Informants can claim 10% of monies recovered from whistleblowing

ROAD TOWN, Tortola, VI – Whistleblowers whose disclosure results in the recovery of money in the Virgin Islands (VI), can be rewarded 10% of the cash, according to the proposed Whistleblowers Act 2021.

The cash will come as part of a reward structure to encourage whistleblowing in the territory, where persons will be compensated via the percentage, or through monies made available from a Fund.

The bill received its Introduction and First Reading at the Sixth Sitting of the Third Session of the Fourth House of Assembly (HoA) at the Save the Seed Energy Centre in Duff's Bottom, Tortola on March 4, 2021.

Sponsor of the bill, Premier and Minister of Finance, Hon Andrew A. Fahie (R1) said the Whistleblowers Act “allows any public officer or even in the private [sector] to be able to report it and not be penalised by the employer.

"As a matter of fact, there is a reward for the person if the information that they have brought to the officials is of worth..."

Cash rewards

Part V, Section 23 of the bill, states: “The moneys for the Fund shall consist of (a) voluntary contributions to the Fund; and (b) other moneys that may be allocated by the House of Protection against civil and criminal action."

Section 25 of the bill states: “A whistleblower who makes a disclosure that leads to the arrest and conviction of an accused person shall be rewarded with money from the Fund.”

Where a disclosure results in the recovery of an amount of money, the whistleblower will either receive 10% of the money recovered or an amount of money that the Governor, after consultation with Cabinet, shall determine.

Disbursement

According to the bill, the disbursement of Funds shall be determined by the Minister with the approval of Cabinet and the Accountant General shall within thirty days on receipt of the submission of a claim for payment out of the Fund, approve  "(a) payment of a reward from the Fund; (b) the reimbursement of expenses incurred by a whistleblower whose disclosure resulted in an investigation for which that person incurred those expenses..."

The act states that monies to be paid for a claim, subject to conditions, shall be paid within a period of not more than three months from the date the payment of the money is approved, as signed by a minister.

Objects & Reasons

The Bill seeks to provide for the manner in which individuals may in the public interest disclose information that relates to unlawful or other illegal conduct or corrupt practices of others; to provide for the protection against victimisation of persons who make these disclosures; to provide for a Fund to reward individuals who make the disclosures and to provide for related matters.

Whistleblowing legislation is a campaign promise of the Virgin Islands Party (VIP) Administration.

    Here's the problem, people in this whistle blower recovery program cannot keep their mouths shut about who the informants are, putting their lives in danger. So is the money worth your life?

      @Greg, I think that the people who is in THE WHISTLEBLOWER RECOVERY PROGRAM SHOULD BE MADE TO SIGN A NON DISCLOSURE CONTRACT. IF THEY OPEN THEIR MOUTHS ABOUT WHO THE INFORMANT(S) ARE, THEY WOULD BE SERVING A MININUM OF 5 YEARS IN PRISON AND A $10,000 DOLLAR FINE.

        You have to protect the INFORMANTS AT ALL CAUSE. IN THE US, WHISTLEBLOWERS AND THE INFORMANTS ARE WELL PROTECTED.

    More murders to come ... how can you encourage people to snitch with no protection just money ??? Guys you need to also read the words in the act “or an amount the governor shall determine” that amount can be a dollar or just 500 dollars ain’t no guarantee you will get that 10 percent ...

    From what I understand this act may be focusing on businesses not directly drug crime etc. so let's say you work for @#JS company and find out and report that your employer is not paying his/her portion of taxes. And you whistleblow you may get a cut as a reward or as reimbursement?. ps. this is a random example, not a claim or otherwise.

    how about people mind their business and you funnel that 10% into the education system so maybe oneday teachers wont have to buy school supplies and toilet paper out of the small salaries they receive.

    this is a very dangerous game - a couple years ago when the police was going to make a raid \ a police girl informed the drug dealers of what was going down and was asking to be rewarded with some $$ for the info so I think you will have to deliver it to the governor yourself

    It may work in the private sector, but to try and apply it to the gun and drug trade? Nope. too dangerous. The people behind the guns and drugs pay WAY more for info on upcoming raids etc than any government. Don't believe me? Just take a look at Columbia and some other drug producing countries.

    Just to suspect someone around u snitching would be more valuable to blast first them ask questions for there wouldn't be answered. Hnnn..receipe for more violence.....and innocent lives taken...protect the people if u going to use them ....law enforcement...be we know there only care about solving case for a stripe on thete coat ...bigger salary in end not u....

    It’s always good for persons with knowledge of crimes to come forward, but as others have said this is very risky.. the BVi is a very small plane where everyone basically know each other or a family member and we all know that confidentiality is an issue here.. we’ve seen this breached before even in the face of signing a confidentiality clause; and not just in law enforcement but in other services as well..some persons just don’t know how to keep their mouths shut.. and again it’s because we are a small community, everybody is some form of family etc so though it’s a good idea - risky to the bone . guns don’t kill people; only stupid people with guns kill people.. serious measures will have to be put in place to protect the informant e.g. like stiff penalties for breaking for breaking confidentiality; and perhaps where the informant voice and number can be disguised in totality..

    Forget the money! In order for us to reclaim our islands, send an anonymous letter in the mail, giving all details, and you will be safe. The main objective is to have these murderers captured. Money can't buy life, we want our peace and freedom back.

    Hope u send ur prove or ur self as witness for the court ...how stupid u all can be ...if u ain't got proof of the knowledge that can be brought before court or ur self as a witness how can u collect the 10 %...lmaooo...anyone can say anything and get paid wah ? Ok then omar is who kill Jimmy. And even tho it tru how can I collect if I cant produce proof for a conviction

      @ @linda. Can you understand what I wrote? How stupid and uninformed are you? I said "FORGET THE MONEY". It is not wanted. What we want is our homeland back. What is needed is to mail an anonymous letter giving vivid details of what and where. If the police check out this lead, they can capture known criminals and murderers. You ever heard of the police got a lead they are checking out? No one has to go to court because the police would not know who informed them. Many cases have been solved all over the world because of tips given. Negative people like you would never help solve a crime, being a wuss.
