Works Minister accused of violating building protocol

- FOL Limited makes the allegations against Hon Mark H. Vanterpool (R4) but Town & Country Planning Department sees no violation

PURCELL, Tortola, VI – A partner of FOL Limited has accused the Minister for Communications and Works Hon Mark H. Vanterpool (R4), who is also the proprietor of One Mart Superstore in Purcell, of violating construction protocol with the erection of a building next door to FOL Ltd.

This was brought to the attention of this news site as the business partner said everyone should comply with the building code, regardless of who they are and what position they hold.

“The issue is Mark (Hon Mark H. Vanterpool) is building directly on the boundary of the property. He did not leave the required space by law which is 10ft,” said the concerned businessman, who added that the building leaves no space on the four sides of the property.

Matter reported to TCP

According to FOL Ltd, this concern was reported to the Town and Country Planning Department, which responded promptly. Officers from the department visited the construction site last week Thursday and were observed taking measurements.

“However the project still proceeded…That was Thursday last week before they (Hon Vanterpool’s construction workers) even poured concrete,” said the concerned individual.

FOL Ltd sits alongside the construction site and according to the business it is not impeding their property. “But he did not leave the required space which, where my property is, where my wall/fence supposed to be put back. When he is finish his building there would be no space adequately for anybody to walk around his building.”

The complainer said Hon Vanterpool sought permission to remove his fence to allow for the construction to take place and that was granted, “But like I said the space for the bound is a violation.”

What goes for one should go for all

Asked why is this of such concern to him, the businessman said, “Because it is illegal and when I was building my building I had to follow that same protocol. Why does he not have to follow the same protocol?”

The concerned man said he did not discuss his concerns directly with Hon Vanterpool but rather with Head of the Town and Country Planning Department Mr Gregory W. Adams.

Information not accurate?

Contacted yesterday afternoon September 7, 2016 Mr Adams Acknowledged that the concern was brought to his office and he did have officers do the required evaluation/measurement.

“The information given to you (VINO) is not accurate to a point. My staff did go to the site that’s why I know what the case is you are talking about, so its factual in that regard that we did have someone visit to document what is happening.”

Mr Adams added, however, that it was inaccurate that any building violation was broken as raised by FOL Ltd.

He noted that should there be any further queries; the matter could be investigated further.

Contacted today, September 8, 2016 to find out how much space is required to exist between buildings and their boundaries, Mr Adams said he did not wish to comment any further on the issue as he said it was not fair to be commenting on allegations “when we have the facts here.”

Efforts to secure a comment from Hon Vanterpool proved futile.

    I am happy to know that also becsuse when I start building town and country better step aside because this is wrong and this happening in 2016 where we are cramp for parking space and buildings are still being built againstthe country reqirements. I remember when the court ordered that man at Dove Bottom to break down his wall for the sam reason as Mark Vanterpool.

    FOL Ltd should move to the Courts for an immediate injunction to prevent the further construction of the wall in contravention of the building code and seek judicial review of TCP decision. NONSENSE!

    If you have rules, laws and statutes my guess they apply to everyone. If it does not then we cannot say that there is equality. Whenn certain laws are used to stop Mary and later Fred gets a pass what say of this department that is charged with enforcing these laws. Some say Mark from here so he got all rights to do what he want like P down the Hway. Then the little men them getting stopped after spending thousands. Is this the Law, is this fair is it right? If one gets a pass because he has money, power and other influence then what reason should anyone respect the laws or the whims of the department when some violate it and get a pass.

      Shame on them for not suing the minister for not following the law. Space between the buildings, whether legal or not would be at least more functional and better design choice. This minister is a run-away freight train.

    I am reading this Article from Canada and this is another reason I am so afraid to return home. The laws of the BVI are for certain people, it been happening for ever. Everyone who own a piece of property or built a house already know that Greg Adams response is Hogwash and persons agreeing with this nonsense. This can only happen in Tortola where the people act like fools.

      @ wake up....why don't you come and demonstrate what needs to be done BUT I have to agree with you especially about Mr Noel Llyod; I grew in that era so as a young man I knew the positive action movement....what changed the territory is money and victimization; our people love money that's why the whites now rule all the money making companies then turns around and give our people a percentage from

    As I always say the Virgin Islands is a cow boy town or the Wild Wild West. The Purcell exit road was blocked Monday morning and motorists had to use One Mart parking lot to get out of Purcell. I don't remember hearing any bulletin that the road would be closed. Anyone who uses that road in the morning between 8:00am to 9:00am knows how chaotic it is and to close it at that hour on a Monday morning - first day of school was not a nice thing to do. Now I know who the construction site is for speaks volume. WILD WILD WEST!!!

      Mr Adams used to work for the Port Authority. The TCPD is a cushy assignment. He did do 18 yrs of city planning supposedly in the states, but he still doesn't have any sense when it comes to logic, design, scale, function, enforcing the laws. And that doesn't mean just a stop work order just to get a piece of paper for protocol, like he did for Brandywine. It means following the law. Period.
      But he also has a problem confronting the NDP. They over-ride the dept often. That is why the ugly empty building is on the highway at Pasea. Special treatment.

The article actually pits one bvi person against another yet it's the expats blog that offends you. Hope you're not weaning away on your piece of bone. History do roll around as when some BH had to leave these shores for better prospects be they money or education. Once upon a time the big isles did not care to integrate cause they have resources aplenty. There's a saying boast not thyself. BTW do you know that Britain is an island much smaller than Guyana? Get some education it may be the antidote for your hate.

    Judging from the photo, it looks like there is no violation. The complainant should take a look at the distances between some of the building on Wickhams Cay I before he goes and make himself look like a fool.
