ROAD TOWN, Tortola, VI- Some six months after a man was killed and others injured in a boating accident near Duff’s Bottom, Tortola in October 2021, a man has been slapped with several charges, including manslaughter.

Charges

Andrew Morrell has been charged with Manslaughter, Causing Serious Injury to a Person while on Board a Vessel; and Failing to Render Assistance after a Collision.

The accident had claimed the life of well-known musician Frandie M. Martin Jr.

According to the Office of the Director of Public Prosecutions (DPP) in a press release today, April 13, 2022, Complaints have been preferred as a result of the boat accident on October 16, 2021.

“As a result of the Police investigations, there is sufficient evidence and in the public interest to prefer complaints against Andrew Morrell for Manslaughter, contrary to the Criminal Code 1997 (as amended), Causing Serious Injury to a Person while on Board a Vessel, contrary to the Merchant Shipping Act, 2001 (as amended); and for Failing to Render Assistance after a Collision, contrary to the Merchant Shipping Act. 2001 (as amended).”

Morell to appear in court May 31, 2022

The Office of the DPP said Morrell was arrested and charged by the Police and granted bail with strict conditions.

He is scheduled to be brought before the Magistrates' Court on May 31, 2022.

“We are aware of the public interest in this matter, and remind the public that such investigations take time, and must be executed properly to ensure that there is due process for the victims as well as the accused,” the Office of the DPP stated in the press release.

Tragic boat accident

The tragic boat accident occurred around 6:30pm on Saturday, October 16, 2021, and involved a powerboat and a 40-foot Sunseeker yacht named Bayou.

According to reports, the yacht allegedly collided with the small powerboat with about three persons on board, almost cutting the powerboat in half.

Out of the three passengers on the powerboat, Mr Frandy Martin Jr, suffered severe injuries and later died.

The other two persons on the powerboat were taken to Dr D. Orlando Smith Hospital in the capital city, Road Town where they are undergoing treatment.

Our newsroom was told that several persons on the Sunseeker yacht also suffered minor injuries, and two reportedly required medical attention.

      “1. If another vessel is approaching you from the port — or left — side of your boat, you have the right of way and should maintain your speed and direction.“ Andy’s boat was heading west along the south shore of Tortola. Martin’s boat was heading North towards Tortola from Norman Island. Andy had the right of way. This is a universally accepted principal of International Maritime Law.

    Finally charges are issued against the operator of the Bayou in this fatal collision over 6 months ago. However the defendant is not the owner of this yacht just a charterer/renter. It appears that the yacht management company of Bayou could be guilty of criminal negligence if the accused is not a BVI licensed captain or has an expired BVI captain license. VISR needs to investigate these additional charges forthwith. If the defendant has a valid BVI captain license then the VISR and the BVI Port Authority need to commence a safety investigation to determine the cause of this fatality and amend their competency and captain qualifications for the operators of large fast planing charter motor yachts operating in BVI waters with passengers aboard to prevent such fatal collisions in the future.

      It wasn’t chartered. It was a private yacht and the owner was on board though not driving at the time of the accident.

    Is good for him because sailing a speed power boat comes with serious responsibilities and controlling the vessel with such care. But playing carelessness and out of control by threatening someone's life is a huge different story. All I have to say is that Rest In Peace to Mr. Frandy Martin Jr. My condolences to the family and friends that knew him extremely well. We all wish yu could of been here with us up to this day; walking, talking, and doin the things that yu luve to do with yur life

    It look like the Dpp is now in charge of making press releases on police investigations. All of a sudden she coming out making press releases. It is the police that if they arrest and charge ppl, they are the one to make the release, her job is to advised the police legally on criminal matters when an investigation is complete.       Section 153[2] for Manslaughter, under the Criminal Code 1997 states:- " Any person who is convicted of manslaughter is liable to imprisonment for life"...

      Section 27 No bail to be granted by the police in cases of certain offences, under the Police Act states;- "Nothing contained in section 25 or 26 authorizes a member of the Force to allow bail to a person charged with an offence the penalty for which is life imprisonment or a more severe penalty".

      So, according to section 27 of the Police Act, the COP cannot grant bail for manslaughter.

      Under section 59 of the Constitution, the DPP cannot instruct the Police to grant bail or not to grant bail; because the DPP, only have power to take over a prosecution that the police instituted in the Magistrate's Court.

