ROAD TOWN, Tortola, VI- In spite of his pleas to the court for a second chance, 25-year-old Dillon Findlay will now have to pay $5,500 by February 28, 2020 or risk spending 28 days at Her Majesty’s Prison (HMP) for cannabis.

“Give me a chance; I am sorry for wasting the court’s time. I am trying to be a better man. I have my own business I want to start up,” he told Magistrate Samuel Jack Husbands on Monday, November 18, 2019, during his sentencing hearing at John’s Hole.

A Police report states that Findlay was caught in Baughers Bay on September 22, 2018, discarding a package containing 38 grams of cannabis which was later reduced to 27 grams due to the lack of moisture. After retrieving the suspected drugs, Findlay was later arrested and charged with drug-related offences.

He was fined $500 for possession of a controlled drug, and $5,000 for possession of a controlled drug with intent to supply to another.

Findlay pleaded guilty to possession of a controlled drug but not guilty to possession of a controlled drug with intent to supply.

As a result, he was only on trial for the possession of a controlled drug with intent to supply charge.

Following the trial, Magistrate Husbands said: “I find you guilty.”

No forfeiture

Magistrate Husbands said the sum of $498 that was found on his person during the time of the offence would not be forfeited to the state.

The magistrate said this is because, despite the Prosecution’s objections, they did not prove that the funds were from criminal activities.
