ROAD TOWN, Tortola, VI - The plot around the boating accident on October 16, 2021 that took the life of local resident Frandie M. Martin Jr., seems to have more questions than answers.

The boat Blue Bayou, belonging to Andrew Morrell which will be used as part of the evidence, has been repaired and re-sprayed over at a boatyard in Nanny Cay and released to its owner according to information obtained from sources familiar with the situation.

It is unclear now why the boat was released to Mr Morrell, if the evidence of the boat has already been fully documented or why the vessel was not kept in police custody until the investigation was concluded.

“A jury may have to rely on still photos,” a senior lawyer told our newsroom on condition of anonymity.

Where is the urine sample?

It is also our newsroom's understanding that Mr Morrell’s urine sample taken hours after the accident by the Dr. D Orlando Smith Hospital has reportedly disappeared. Officials of the Royal Virgin Islands Police Force (RVIPF) are tight-lipped as to who took the urine sample at the hospital lab and where it was stored.

There are also unconfirmed reports that after the accident, Mr. Morrell wanted to speak to two high-ranking UK nationals, the Police Commissioner and the Governor, however, our news centre could not independently verify these claims. 

Two legal systems?

Since Martin’s death, there has been public and social media pressure over the circumstances surrounding the boat accident that occurred at night, and whether the VI legal system is colour blind.

It was six months later (April 13, 2022) that the Director of Public Prosecution announced that Mr. Morrell has been charged with Manslaughter, Causing Serious Injury to a Person while on Board a Vessel; and Failing to Render Assistance after a Collision.

      Morrell does not own the boat. The owner left the wheel and Morrell was never the captain of the boat.

      The question is why the boat was not in the custody of the Coast Guard or Police. It is down right carelessness or willfully allow the owner to have access due to corruption.

        The family may have to seek legal counsel….seems like a good case against the Royal Police Force. The police force needs reforming…they are not trained in criminal investigations as they should be.

      Morrell's biggest mistake was leaving the scene. However there are a few other points being over looked. Firstly , he was neither the owner or the captain of the vessel. Secondly , as the vessel Morrell was on was coming from VG and the other vessel from the Willy T Morrels vessel had the right of way according to International Collision Regulations ( the vessel approaching from the right has the right of way ). Of course there are all sorts of other questions for the authorities to figure out.....alcohol , drugs , watchkeeping , etc. Do you think it would be possible in the BVI to keep race out of this , especially until all the facts are uncovered.

      Of course it is tragic that this good man died and others were injured , however that does not automatically make the other party guilty. The facts will come out. Regardless of the cause of the accident , leaving the scene is inexcusable even though they had their own injuries aboard their own vessel.

    It would seem to me that the drivers of both boats would be potentially responsible for this accident, and the tragic outcome of it.
    But then again, all of those (including myself) who don’t know all the facts should sit down and keep quiet, until the facts are presented in a court of law (as opposed to the court of rumor, gossip, social media and public opinion).

I want Claude cline to tell me these bvi islanders he rally n for to be in authority if this is the best they can come up with how in The name of justice can we accept this ?who instructed the police has to be a top officer either the commissioner or the deputy had to give instructions for the officer to grant bail and who advised the commissioner or the deputy is it the dpp ?       I remembered when the white man killed the two boys up VG side. He ran over their boat, refused to assist, and fled the scene. Jurors found him guilty and the Judge give him only a fine.

    Reminds me of the incident in the USVI WHERE the white man killed his girlfriend and refused the police and coast guard access to his vessel. Next thing we read that he was down st Lucia with the same boat, repaired and on the market. Ayo think these *$^&* w*** people easy?

    Tell dpp that the british system of justice is not the same as usa.
    In usa the police must go to the D.A with a file and the DA decides on charges etc..
    In bvi it is the police under the police Act to investigate and charge and file complaints.
    The dpp take over the role of the police..

    The boat was released by the DPP as they had no further use for it. Only they can release it, which they did months ago. The fact this is being called a coverup is more proof of failures within the system, blame throwing and misinformation. The captain of the other boat is totally at fault according to the law, why has he not been interviewed, questioned, tested or charged?

    Has International Maritime Law been suspended in the BVI on police corruption and racial grounds? When 2 boats collide Collision Regulation 5 clearly states that as the Morrell boat was on the starboard side it had the right of way. There are 2 scandals here: why is the innocent under the law Morrell being prosecuted at all and the guilty other driver is not? I hope the answer is not what I fear it is, or it will be a disaster for our charter boat industry if maritime law is suspended due to police corruption and racial prejudice.

    For a high value asset it would be normal to photo and document then release the boat - in order that the BVI taxpayer does not fund years of storage and maintenance. (There has already been a case where the owner was paid by gov more than the value of the vessel impounded!). At the incident it would have been normal to take a blood test and submit blood/urine tests results not the pee sample.
