals will need to declare an interest, however, how such a declaration should be made, and the consequences of them not doing so remains unknown. 

Meet deadlines or else! 

In addition, all of the items to be implemented by the local Government are given deadlines, however, most of the deliverables of the Governor under the same framework, come without a deadline.

The framework for implementation of the CoI recommendation states that a delay by any actor in meeting an implementation deadline without a legitimate excuse will trigger consultations between the Governor, Premier, and relevant actor(s) to assess and address the delay.

A further delay without a legitimate excuse will be considered obstruction and will trigger consultations between the Governor and the UK Government.

In other words, if at any time the colonial power of the ‘strong man’ Governor is not satisfied with a deadline not being met, they can impose the partial suspension of the VI’s constitution to dissolve the House of Assembly (HoA) & local Cabinet.

    We do not have to implement Judge only.trials. it was not said we must, whether consideration should be given for that. What is happening in other Caribbean jurisdictions? Let us work on the best recommendations. We are not UK's Robots

    Judge-only trials are not unique or undemocratic. Dozens of countries including Australia and South Africa are using the practice. Please research anything you read these days as some people may deliberately miss guide you for their own selfish reasons.

    The Unity Government begged, groveled and capitulated and they still got their head chopped off. I don't know how the Unity government got to negotiate on our behalf because they are an illegal Government. There were Constitutional processes in place to remove or replace individual members of Government and the election process is there to remove all if desired. None of those processes were followed. The take over is anti the UN charter for self-determination as outline by the UN. We choose to capitulate rather than fight. Had we fought we may have gotten a different out come. We now see what capitulation has giving us.

    should return to the BVI as a Judge and take over all the bench trials for criminals in the BVI. Plus the Honorable HIckenbottom could bring with him a whole team of UK prosecutors to replace the lame ones in the DPP and give these defense attorneys a real battle delivering justice without a jury. Eventually he will preside over the corruption trials of the HOA members and other criminal civil servants to deliver verdicts and severe sentences without the distraction of a jury of the defendants relatives. Lastly there will be no conflict of interest as an Honorable Judge in the BVI because in his former capacity as the Commissioner of the CoI he was acting as an investigator on behalf of the FO and not practicing law.

    In England and Wales everyone accused of an offence which carries more than six months' imprisonment has a right to trial by jury. Minor ("summary") criminal cases are heard without a jury in the Magistrates' Courts.

    So why is the BVI being forced to implement judge only trials?

    Maynard and Fahie we get along, when I heard Willock for Speaker and Maynard for Port and was in disagreement. I said to them I think it should switch up, Maynard as Speaker and Willock at Port,. Seen as Maynard has the court experience and went on to further her studies and got her degree...Maynard was whatever she is asked to do she will do, Fahie was nothing or no one will change that's the way he wants it...So,. This is what refusing to take advice came to...The BVI been corrupt for a long time, but Fahie take us over the Clift..One more thing.. Another Suggestion for Premier Wheatley " Create a post of a Director over Customs, Labour and Immigration One Person incharge of all 3 dept". I also suggest that Willock be considered for this position.. I am not a huge fan of Willock the man, but I truly believe he possesses the personality and the ability to fix those departments...So, a lot of bad decisions brought us to where we at and the fix is not an easy one and cannot be done without Britain involvement

    And I agree with the judge to make rulings over these matters. What needs to happen also is the office of the DPP need some help in prosecuting cases. Stop playing like you can do it and take some learning from persons who can prosecute a case properly.

The UK can assist in the improvement but when they kill the first native islander we will hear the uprising as blood flow down the street. We were on a destructive course. Clean up the sham. Unsolved mysteries, mothers crying, save the drugging. Tortolians cannot move to somewhere else. Remediation and re-construction. Show the 5yr plan forward.

    WE have a Common Law legal system in the Virgin Islands. Having Judge only trials has always been a choice for the accused except here in the VI. some cases are soo sensitive, it is almost impossible to find a suitable panel of Jurors. In addition, the case is tried faster and in the event that the judge errs there is always an appeal process. Further more, the judicial system in the Virgin Islands is supervised by the Chief Justice who just happens to be from Virgin Gorda. It has nothing to do with the Governor or the UK.
