ROAD TOWN, Tortola, VI – Retired police officer and former crown prosecutor in the Virgin Islands (VI) Mr Jefferson J. Knight aka ‘Knight Rider’ is reportedly looking to challenge some alleged constitutional breaches connected to the Commission of Inquiry in the VI, according to information revealed on the ‘Da Morning Braff’ radio show on Tola Radio VI.

Mr Knight, who was a guest on the November 30, 2023, edition of the show said he is someone who is not "indigenous" but has a deep connection to the VI, as he grew up with the people of the VI from a teenager and has appreciated the friendship and love of the people over the years.

CoI Commissioner is not an investigator- Mr Knight 

Mr Knight, who revealed that he is also a Belonger, said as a trained prosecutor he has concerns with the CoI recommendations and the appointment of Sir Gary R. Hickinbottom as the Commissioner of the CoI.  

He said his biggest concern with the appointment is that it was clear that the Commissioner was appointed by the Governor to inquire into corruption in public offices and not conduct a criminal investigation.

“Now we must understand, right now in the BVI Constitution we have fundamental rights and freedoms and the safeguard of justice and their provisions like in section 12, section 15 and Section 16 of the Constitution to protect the rights of persons accused of a criminal offense, persons who are under investigation for a criminal offense, and persons who are charged or likely to be charged for criminal offense.” 

He continued, “Now my concern with the COI recommendation is where the commissioner of the CoI… is making a recommendation to the governor to investigate, to conduct criminal investigations against persons after the CoI. Now Sir Gary was not appointed as a criminal investigator in the BVI to investigate the criminal offense of corruption, because corruption is a criminal offense.”

Corruption is a criminal offense not for CoI- Mr Knight 

He added that under the criminal justice system, corruption is a criminal offense, “So if Governor Augustus Jaspert had identified that there is systematic corruption in governance and with our elected public officials and public offices, then Governor Jasper should have appointed a criminal investigator to investigate the criminal offense of corruption, but he did not do that.”

Mr Knight said the use of a Commission of Inquiry means the commissioner was not a criminal investigator to fall in the category of a police officer to conduct criminal investigations in the VI.

He said his move to bring the matter to court is to share his view that the CoI was constitutionally wrong and was rather a ‘setup’ for not appointing a Police to conduct a criminal investigation if the governor believed there was corruption in the VI.

      You have no knowledge of the law. Nothing criminal to investigate and if any charges brought, the case should either be thrown out (for unfairness, prejudice and abuse of process) or any conviction that is rendered should be marked as 'unsafe'. Why? Because there is something called "due process of the law" and PACE. One cannot be asked questions of any offfence whereby they may potentially incriminate themselves unless cautioned under arrest (and told what crime they are being suspected of committing), told of their right to silence and their right to an Attorney. The COI is an illegal venue. Due process laws have been developed overtime to protect people and clearly the foundations of the COI, if they do not respect the concept of due process, are clearly archaic, outdated, illegal and unjust. Nobody name starting with "Sir", coming from the UK and do not know this. The whole set up neither looked, smelt or felt right. There was no due process. If crimes are suspected, the process should be: 1) reporting through confidential whistle-blower policy; 2)internal investigations led by an independent committee and/or 3) reporting to the police where suspicion of crime. The police SHOULD have the sense and training required to investigate and then bring charges,arrest, cautioning etc. (outlined above), for progression to a trial if need be. Knight Rider is right all day long. Foy could not challenge the COI because ironically he was the one who asked.for it even though he did not know what the hell he was asking for. It was down to pride. Any other party in government would have had the sense.to challenge it from the jump. Sense over nonsense.

    This is just hilarious nonsense being spoken. The COI identified possible criminal matters that were then passed to the formal criminal investigators of the RVIPF. That is how it’s supposed to operate when a COI is called.

      The COI called for the suspension of a constitution based on suspicions of things not yet proven in court. It would have been and will still be hilarious WHEN the UK suspends rhe constitution. LOL.No. I paid the police administration with my housing allowance and half of my national security allowance,to stay in the barracks for my safety and security.I did not stay in barracks for all that time for free. I was transfered from station to station etc, so the police had to provide accomodation. I proudly stayed in the barracks. My country is BVI,where I getting my pensions from BVI government and SSB.What happens in my area where I reside, is not my business and not my concern.BVI is my country.BVI people are my people.My candle is burning.My rosary is rolling,and I would say the Hail Mary Prayers.I shall defeat the COI recommendations.The COI recommendations are [FAKE]!!

    From the a very long time i say the BVI have the most human ass holes, please allow me to clarify I am not a lawyer but common sense told me that anyone that live on an island and constantly refer to other's as " island man" or "island people" deserve what ever the UK do them. from the start of the coi i was amazed at the amount of what i considered learned people who was cheering for the coi, the so call brilliant lawyers with the exception of Micheal Fey stood on the side line with their hands over their mouths, and of course Mr. Fey was made to pay, I really do not expect a lot these 'Aholes" to side with knight rider at least he has balls.

    Corruption is a criminal offence, identified in the Criminal Codes, to be investigated by the police.

    The COI revealed and exposed, that all or most of our public officials and public officers, fell short of their duties and responsibilities etc.
    But the COI did not recommend that they be disciplined for their conduct.
    Some of the very same elected officials, are back in the Parliament!
    Only one [former Minister of Government] was arrested and charged with a FAKE and KOKOMAKAK charge of Breach of Trust??
    What happened to the rest of them, whom the COI accused of doing wrong?
    I had welcomed the COI, but to the end, the Governor and the COI, did not do justice to the BVI people
    Some elected officials and some public officers were targeted in the COI recommendations, while others were not targeted?
    Close the COI recommendations, reinstate the senior public officers, withdraw that fake charge against the former Minister of Education, and let's move on..

    I want to commend Knight Rider for his advocacy and courage to express his views on the COI. I do hope that what was mentioned in his statement will be able to educate the residents of their rights in this country. First of all, the COI was illegal with the Attorney who was asking the questions on behalf of the Commissioner practiced his profession without being admitted to the Bar in the Territory. When the Hon. Speaker filed a court action to ensure that the legal process is followed, many persons criticized him.

    Sir Gary Hickinbottom wrote to the FDCO-UK, dated 8th June,2022 and he said in an excerpt at paragraph 16:-
