DPP Office most misunderstood, undervalued, underappreciated Gov’t Dept- Scatliffe-Esprit

ROAD TOWN, Tortola, VI- Appearing before the House of Assembly’s Standing Finance Committee (SFC) last year over the 2024 Budget, the Director of Public Prosecutions (DPP) Mrs Tiffany R. Scatliffe-Esprit explained the role of her Department.

The DPP stated that her “office remains one of the most misunderstood, undervalued, underappreciated and oversubscribed government departments.” She further stated that this was reflected in the continued fight for adequate funding and human resources that were allocated to the office. Despite these shortcomings, they continuously worked to meet their constitutional mandate as required. 

The DPP listed the following vacant positions: 1 Financial Crown Counsel, 2 Senior Crown Counsels, 2 Crown Counsels, 2 Legal Executive Officers (posts were approved in the SAP earlier this year), 1 Paralegal, 1 Case File Clerk, and 1 Office Generalist II.

My department’s role-DPP

Mrs Scatliffe-Esprit noted that she remains short-staffed and needs more positions.

The DPP indicated that the prosecutor's role was to “present a case that is prepared by the investigative law enforcement authority.” It is their job to facilitate witnesses to give their evidence within the remit of law before a court, and to ensure that persons who have had their rights violated, and those who have been accused of criminal wrongdoing, have an opportunity to gain justice.

Some members of the public have interpreted this to mean that when a case is lost by the DPP Office it’s not necessarily her failure, but that of law enforcement.

The DPP also raised the issue while testifying before the SFC that she wished to participate in cybercrime, money laundering terrorist financing and proliferation financing training, and also to extend administrative training, which she hoped would help improve overall performance.

I need more staff-DPP

The Leader of the Opposition and Territorial Member Hon Ronnie W. Skelton asked the DPP what was her current staff complement and how many staff was required to run an effective office.

The DPP responded that her current staff complement was 28; however, she noted a decently staffed office would normally have approximately 40 staff. It remains unclear why the Attorney General’s Chambers was able to increase staff by 16 in three short years and the DDP Office has not had success in filling vacant posts.

Is the DPP office independent? 

Recently, many from the political and social classes have raised the issue of interference by the Governor and Police Commissioner, along with UK Police Officers, as to who is prosecuted and what cases to move forward with.

One elected official has accused the controversial outgoing Governor John J. Rankin, CMG of using the DPP office as a weapon to go after his critics.

      We don’t need a UK DPP we just need a reasonably competent one. The current DPP is not fit for purpose, and the unfilled positions in her dept are because no sensible lawyer would work for her.

If law enforcement presents a case to the office of the DPP and there is little or no evidence why is the matter taken before a court? Always looking for someone to throw under the bus.

          It's the DPP to blame. Law Enforcement can only present to them what they have, she is the one who makes the decision based on what they present whether to press charges or not. And once pressed then it goes to Court. Half the time ain't no evidence but anything for her to try to win a case.

        We need JUSTICE!!! We need the Governor to be charged for Breach of Trust to allow his white UK Commissioner of Police to be still on the job while being looked into for allegations of corruption and breach of trust. This is wrong and the BVI people need to stand up against this abuse of power by the Governor.

    There is no way any government can fund 48 new preauthored and unreasonable COI recommendations and timeframes and still fund all the needs of existing government departments and programmes. The UK is strategically trying to organize how to bankrupt the treasury while making their hands look clean.

    If the DPP did what all the COP is accused of doing wrong the Governor would have sent her home and hold a full investigation. It is so wrong what the Governor is doing. Ot is so clear these actions are also hinged on racism and unfairness.

    I will like to know her legal stance on the unethical manner the Governor is handling the alleged corruption of the Commissioner of Police especially when you stack it up against how all other public officers who have been accused of same is being dealt with by the same Governor.

    Madam, DPP, if you would only do some introspection and realize how terrible you treat people, especially in your partner agencies in the criminal justice system. Your default posture reeks of condescension and contempt for people. Otherwise, I believe your office is misunderstood and unappreciated, just your behaviour plays some role in that reality.

    The man died over three years ago and you still have the man money hold up, give the man money to his wife and children you are not going to find anything illegal, every couple of months you finding excuse not to give up the money. you and others in your department are a legal bunch of thieves and you complain about criminals, you are the worst, give the man family his legal money Criminals, all of you .Every time the case calls for a hearing, you asking for a postponement for over three years, You are of your father the devil .Give the man family his money and catch the murderers.
