DUFF'S BOTTOM, Tortola, VI - With the aim of addressing local workforce and job loss issues that have aroused out of the COVID-19 pandemic, Minister for Natural Resources, Labour and Immigration, Hon Vincent O. Wheatley (R9) has announced new requirements for work permit renewals in the Virgin Islands (VI).

"Mr Speaker, effective immediately, all work permit renewals being submitted to the Department of Labour and Workforce Development are to be accompanied by the company’s good standings from the Social Security Board, Inland Revenue Department and National Health Insurance."

Hon Wheatley continued by saying the submissions must also include, "the certificates of earnings from the Social Security Board and Inland Revenue Department for the applicable employee seeking a renewal of his or her work permit," he said.

New Workforce issues as a result of COVID-19 

Mr Wheatley was at the time speaking at today's July 10, 2020, House of Assembly (HoA) sitting where he also made sweeping announcements regarding the future of expats who have been living and working in the Territory but may have now found themselves unemployed as a result of the COVID-19 pandemic.

According to Hon Wheatley, while the VI economy has benefited greatly and they are thankful for the labour of expatriate workers who have come to build the Territory, he said as Minister responsible for labour, he now has to bear the heavy task of addressing workforce issues and the movement of persons in and out of the Territory.

"Persons residing in the BVI who have been terminated and would like to seek alternative employment will have the option to apply to the Acting Chief Immigration Officer for the option to receive a Conditional Permit under Section 31(1)(c) and 31(1A) of the Immigration and Passport (Amendment) Act, 2016," which would allow for stay in the Territory for three months to seek new employment, he said.

Only persons residing in the Territory for a period of five years or more, and not having a previous Conditional Permit within the last three (3) years, will be able to take advantage of that conditional permit option.

Expats living in VI for 5 plus only will qualify for a conditional permit 

He said persons who have lost their jobs and have remained unemployed but do not qualify for the Conditional Permit should still make an application to the Acting Chief Immigration Officer, Mr Ian B. Penn, for his review and discretionary decision.

"However, Mr Speaker, the reality is, some will not be able to find alternative jobs and, without financial or family support, will be required to leave the Territory."

Hon Wheatley reminded that the Government’s commitment lies under the Labour Code 2010 Section 2(b), which states “the legitimate employment interest of Virgin Islanders and Belongers shall be paramount ….”, meaning that Virgin Islanders will be at the front of the line for available jobs.

He said, therefore, expats who are unable to find alternative work and unable to obtain a Conditional Permit should begin to make the necessary arrangements to return to their homeland or an approved receiving jurisdiction of their choosing.

"These persons should also register with the Immigration Department by emailing immigrationinfo@gov.vg giving the particulars of their departure to allow for their exit to be properly recorded, thus assisting in a smooth re-entry when [the] opportunity presents itself."

        ... why can't we have joined up Government where the labour department can see for itself whether an employer is up to date with its NHI and SS payments - unfortunately, what is proposed will require employers running around from one Government department to another just to confirm to the second Government department what the records of the first Government department show. It is a really good idea to ensure that SS and NHI are paid before granting renewals, but there needs to be a more efficient way to do it.

          The Government need to wake up. Sending home the people from down Caribbean makes no sense. It will make things really, really bad for us. We have to look at the bigger picture. Which is or work force. The BVI is now trying to rebuild and the demand for skill worker's and labourers are essential. We have to be carefully. The Bvilanders who are into construction are the ones who hold licenses to build.they are not doing the work. We cannot fine that amount of locals with the required skills here. Most of these people are working for local businesses men. To do something like that can be bad for our own people. You have to look at the merit of each individual and their contribution to the country before you make such a sweeping generalization to send people home. Cabinet needs to rethink this policy before it is place effect.

    I'm so sorry for some people it's not fair to take out those employees money and not pay it in. Put your self in those employees place have some empathy man. One person said for years their s.s, tax was not paid in and nhi came on stream nothing was paid for them. This is a shame. Some thing needs to be done. Employees have the proof on their pay slip.

    Employers are responsible for deducting employees NHI and social security contributions from their wages and submitting them to Social Security in a timely manner. Contributions deducted, they should be submitted to Social Security. Failure to submit deducted contributions is probably fraud and government needs to pursue the fraudsters to the end of the earth to get the deductions.

    Employers are doing employees a grave disservice with withholding contributions and not submitting them to Social Security, eg, denial of needed medical services and reduced social security pension at retirement.

    Moreover, work permits are issued to fill jobs that exceed the workforce of the VI or fill jobs that Virgin Islanders don’t want to do. In these challenging times, Virgin Islanders must have preferential to available jobs. As such, unemployed expats should return to their homelands.

      There seems to be different situations occurring. There are employers who take out employees pay and don't pay employees NHI and SS. Then , employers who sponsor employees but the employees work for someone else and not the one who sponsor them. Those employees are responsible to pay in their Nhi and SS.

      Sad you are misunderstanding what the minister is saying . It's only fair if someone is not employed for that person to return to their home land if he or she cannot get employment instead of staying in the country with out means of support. If I have ten dollars save and my expenses is 2 dollars every month with no source of income and I have to pay rent by food along with other expense and my mother or father have a home I would move back home until I can do better.

