ROAD TOWN, Tortola, VI – Former legislator, Andre Penn, has two weeks to inform the court who will be his attorney when he re-appears in the High Court on February 27, 2012.

Penn, who had his conviction overturned in the Court of Appeal on January 17,2012 told Justice Rita Olivetti during the opening of the High Court criminal assizes this morning February 7, 2012 that he did not consult with a lawyer to give him legal advice.

In light of this, Justice Olivetti has given him two weeks to sort himself out and added, “I will not accept from you that you have not consulted legal counsel. I want a concrete position when you appear on February 27.”

And if everything goes according to plan, the Director of Public Prosecutions (DPP) Elizabeth Hinds told the court that the Crown is looking at March 6, 2012 as a possible trial date.

The former legislator, on March 2, 2011 – was found guilty of having sexual intercourse with a girl under the age of 13, buggery and indecent assault. He was serving 12 years. Following the Court of Appeal hearing on January 17, 2012, the decision was overturned and a new trial was ordered.

On January 18, 2012 he was granted $50,000 bail.

Meanwhile, 31 cases are slated to be heard during this assizes with 16 being traversed from the last assizes.
