DR man prosecuted for alleged knife assault on girlfriend

ROAD TOWN, Tortola, VI – Dominican Republic national, Kelvin Solomon, 26, appeared before the Magistrate’s Court on January 23, 2013 charged with the offences of criminal trespass, being armed with an offensive weapon and assault occasioning actual bodily harm. The offences were allegedly committed on November 18, 2012.

The defendant, who was unrepresented at the time, did not offer a plea to any of the charges.

According to the Prosecution’s case read by Crown Counsel Leslie-Ann Faulkner, the accused and the Virtual Complainant (VC) currently have a five month baby together. It was disclosed that at the time of the incident, the couple was separated and the VC was residing at Horse Path, while the defendant lived at Sea Cows Bay. They have since reportedly reconciled.

The Court heard that on November 18, 2012 the defendant asked the VC to pick him up from a boat at Road Town, but she refused. It is alleged that on the same day the defendant made his way to the VC’s home in Horse Path, and knocked on the door, but the VC refused to let him in.
The defendant subsequently gained entry by walking on a ledge and going through a sliding door. He then went into the VC’s bedroom where she and the baby were.

The Court was also told that the defendant then advanced towards the VC and allegedly pushed her down on the sofa which was in the bedroom.

While she was on the sofa he allegedly began to beat her on her face with his hands.

He then allegedly stopped hitting the VC and went to the kitchen before returning to the bedroom with a knife where the VC and the baby were at the time. He allegedly pressed the knife against the VC’s face and told her, “I would kill you.”

The VC ran to another bedroom in the house but the accused allegedly followed her and pushed her on the bed and began to beat her all over her body. She reportedly fought back and in the process ripped his shirt and burst his chain. The VC was said to have begged the defendant to stop and asked him to leave her alone.

During the ordeal, the couple’s child was reportedly crying in the other bedroom.

The VC later managed to escape and ran to the first bedroom and locked herself in it. She then contacted the police, who responded at the home and met the defendant there.
The knife was retrieved and strands of hair were allegedly found on the weapon. The police also observed visible injuries on the VC and a small cut to her neck. She was later transported to Peebles Hospital and was treated for injuries to her face, neck, nose, and other parts of her body.

The defendant was offered $50,000 bail signed with one surety and asked to return to court on February 7, 2013