    Anyone of you ever thought about the other obligations that most of them have here. Like the loans they owe the banks. They have kids with women from here that would be in need of child support? I'm not saying that what the minister is proposing doesnt have merits but for the people gloating remember the long term effects that will hamper the high standard of living you guys have been enjoying for so long. I should be punished for my employer not paying my contributions. Wonder what penalty the employer is going to face. Fine if I have to leave I wish to be compensated for all he took from my salary. After all its mine and I'm being sent from the country because the government did not receive any.

      This is where I will comment. They have obligations, kids, loans, etc. Everyone have obligations, however, how were they granted a loan on a one year permit, and no ties to the BVI, that is crazy. As for the kids, this is where the moral fiber of our society has broken down, having kids outside of wedlock. As for child support, if they are men, they will return to their homeland and job hunt so that they can support their children, no matter where they are.

    I am disappointed at the way some people think so if you send the island people home and they too want bvi lslanders to leave their country. Perhaps everybody from here should go back home to were their forefathers came from because no one really belong here. nobody create this island. When disaster happen do not ask for help from this island people. All the doctors that came do the bvi to assist the medical field do not allow them anymore.     so this is great news that work permit renewals need to have proof of nhi and ssb payments up to date.........what i dont understand with having those who have lost their jobs and may have to return to their homeland.....what happens to those who have paid in full into the system and have been contributing properly to our social security system for many years but may find themselves having to leave the territory. Are those people able to claim any benefits back.
    also if someone has been fired from a job during lockdown or had their job terminated and they find themselves having to leave the territory then the employer is responsible for the employee by way of the immigration bond to repatriate them. has consideration been made for this and what action will government take to followup with said employers. government cant afford to be chartering flights to deport people..........i once was forced by immigration to repatriate two emplyees who had stolen from me !!!!!

Look at America they are asking persons without green cards to leave even students with students visa who in colleges or universities or faced deportation. So why can’t you all leave it’s better to take knock about in your country than a next man country BVI don’t have to keep you. When 2017 hurricanes came and NDP was in I clearly remember MS P telling Dr Smith send persons out and deal with your own but he refuse will time up.

    This requirement will create real problems for sponsors who cannot provide full time employment all the time and allow the people they sponsor to work else where, as they have no control over persons not in their direct employ.

      If an Employer cant provide work, the work Permit holder supposed to return to their native Land by Law!! But what i dont get, is that why Govt have such strict laws pertaining to this. I believe once a work permit holder is constantly employed - Regardless of who the Employer is, LEAVE them alone, its not like they are on the land soaking up resources and unemployed!!!

    Some of you expats don't read or understand what the government is trying to do is good for you all. Lets take for instance if you are in the construction field and your employer has a contract which he or she has to honor then they can't afford to loose their workers. They have to pay up all the outstanding fees which is owed to government. So by doing that you are up to date with your contributions and your employment continues. A win win for you. That was easy.

    The people and the government needs to be careful of what they plan on doing with expects.

    1) expats can be held accountable for their employers actions on not paying their SSB and NHI.

    2) All who saying send down island people home please remember if they are not here to pay rent how will landlords pay the bank back because of expats many landlords are able to live a more comfortable life and retire earlier.

    3) All that saying send down island people home are those who live under their parents roof and don’t pay a rent. So I wonder If you guys are concerned about your parents who have worked so hard to give u that privileged so life can be easy on you.

    Well time will tell when that time comes and the number don’t lie so we as a people need to stop that mentality of saying send people home some people worked hard and build their homes and can be comfortable and plant food in their back yard can any of u say that

      Expats,in general, with makebelieve and uninformed attitudes, ridiculously for truth, are convinced that the VI won't survive without them. In truth, the benefit to expats have far outweighed any benefits to the VI. The VI has become lesser because of the ungodly invasion by these folks ( with exceptions). ViIanders are no better off than they were..they have always owned ther homes and land,educated and nonbeggars.
      Expats would do well to know that they are not indispensable and with their attitude of ingratitude they will forever be knocking from pillar post empty handed wanderers.

    This need to apply to Trade Licence too. I don't understand how this country has let these things slide for so long. In order for you to operate and do business in the BVI your SSB NHI and Taxes need to be up to date point blank.

    As a Christian expat, I know God's Will will be done! I pray for the people on this land, both citizens and non citizens. Annnnd for the organizations who illegally do not pay ss and nhi, causing employees to take the beating for their actions. The Lord is watching it all and we shall all give an account of ourselves to him. I have no worries because thankfully God takes care of his own.

    He said persons who have lost their jobs and have remained unemployed but do not qualify for the Conditional Permit should still make an application to the Acting Chief Immigration Officer, Mr Ian B. Penn, for his review and discretionary decision.

    Really. Let's not usurp authority here.

    Have any of you who hating on “down island people” stop to think, all these home owners that renting to “down island people” when you kick us out how you parents or your families going to pay there mortgage. So when the banks take your home, you will see how it feel to be kicked out. Now let that set in.
