Full term pregnant woman among VZ nationals remanded on drug & firearm charges

- to return to court on October 12, 2020, four days before baby is due

ROAD TOWN, Tortola, VI- A woman who is in her full term of pregnancy was among six Venezuelans remanded to Her Majesty’s Prison (HMP) on charges relating to drugs and illegal entry following their appearance before Magistrate Christilyn Benjamin today, Thursday, October 1, 2020.

The court denied the request on behalf of Jessica Faronas Farinas, 32, by her attorney Stephen R. Daniels who implored the court to allow her to be remanded to a hotel room instead of the Balsam Ghut-based facility.

He told the court that her due date was October 16, 2020, which coincidentally, is days away from the next scheduled date of October 12, 2020, when she is to return to court, along with her co-accusers.

Magistrate Benjamin said if she requires medical assistance while at HMP, she will receive it. Notably, the prison is equipped with a nurse, and plans were underway to create a mini-hospital ward there. The prison also has staff tasked to transport prisoners to receive medical attention at the Dr D Orlando Smith Hospital in Road Town.

“All defendants will be remanded at HMP,” the magistrate said.

Charges, information

Hector Gonzalez, 26; Pineda Moises Gonzalez, 27; Franklin Ramirez Garcia, 26 and Jessica Faronas Farinas, 32, all Venezuelan Nationals, were jointly charged for Possession of a Controlled Drug (cocaine, 112 blocks weighing 124.36 kilograms), Possession of a Controlled Drug with Intent to Supply, Keeping a Firearm without a Licence, and Landing in the Territory without Permission from an Immigration Officer.

They were arrested and charged following a raid in the Anderson Hill area on Sunday, September 27, 2020.

The four are represented by Lawyer Stephen Daniels.

The other two Venezuelans, Dannys Rodriguez Robles, 59 and Emerais Lopez Leiva, 55, who were charged for Overstaying Landing Permit, were not represented.

For the defendants being represented by Daniels, the charges were read for their information, but no allegations were read as per his request. They will be expected to plead and hear the allegations/facts at the next court date.

The duo who were charged for Overstaying Landing Permit asked for lawyers to represent them and the court ruled that the reading of the charges and their pleas will be pushed to Monday, October 5, 2020.

Attorney O’Neil Simpson is the Crown Counsel handling the matter.

      If you pregnant, do not break the law if you do not wish to have your child up Balo. She should have thought about the well being of her child before allegedly being involved in illegal activities.

      I am going to be as transparent as I possibly can. If it had been a pregnant woman from the BVI that was caught in Venezuela for the same exact crime, she would be sitting in jail. I have empathy for the innocent unborn child and wish the best for the unborn child. I don’t have any empathy for the mother that chose to risk and endanger the life of her unborn child.

      In other countries there are pregnant women in jail for years, they give birth in the hospital and go right back to jail. And those prisons ARE PRISONS!!! They sleep on the cold floor etc. stop the non sense!! THE PRISON HERE IS A HOTEL!!

      She should have thought about her child before allegedly engaging in illegal activities. There are consequences to everything, this is hers. Women have given birth in prison before. She isn't the first and won't be the last.

      The Magistrate did nothing wrong. Pregnant women go to jail all around the World and give birth in jail. If she could smuggle all the way to the BVI putting herself and baby at risk, jail should be a piece of cake for her. She will be just fine at the women’s prison. When she was being smuggle here on the open water, suppose she had gone into labor or given birth out at sea. Please, she will be just fine where she is. Free medical care, three squares and a cot. Look, I am a tax payer and the only reason I am not flipping my lid is because I feel sorry and have compassion for her innocent unborn child. Her, I don’t care anything about her.

      if she was from road town most of u on here blogging would have been singing a total different song. lots of you in this territory continues to falt locals for drug trade while the spanish & irish deeply involved. pay more attention to the private charter boats and salvage companies in the british virgin islands. search warrants will be quickly executed at homes of locals while homes or private villas consuming the very same substances and is labeled recreational usage whereas the boy from road town is labeled a crack-head or hooked on drugs.....she should be given no less than 10 years come here f$cin& up our country

    This is crazy! Clearly they are here will illegal intentions and who knows what they have already done. This case should be taken very seriously and send a VERY strong message that we punish to the MAX anyone coming into the BVI with illegal intentions. Lost them at HMS. @Goverment of the Virgin Islands don’t play with them.

      Had she been in her home country, would she walk because she is pregnant? I think not! Would they let you or a loved one walk? I think not! There is no rule of law that says pregnant women should automatically be pardoned for any crime committed. This woman isn’t the first to be a jailed pregnant woman and she won’t be the last. Hint! Hint! Ensure that you check your family planning calendar before planning to participate in criminal activities.

    It is inhuman. Yes she is a part of a criminal enterprise but she is innocent until proven guilty. They should take into consideration her condition so she can be placed somewhere else beside the prison. She is 9 months pregnant. Everyone knows how risky a pregnant woman is. Going through so most stress at the moment can cause to loose the baby. It is immoral to jail a baby. It is against human rights which is universal. No matter of her nationality, her ethnicity, her social status , her color she is a human being. If the crime she has committed is so severe she should be at least benefited of this constitutional proviso "RIGHT TO A SPEEDY TRIAL". The BVI claims to be a Christian society where the love for others? What the churches said in a situation like this? Where immorality and wickedness are exhibited the church's leaders should intervene and remind the states of its obligation. Treat others as you would like to be treated. God forbid if something happens to this woman and the child in our Prison what consequences that will have in the BVI reputation around the world.? We can be firmed and human at the same time. I am calling on the media, the churches,the ladies groups in the churches,the Christian council, UNESCO OFFICE IN TORTOLA, family support network, social services,Red Cross and concerned citizens to speak out. This child will be born behind a prison wall..................

    There are terms and provisions for this situation the child be born and she will breast feed it up to six weeks by that time if there is any close family members or friend who can take care of the child or it will go into a government foster care home untill she is release or it can be send back to her family in vz
    But on second taught where is the father is he one of the men remanded or he is legal he can care for the child
    May be it is a local then it may have roots hare cause nobody asking about the father that put it there

    For real if you know your pregnant dont be involved in any wrong doing, and when you get caught you expect compassion, when you know better, and s***8accomponied by drugleaders/criminals, to come &*^%up the Island more and kill of people with them dirty drugs, turning people into crack heads, get them the &*(^%$ out of here, why dont u people go somewhere else, keep coming to our island we dont want u people, cause all yo do is #%%^^ the place up and cause trouble/problems
