DR man spared jail, fined $2K for attacking wife
The Dominican national was fined $1,000 or two months in prison for assault occasioning actual bodily harm; $1,000 or two months in prison for criminal trespass and 12 months suspended sentence, or two years, for being armed with an offensive weapon.
He had pleaded guilty to the offences on June 16, 2011.
Before handing down her decision, Magistrate Tamia Richards indicated that she took into account the father of three guilty plea at the earliest opportunity, his express of remorse and the fact that he attended the Partnership for Peace Programme.
However, she pointed that Pena did strike the Virtual Complainant (VC) repeatedly, she was vulnerable, depended on him financially and that he attacked her during the wee hours on March 23, 2011 at their Sea Cow’s Bay residence.
But she also took into account that the VC is no longer residing in the Territory, therefore he posed no threat to her.
With regards to the fines, Pena’s lawyer Richard Rowe asked for some time for the monies to be paid, which the Magistrate agreed to.
Pena has until May 4, 2012 to pay the fines.
