Fisherman accused of assaulting girlfriend on boat
Gary Smith, 39, of East End pleaded not guilty to the charge of common assault when he appeared before Senior Magistrate Tamia Richards. The defendant was unrepresented at the time of his appearance.
The court heard that the defendant and his girlfriend lived together with his mother at East End and that on November 8, 2012 the defendant and the Virtual Complainant (VC) were just off the island of Great Camanoe when they allegedly got into an argument during which the defendant subsequently got upset and allegedly hit the VC. The VC retaliated by hitting the defendant, according to the facts read in court.
It is at this point that the accused allegedly pushed the VC off the side of the boat causing her head to enter the water while her feet were hooked on to the boat.
The defendant then allegedly pulled her up but the fight continued between the two. Mr Smith then allegedly struck the VC with his elbow on her mouth which caused her lip to burst. The matter was next reported to the Police station and the VC was seen by Police Officers who observed that she had a burst lower lip.
The VC reportedly received medical attention on Friday November 9, 2012. When officers met with the defendant at the Police Station he alleged that the VC had hit him first and he put his hand up to block her after which his elbow hit her mouth. He was then granted Police bail.
The defendant, who is a Virgin Islander, was today granted $45,000 bail with one signed surety and ordered to immediately report to the Partnership for Peace Programme on leaving the court room.
He was instructed to return to court on February 15, 2013.
