The man will be sentenced on November 14.

The verdicts were unanimous.

The Sea Cows Bay resident was charged with three counts of indecent assault, two counts of incest, three counts of buggery and two counts rape – however, he was found not guilty on the two latter offences.

The 43 year-old will be sentenced on November 14, 2011, until then he will be on remand at HM prison. The trial began on Monday October 31 before Justice Indra Hariprashad-Charles.

Since his arrest in early July, the Virgin Islander has maintained his innocence and is represented by Patrick Thompson. Principal Crown Counsel (ag) Tiffany Scatliffe appeared for the Crown.

The Crown’s main witness was the daughter, who testified via video link. Other witnesses include the investigating officer (IO), the doctor who examined her and the mother.

According to court records, the incidents came to light when the VC took a highly sexual book to school, prompting the school’s principal to contact her mother, and a conversation between mother and child revealed some disturbing facts.

Ultimately, she was taken to Eureka Medical clinic, where it was discovered her hymen was not intact. This revelation sparked a police investigation.

In an interview with the Police, the VC indicated that the first incident occurred on August 21, 2010 at Duffs Bottom. She told officers that she was asleep between her parents, and was awaken after feeling her private part being massaged.

According to the VC, it was the defendant who was massaging her private part. Investigators heard that he inserted his finger into her part and she removed his hand. The defendant allegedly tried to insert his private part into the VC’s rectum but stopped when her mother woke up.

The court heard that the second incident occurred in September 2010 where the VC was once again sleeping with her parents and awoke once more to see the defendant massaging her private part.

In December 2010, sometime after 11 p.m., the VC who was spending the weekend at the father's home was watching television in the living room, and according to the VC, the convicted man sat next to her, put his hand in her bra and massaged her breasts. She contended she told him to stop. However, it is alleged that he ignored her plea and threatened to kill her if she told anyone. The VC said, her father continued to massage her breasts until a cousin came into the living room.

The next time the VC said she was sexually molested was sometime in January 2011. She was sleeping in her grandmother’s room when her father came into the bedroom and massaged her private part while covering her mouth with his hands.

The VC claimed that when she tried to move his hand, the defendant slapped her on the left side of her face. He then pushed aside her underwear and allegedly had anal sex with her until her aunt woke up.

March 2011 was when the next incident allegedly occurred when the VC was in the living room watching television and the defendant turned off the lights and told her if she told anyone he was going to kill her. He then laid on top of her and had intercourse with her all the while allegedly telling her that he would kill her if she told anyone.

In the latter part of March while at the grandmother’s home one night as the VC watched television, the court heard that the defendant came to the couch and tried to pull down her underwear. He taped her hands and mouth with what appeared to be brown tape, went on top of her and again allegedly had intercourse with her.

In July when the Police met the defendant following the report, he told the police that he did not have anything to say beside that it is a lie; and that his wife left him so his daughter no longer resides with him.
