Bar owner fined $200 for opening beyond prescribed time

ROAD TOWN, Tortola, VI – Epifania Thomas, the owner of Anna’s Bar in Sea Cows Bay, was fined $200 or an alternative of four (4) days imprisonment on the charge of failing to close her business within the prescribed time for closing.

The judgement was read to her by Senior Magistrate Tamia Richards when the defendant appeared before the Magistrate’s Court on December 17, 2012.

Principal Crown Counsel Tiffany Scatliffe held for the prosecution in place of Crown Counsel Leslie Ann Faulkner who had conduct of the mater.

Thomas, who utilised an interpreter during the course of her matter, pleaded guilty to the offence at an earlier court appearance. The Magistrate related that the defendant had a previous conviction for a similar offence in 2011.

When the defendant appeared before the court on December 4, 2012, her attorney, Mr Patrick Thompson, in offering mitigation, told the court that she was a Belonger and had been operating the bar for about eight years. He noted that it was the sole source of her income.

He further related to the court that the defendant was very apologetic for keeping her establishment opened beyond the prescribed time and recognised that it was an offence.

The attorney also asked that the court to take  into consideration the time at which the offence reportedly occurred (1:50AM) and that there were only five patrons in the bar at that time; further, there was no attempt on the defendant’s part to attract additional customers.

He added that she was winding down operations at the time when Officer Callwood came to the premesis.

He had pleaded with the court to reprimand and discharge his client since she was a hardworking and decent lady.

While handing down her judgement, Senior Magistrate Richards remarked that the court was surprised at how lightly the legislature takes offences of this nature.

    while it seems a small violation, the point is that laws have to be upheld for the greater good of the community. If exceptions for one, exceptions for all... and if there were only 5 patrons, it would have been easy to shut it down at the perscribed time. wouldn't it be nice if everyone followed the laws on everything?! It would be such an orderly society where people could depend on officials to be responsible (respond) and citizens be respectful (respect).

    Super Cop does it again. She won't stay open late anymore. We must abide by the rules so there can be some comtrol or everything will go haywire. 5 patrons should have been told to leave because it is against the law to stay open any longer and I am sure they would have left with no problem...Enough said

    She has this business for 8 years? Is a belonger? Need an interpreter? How on earth we give status to people who can't even speak our language? No where in the world could that happen!!! Thanks officer Callwood. We live right behind that joint and hopefully will have a peaceful Christmas instead of her nuisance noises!!!

    a wonder if super cop is paying his ch...d supportance now. he better do that and stop harrass othe people who trying to make an honest living and by the way how come the police can have bands playing at there ball until 3am and want to close down people by midnight thats double standard

    if you cant make a living in your own coutry then what....how come that place at nanny cay is open to all hours and those other white owned busnesses in road town...oh forgot the COP is white as well !!!!! my bad?????

    Commisioner of POLICE how come east end police can't do the same with the Bar at Paraquita bay
    There open all hrs and very noisee. There never close when there suppose to. We need super cop at east end police station.

    Every country that I know of allows businesses who cater to the Tourist Trade special treatment because their business is tourism and the tourist shouldn't be hindered by certain local rules.
    For example election day Dry laws are not enforced in hotels that cater to tourist.
    It's Common Sense, not Black or White.
