Father gets 11 years for molesting daughter

ROAD TOWN, Tortola, VI - A man convicted of sexually molesting his 11 year-old daughter was given an 11-year sentence by Justice Indra Hariprashad-Charles this afternoon, Tuesday November 15, 2011.

The Sea Cows Bay resident was sentenced to eight years for incest and three years for indecent assault. The sentences are to run consecutively.

Due to the sensitive nature of the case, media houses were asked not to publish the convicted man’s name, since the Virtual Complainant (VC) could be easily identified.

After a four day trial that concluded on Thursday November 3, 2011 in the High Court, a nine member jury returned unanimous verdicts on the sexual related offences.

The 43 year-old had been charged with three counts of indecent assault, two counts of incest, three counts of buggery and two counts rape – however, he was found not guilty on the two latter offences.

Since his arrest in early July, the Virgin Islander had maintained his innocence. He was represented by Patrick Thompson. Principal Crown Counsel (ag) Tiffany Scatliffe appeared for the Crown.

The Crown’s main witness was the daughter, who testified via video link. Other witnesses include the investigating officer (IO), the doctor who examined her and the mother.

According to court records, the incidents came to light when the VC took a "highly sexual book" to school, prompting the school’s principal to contact her mother, and a conversation between mother and child revealed some disturbing facts.

Ultimately, she was taken to Eureka Medical clinic, where it was discovered her hymen was not intact. This revelation sparked a police investigation.

      Why would it cause a lawsuit? no one can see his face. Don't understand why he is hiding, he wasn't hiding when he was doing his deed. My gosh, his own child.

    talk about INJUSTICE!!!! I don't think this judge thought about how much this has ruined this young lady's life. Why was he not found guilty of the rape and buggery charges? This man is sick and he deserved no leniency!!! This is not fair. How is this sending a message to the other sick bastards out there?

      This judge is much better than Stephens in my opinion. This creep got 11 yrs for sexual assault, when the other judge was giving less time for actual rape and buggery. Now the question is how was he not found guilty of the Rape and BUGGERY. I think 11 yrs is alot without a charge of rape. Now does he deserve to be buried under the jail, OF COURSE. However she dealt him good time for what he was charged with

    Both Justice Indra Hariprashad-Charles and I share similar feelings when it comes to sentencing involving a crime of abuse to minors like this. I guess she calculated a year of prison time per year of age. Hmm, 11 years? Wow....

    "A man accused of..." Shouldn't that read, "A man convicted of..." instead? Granted, I'm no legal professional and the terminology here may be different than where I'm from, but simply being "accused" can often allow some doubt regarding the person's guilt. If the man's been sentenced, he's a convict, not a suspect.

    Look, this man is my cousin. I am so ashame and disappointed, he needs to get life and cut off his penis. Why are they hidding his name? His name needs to be publish so the world could know what he did and who he is, so thta we he comes out of jail people could be cautious around him.
