Gun Bill with stiff penalties tabled in HoA

ROAD TOWN, Tortola, VI - The National Democratic Party (NDP) has tabled legislation aimed at gun violence with proposed stiff fines and heavy sentences, including a mandatory 20 year sentence for being convicted of a gun offence.

The proposed legislation was tabled in the House of Assembly yesterday March 12, 2015.

The Firearm and Air Guns Amendment Act 2015 was tabled by Premier and Minister of Finance Dr The Honourable D. Orlando Smith, following up on a promise the NDP made during its campaign prior to the 2011 elections.

The Act when passed will give judges and magistrates the authority to use their discretion in imposing penalties where they feel that the penalties would be arbitrary or disproportionate.

According to the Act, persons other than juveniles who use a firearm in the commission of a crime, including kidnapping, robbery, rape or other sexual offences or domestic violence acts, face 15 years behind bars.

The Act states that for having prohibited weapons a person faces a minimum fine of $80,000 or no less than five years imprisonment.

For the Act of attempting to use a weapon to intimidate, threaten or cause injury to the governor or a judge, master or magistrate, public officer or member of the House of Assembly a person faces a sentence of 10 years.

For trading in firearms or air guns when one is unauthorised to do so, one faces a fine of $50,000 no less than $50,000 or imprisonment of not less than eight years.

Over the last months, despite the utterings from the Government to the contrary, persons on the streets say that crime, especially gun crime, is on the rise. The Opposition parties have been critical of the Government’s sloth in bringing the legislation aimed at addressing serious gun crime in the territory.

    Someone in their grave smile - Someone mom, dad, brother,sister other families & friends a like.
    If is one thing NDP did as a good things since they been in power, this will be it. However adding to the (mandatory 20 year sentence for being convicted & The ( gun crime; 10 years for threatening with a gun) While this is still let's just go to gridlock & cut the goose chase & add 2 years on each gun shot, as the basic hand gun carry 8 shots, 8x2=16. 16 years for the shot & 20 years in convicted. That's 36 years just for being stupid, If i was a (Bad man Thug) this will make me think twice...............


    However good to wake up to good new.

    Am I not reading what everyone else is ? Where is the mandatory jail sentence? I am seeing fine or jail, we were promised MANDATORY JAIL time for illegal guns.A fine no matter what amount is nothing to drug dealers carrying a gun.

    Good Act. One problem I personal see with that act.-----Importing and trading in fire-arms and Ammunitions when not authorized to do so--This crime should have received the stiffest penalty--But this act has it as the third less serious crime---We don`t make fire -arms and ammunitions here, people have to be bringing them in-That's called "importing/trading". If they don`t get in, they won`t be none to used

    threatening with a gun = 25 years
    caught with a gun = 20 years
    caught with a gun + bullets = 30 years
    commit a gun crime = 40 years
    murder with a gun = 80 years

    the laws in the BVI are good; this law is also good law; what we need is the enforcement of the law(s)...we need more border patrols by police/customs...the virgin islands police-force have a big old patrol boats that is always/most times docked, that vessel needs to be out patrolling our borders more...we do not manufacture guns here in BVI but we have all types of guns on our streets...I personally think having more border patrols by customs/police send a message to the guns & dope runners BVI/customs out on the water patrolling( the presence of the police send a message).....call on the governor to ask the united kingdom to help us with border patrols)..the guns are coming in and someone must step up to the plate and protect our borders....

      Does it really matter. Every cloud has a silver lining.
      The convicted could also
      look at it as his positive contribution to society.
      Parents might also revisit their roles and seek to gain the respect of their children.
      An all around win win.

    no one saying anything about legitimate self defense using a gun. some of this sounds fascist.

      No one has a right to defend themselves with an illegal gun. You go to jail. There is no legitimate self defense with an illegal gun! You would be part of the problem for having the gun.

    The word around is that some people are importing weapons. Why doesnt thenpolice act on somenof these tipsvto carch these importers? It is high time a sting operation be conducted to catch somenof these importers.

    Notice that the legislation says not less than. Well this is fire here. It means you can be sentenced up to 30 years for one of those not less than offences depending on how the judgb or Magistrate view the severity of the crime. Lets see how this deters these thugs from reaping havoc in our country.

    Good going NDP. You are the better hope for the country.
