Javier Maduro guilty of reckless driving

ROAD TOWN, Tortola, VI – Javier Maduro was today November 21, 2014 sentenced by Justice Nicole Byer in the High Court to nine months suspended for 1 year and fined $950 to be paid in two weeks or face six months imprisonment for reckless driving during which he caused serious injuries to Asiyah Mahoney.

Further, his driver's licence was suspended for eight months as part of the sentencing he was handed.

Reading from a prepared statement Javier Maduro told the High Court earlier today November 21, 2014 that he was deeply sorry for his actions which resulted in Ms Asiyah Mahoney sustaining injuries to the extent of still being overseas undergoing medical procedures.

He told the court that since the February 1, 2014 incident he has been remorseful and has been praying for her recovery. He also told the court that when he fled the scene was for the single purpose that he was afraid and went to get help.

As the Crown and Maduro’s Attorney Mr Stephen R. Daniels presented mitigating and aggravating factors the court heard that on that ill-fated morning the accused had attended a night club where he had consumed some alcohol and having left the club sometime around 3:00pm he proceeded to East End to drop off a friend then was heading to his home in Carrot Bay when the unfortunate incident occurred.

He was said to have fallen asleep behind the wheel of his vehicle.

After he had fled the scene he was taken to the West End Police Station by his mother with whom he lives and had since been cooperating with the police and the procedures of the case. He had also confessed his guilt to committing the offense.

The court was told that up to the time the 22 year old was working with his father as a heavy duty truck driver but his father has since fired him resulting in him seeking employment elsewhere.

On the other hand Ms Asiyah Mahoney’s injuries were to the extent of a fractured skull and bleeding in the head among other things. She is currently in the USA and has to undergo therapy.

    I think the sentence is appropiate. I know some people would have hoped he would have gotten thrown in prison for a long time, but what good woud that do? This is something he is already paying for everyday. We must all continue to pray for both him, his mom, and the victim. I am ashamed of his father though.

      If he's a driver with no licence how can he effectively carry out his duties. . . In the mean time he can find something else to do which will help to contribute the bills that will be coming . . . Also look at it from another point of view. . . his salary can also be used in assistance to the family. . .

    This was an unfortunate situation for both parties. I am truly happy that Javy did not get jail time. I pray that Mrs. Mahoney fully recovers from her injuries.

    Shame of father for what....your child in your registered vehicle, hit and injured an individual....probably got a lawsuit in his tail, and I should still have you employed? HELL NO! Prob was lazy on the job too anyway! Well let mom take up the slack...it's about time!
