Hotel stay, No Pay
According to records given to the court, on July 10, 2012, Ashby was allegedly seen loitering on the compound of the hotel by a Janitor, who came to a conclusion that Ashby was not a guest.
While continuing her duties, the court understood that the Janitor began checking the rooms for anything strange, which resulted in her allegedly finding the defendant, laying on one of the beds in a room.
She allegedly notified her boss immediately after.
The court also understood that, the owner of the hotel, and the Virtual Complainant (VC) in the case, saw a rental vehicle about to drive out of the area, where he then allegedly ran to the jeep and stopped the driver and observed that Mr. Ashby and another male were the occupants of the vehicle.
They were allegedly asked why they were on the premises and told not to return. Ashby allegedly told the VC that he didn’t know what he was talking about.
On July 15, 2012, the Janitor allegedly spotted the defendant on the hotel grounds again, and in the room where he allegedly sneaked into, the bed was rumpled and a towel was used in the bathroom.
It is the court's understanding that on both occasions, the beds were rumpled.
Management of the establishment and police officers, then examined footages from CCTV Cameras that were installed on the grounds of the hotel, which revealed Mr. Ashby and another allegedly walking to and from the rooms.
On one occasion, the viewing allegedly revealed the defendant Ashby allegedly walking on to the compound at 6:48 a.m. with an unknown female. The pair headed to the direction of the rooms and 18 minutes after the couple were seen leaving.
Ashby was later met in the lot area of the establishment, where he was allegedly cautioned, and told officers, “Oh that morning, I only went there for a short while.” They then arrested and charged Mr. Ashby for trespassing.
