ROAD TOWN, Tortola, VI – A 22 year-old man accused of driving over the right foot of a security guard in August 2009 will know his fate on June 29, 2012, while his father, who allegedly egged him on, will stand trial on that same day in the Magistrate’s Court.

Kyle Gumbs is charged with assault occasioning actual bodily harm, and pleaded guilty to the offence on February 17, 2012 before Magistrate Tamia Richards. His father, Wesley Gumbs, on the other hand is charged with threatening language, an offence he vehemently denies.

According to court reports, on Sunday, August 2, 2009, at around 7:30 p.m., Landa Charles, a security guard working at the Festival Village, stopped Kyle from entering the ground because his vehicle did not have the pass to be allowed entry.

However, he became upset and began to argue with Ms. Charles, and it was then his father Wesley came up and allegedly begun to verbally assault the security officer and urged his son “to run her down”.

Heeding his father’s advice, Kyle allegedly drove over the right foot of Ms. Charles and drove away.

The doctor’s report indicated that Ms. Charles suffered soft tissue swelling and tenderness. She also still suffers from the effect of the injury.

Both men are represented by Patrick Thompson and are on bail.

The justice system stinks. My child foot was run over by a guy and suffered tissue damage and after making a report to the police, I waited 18 months for a police report that stated that he was not liabiliable for the damages sustained and his actions towards my child. How is it this case was able to be presented to magistrate court. Is there any justice for VI Landers anymore!!!

You sound stupid!! this has nothing to do with born here. You need a vehicle pass to get into the festival grounds, bottom line. You dont have one, you cannot enter. We must learn to adhear to rules and regulations. That young man is to rude.
