ROAD TOWN, Tortola, VI - Mida Rabsatt pleaded not guilty when she appeared before the court today, October 5, 2012 on charges of common assault.

A Belonger and resident of Purcell Estate, Ms Rabsatt chose not to seek counsel but instead indicated to the court that she would be representing herself in the matter. The crown was represented by Leslie-Ann Faulkner.

Allegations in the matter are that on Saturday, March 31, 2012 at about 11 P.M., the Virtual Complainant (VC), Natividad Tibre, was at work at Cool Breeze bar in Jost Van Dyke when the defendant, along with a gentleman by the name of Leo, entered the bar.

The defendant then reportedly asked the VC if she knew Leo to which the VC responded by saying, “Yes, he’s my friend”.

The defendant then allegedly said “he is my husband” to which the VC reportedly replied that she did not know that.

The defendant then allegedly hit the VC “hard across the left side of her face with the palm of her hand.” Rabsatt was allegedly only able to strike once as she was restrained by "Leo" when she allegedly attempted to strike again.

The VC then reportedly attempted to get from behind the bar counter during which time the defendant allegedly began searching her purse and said “If you come near me I will cut you”. The VC explained that she saw no knife at the time.

Police reportedly arrived at the scene shortly afterwards with the defendant still there.

The court was told that an Officer Livcott reportedly spoke to both the defendant and the VC. He later informed the defendant that a report had been made by the VC and cautioned her. The defendant allegedly replied, “she slapped at me first because we had the same man".

The prosecution did not object to bail, which was set at $35,000 with one signed surety. The defendant’s travel documents are to be lodged with Police and she was also asked to have no contact with the VC and to report to the Road Town Police Station on Mondays and Fridays between 6 A.M. and 6 P.M.

Rabsatt is to return to court on December 4, 2012 for the start of her trial.
