Findings of CoI not 'justifiable' for direct rule– Cromwell Smith

- says CoI Report has 'plenty of ambiguous language & lacks supporting evidence

ROAD TOWN, Tortola, VI– Commentator and activist Mr Cromwell Smith aka Edju En Ka has said the Commission of Inquiry (CoI) Report is full of ambiguous language and lacks supporting evidence for the many serious pronouncements.

Mr Smith was at the time speaking during a May 11, 2022, episode of ‘Territories Talk’, a cross-border conversation on the challenges of British Overseas Territories.

“The report is not the easiest read, and I suggested to some of my colleagues that we get an attorney or someone competent in reading these types of documents to do an analysis of the document,” he said.

Smith said that given the language of the report, the legal mind could look at all that is being said and break down what recommendations of the report may not be in the best interest of the VI.

No justification for direct rule – Cromwell Smith

Mr Smith added that the ambiguous language in portions read included phrases like, ‘may have been some dishonesty’ and ‘environment conducive to corruption’, which he said lacked supporting evidence.”

“Most of the recommendations I think are designed to strengthen civil service processes, more audits, and better structures and processes to make sure the administration is better and close some of the loopholes and so on,” he said.

Mr Smith added, “That gives me the feeling direct rule is not justifiable in the report although, Sir Gary Hickinbottom insisted that if the UK doesn’t implement direct rule, the challenges of the civil service and the politicians' disregard for good governance will continue indefinitely.”

Commissioner not qualified to make predictions on VI – Smith

He said such a prediction is one the commissioner, Sir Gary R. Hickinbottom, was not qualified to make on the future of the VI and its democratically elected leaders.

The predictions he said suggest, “As a people, we cannot fix a problem for ourselves, so if Britain does not take us over, those problems would never get fixed.”

Smith said another major challenge with the CoI Report was that it went further to absolve the Governor of the VI.

He said the CoI Report takes away the responsibility of the Governor and Governors in what it called possibilities of corruption or dishonesty.

    How about the ingrained corruption and wickedness in government and the community. How about the amount of power the LODGES have over government and the lives and wellbeing of our community. Surely Mr. Cromwell these two issues should be enough for two years of UK direct rule so that we can root out the evil that WE ALL KNOW exists.

    Cromwell, I listened to your show for one reason. The young lady, your guest, was making a lot of sense. It is quite obvious that she does not agree with a UK direct rule but her reasoning and statements were fair. Her knowledge of how government works were exemplary. You on the other hand were just plain and were just bent on finding a "tag" to pin on the Governor and his predecessor. One of the things we bragged about here, is the fact that we ran a Governor from these shores and how he had to catch a small boat from the harbor. We blamed some of them in the past for abusing their powers when they attempted to get involved in decisions made by our elected members and went as far as to remind them that they were not elected by the people of this territory. Now you are saying that they should be blamed because they did not step in and stop the wrongs that were going on in our Government. You then went on to look at the Police Force under the Governor. In my humble opinion, it is the only department that has shown any efforts in fighting corruption in its rank. Do you know the number of Officers that were arrested, suspended, or fired when they are found guilty? Does that not tell you something? Do you believe that corruption does not exist in other Departments? Then why has that issue not been dealt with? You then went on to ramble about contracts and some foolishness about it being a cultural thing. Thanks again to the young lady who pointed out to him the laws of contracts. Sir, your time came and gone. The people have spoken. Stop blaming other people for shortcomings. That has been going on too long now.

      What the Premier has done or did not do is not supporting evidence to take away the people of this territory's democratic roghts. There are two different isues at play here. Temporary help is OK but without a constitution, what Fahie or any one else have done will be child's play to what will transpire. There are no angels on earth, even though some people will like us to think that they are above reproach. What Fahie has done is being used to accomplish a plan that was already in the works. This is bigger than Fahie's mistake.

    No, seriously- are the people of the BVI delusional, in denial or both. I mean, what does it really take? The implosion of the entire territory perhaps? Wait that pretty much recently happened. It doesn't matter how man join this bandwagon about UK rule and colonialization. The fact remains the people of the BVI are so inherently corrupt and inept in governance, that there simply isn't any other viable option left. Quit flogging the dead horse, sit on your pride and egos and enjoy the beds you have so dutifully procured for yourselves. You will never learn if the lesson is not taught. And do not come talking about independence because in that state you are pretty much worthless to the rest of the world. Perhaps that's what you really need to see how you stand up against the 'down islands' and the rest of the world. Just take a look at the other independent nations lobbying on your behalf..they really do not have much going for them. Careful where your support and advice come from. Adieu!

    If you start with the premise that we have a right to self-determination there is no justification for direct rule or constitutional suspension. If the UK wants us to be under their direct rule they should entice us into integration. Any form of colonial rule is wrong and antiquated including the present relationship with the UK. IT doesn't make any sense that we can choose to sever ourselves from the UK and at the same time they can force colonial rule on us. Self-determination is a progressive one way road of travel; It doesn't lend itself to regression. The UK isn't allowed to interrupt the process simply because they are our former colonizer. Either we have the right to self determine or we don't. If we do then every relationship, correspondence and interaction with the UK should be with that intention.

    Agree with Edju En Ka. The constitution should not be suspended and UK direct rule imposed based on vague, subjective findings that are not supported by concrete evidence. It is insulting to Virgin Islanders that only the UK can fix the VI’s problem. That is superiority, colonialist, outdated, racist thinking. There are few, if any, problems in the world that only one race can fix. Reparative justice though is one problem the UK alone can fix. The I alone can fix It mantra was disastrous.

In the Bible, Solomon employed wisdom and understanding by threatening to split a baby in two to get it to the right mother. No Solomonic wisdom employed in calling a spade a spade here. One side that should also share in the blame was absolved of any responsibility. There are no Pilates in this sordid governing debacle. My view is not a popular one but I not losing any sleep.
