ROAD TOWN, Tortola, VI - When the Dr the Hon Natalio D. Wheatley (R7)- led delegation goes to London later this year, there are some specific items they will be seeking from the new constitution.

Elected Members agreed to relocate the public service leadership from under the Governor and Deputy Governor to the Premier through a strengthened Cabinet Office, with the Cabinet Secretary recognised as Head of the Public Service and responsible for arranging Cabinet business.

The Cabinet Secretary role, including acting appointments, would be restricted to an Ancestral Virgin Islander (used to be called an indigenous Virgin Islander) who is also a Belonger. The role of being responsible for the Public Service will be stripped from both the Governor and Deputy Governor in the new constitution.

Deputy Governor’s role must be Ancestral Virgin Islander

Meanwhile, Elected Members identified a need to modernise the constitutional arrangements for continuity in the exercise of executive functions when the Governor is absent or unable to act.

The aim was to enhance clarity, predictability, and stability within the acting framework, and to align eligibility for this senior constitutional role with the Virgin Islands’ approach to key public offices.

Elected Members agreed that the Constitution should require that the Deputy Governor be an Ancestral Virgin Islander who is also a Belonger, and that the Deputy Governor should automatically perform the Governor’s functions whenever the Governor is absent, ill, or otherwise unable to act, subject to any express constitutional exceptions.

Rationale of Elected Members

Members were of the view that the current acting arrangements are unnecessarily fragmented. They saw value in consolidating these into a single, automatic acting model, while still respecting any constitutional requirements for the Governor’s personal involvement (or through a specific instrument) where reserved functions necessitate it.

This change was viewed as a way to improve clarity, align with modern practices, reduce ambiguity, and support continuity in governance.

This will be achieved by a constitutional amendment, with consequential alignment across provisions that currently trigger acting or deputy constructs.

      Not under the Premier. Cronyism is a notable concern regarding whether the Premier will keep incompetent friends and family out of significant government management roles. What actions is the P.S. overseeing the ministries taking to prevent this, and is it possible to prevent? I am not convinced, and where are the checks and balances in this regard? Hence, it becomes entirely political, and public servants will not receive the appropriate justice for their legitimate complaints against upper management.

        Until governments in the BVI show maturity, this does not need to happen. They already choose senior heads who take instructions from them that impacts other people's lives whether negative or positive; the governor nor the UK gets involved with those decisions. What they don't want is public servants running for cover to anyone else, as has been recently done, but there is a God above.

      This matter is not about the current governor. The delegation is travelling to London to negotiate directly with the United Kingdom, and the proposal carries both merits and demerits. Those points will be addressed and settled through the negotiation process, which is the proper mechanism for determining the way forward.

      The thing is, those children born in the US have and will continue to have more rights than the ones born in the BVI. All they have to do is trace their ties to the BVI 3 generations on one side of their parents. The ones that are born in the BVI without any BVI parentela won’t have as much say as those.

    A vital component in the success of colonialism/Imperialism is control, in addition to being exclusively. What functions does the UK control but don’t fund, viz, civil service, RVIPF, HMP, judiciary, etc. The UK’s role and responsibility as the Administering Power tasked by the UN is to assist and guide the Virgin Islands towards a full measure of self-governance. As such, such civil service falling directly under the direct purview of local government is an important step in increasing the level of self-determination . The fear being by some is a lack of confidence in themselves, falsely seeing others as the upper class, self-hating, etc.It is time to be bold, strong, confident, etc. Do not forget that the BVI is a representative democracy,ie., people have the right, opportunity, privilege, etc, to go to the poll every 4 years to elect representatives to represent them in the HoA. However, that is not the end of the electorate role and responsibility; it includes staying engaged, holding elected members accountable.

      Well, there’s no governmental accountability in this territory, the government does as it pleases. Blocks any increase in the minimum wage whilst doubling their own salaries and the people can do nothing about it. Take the Governor out of the equation and you will have anarchy.

    The people need to take note of how this government is behaving as we enter the election period. Instead of TV dealing with the numerous ground level problems like education, healthcare, minimum wage and living standards: they double their salaries and engage in delusions of grandeur like this one at hand. A classic case of Nero fiddles whilst Rome burns. If we can’t find 13 good people come election time, perhaps a few years under UK government control might clean house and train a future local government.