      Therefore, the instructions from the DPP to the police, to grant bail for manslaughter, is unconstitutional and unlawful, under the Criminal Justice System.

      The DPP and COP are wrong in law!

    Section 27 of the Police Act Cap 165 states:-"Nothing contained in section 25 or 26 authorizes a member of the Force to allow bail to a person charged with an offence the penalty for which is LIFE imprisonment or a more severe penalty".

    According to the LAW, The DPP has NO power under section 59 of the Constitution, to instruct the Police, under the Police Act. to grant bail under sections 25 or 26 of the Police Act.

    The DPP cannot in law, grant bail to an individual, charged by the Police with a criminal offence. Therefore, if you cannot do an act, under a law, then, you cannot instruct another person to do the same act.

    So any instructions from the DPP to the Police is [wrong in law] unconstitutional and unlawful.

    The Police must therefore, revoke the bail, and charge Mr. Morrell before the court, right now, and let the Magistrate deny bail, and allow the High Court to grant bail; if necessary.

    The DPP [IS FUNDAMENTALLY WRONG IN LAW], and the DPP is Fundamentally incorrect in law.
    The DPP cannot in law,instruct the police to grant bail in contravention of section 27 of the Police Act.

      It’s like driving a car on a main road and someone comes out from a side road doesn’t give way and hits you, unfortunately the side road driver dies. Like roads, marine traffic also has rights of way. Was Morel negligent of not keeping a look out and diverting to avoid colliding- Yes. Did he cause the accident - no! its a tragedy and sad loss,of a young man’s life - this is paramount. What must be questioned is what about the captain of the vessel that hit into the right of way vessel? Is he under arrest?

    So many aspects of this reek of corruption and cover up. He was taken into police custody the night of the accident because he stank of alcohol at the hospital, like from 10 feet away! Where is the operating under the influence charge?
    Why has it taken 6 months to charge him?
    Why is he now on “Police bail” for a manslaughter charge?
    The DPP only reacting now because her office has come under pressure to do something because Lord knows, the police were doing their best to muck this investigation up. But wait! When did her press release say he is appearing before the magistrate again? Oh right, the 31st of no month in 2022. I will wait…
    They have already given the boat back to its owner months ago so he can destroy whatever evidence there was on it, so where is the grand investigation?
    For a seasoned captain sailing these waters his entire life, tell me what the hell he could have hit out there so hard that he did not think to stop and check around? There are no reefs, rock or buoys in that area that he could have hit and it sure as hell was not a whale. The extent of the damage to the other boat clearly shows that it was a very hard collision. How could he not know he hit something?
    He and the CoP are buddies and we know how the pale community stick together and protect each other.
    I’m just doing the Maths here and the addition is not adding up!

    This once again proves how corrupt these islands are. The other skipper was totally responsible. BY LAW. Yet he has not one charge brought against him?? The question is who does HE know. Why is HE being protected??? This is clearly showing the deep levels of corruption that is here in the BVI. Shameful behaviour. We can only hope for justice for Frandy Martin. That will come when the one actually responsible is charged. So far, he is walking free. If you all really want justice then you should be looking at HIM.

    The foto of the boat in which the deceased was riding was hit FROM THE RIGHT SIDE.
    Now look at the international colregs (rules of the road).
    When two vessels approach, the boat approaching from the right has the right of way.
    Since the deceased vessel was hit from the right, it means they were supposed to have turned to give the other boat room. I would expect the defence to clearly present this and ask for a summary dismissal.
    Not a surprise the police didn't take this into consideration, I wonder if they presented the collision details to our Shipping Registry and asked for an opinion?

      According to “Rule 15 Crossing Situation” of the Convention on the international Regulations for Preventing Collisions at Sea, 1972:

      • Must be two power-driven vessels, crossing (not head-on or overtaking), and involve risk of collision
      • The vessel which has on her starboard side another vessel crossing must give-way
      • As the give-way vessel, avoid crossing the bow when maneuvering to avoid collision

        Morrell boat was heading west along the south coast of Tola. The other boat was heading north from a floating bar on Normans. Morrell boat had the globally recognized right of way. Morrell can’t be charged with leaving the scene because he wasn’t the captain. The owner of the boat was on board. Morrell had only taken the wheel so that the owner could go to the bathroom.
