ROAD TOWN, Tortola, VI - Host of the local TV show BVI Forum, Edmund Maduro, has called on residents of the Virgin Islands (VI) to stand up and protect their constitutional rights to the stage of demanding fresh national elections if the National Democratic Party (NDP) government continues to show incompetence in protecting their rights.

Mr Maduro was at the time addressing the issue of a recent call by the United States of America (USA) Government to provide them with information which requires the VI Government allegedly compromising the principals of the Financial Service Commission (FSC).

Speaking on his show on Saturday, August 31, 2013 Mr Maduro said what is being requested by the United States of our Premier is unconstitutional and that the British Government should take every step as our constitutional leader in order to prevent any misgivings.

In a previous article published by this news site, Mr Maduro had expressed his concern about what the US government was attempting to do at the time and had indicated his intentions to pen and discuss his concerns. This time he had taken the matter much seriously as he is suggesting fresh elections as, according to him, the Premier and Minister of Finance Dr the Honourable D. Orlando Smith seems to be out of touch with the constitution of the VI and his role to play in the matter at hand.

“…. And our Premier should stop being subservient and do what he was elected by the people to do to; protect and defend our constitutional rights,” said Mr Edmund Maduro. He said what the United States is asking of the Premier and the government is something that is unconstitutional and unreasonable. 

“If not, BVIslanders would have to call for another elections before their (NDP) time is up.” He said the situation being experienced among the three governments, VI, Britain and USA, is causing an economic warfare much to the demise of the VI.

Matters of external affairs, Mr Maduro said, is the direct responsibility of His Excellency the Governor who can delegate any Minister to carry out an international relations act. “But it cannot be done without the Governor’s consent and precisely, without the consent of the Foreign and Commonwealth Office.”

It was also alleged by Mr Maduro that it appears Britain is in company with the US government to infringe and cause the VI to mis-manage its constitutional rights. He noted that if Britain wants the VI to comply with the US request they must first seek to suspend the constitution.

“Edmund Maduro is not here tonight talking about a joke, we have got to protect our off-shore business,” he stressed as he also called on the people of the VI to take actions to let the Premier know that they are aware of their constitutional rights and are prepared to protect it.

He said there is no department here in the VI that has the power and authority to give a person’s private business to any government of any part of the world and the request of the US Government of the VI is an attempt to intimidate. “The United States Government is trying by way of intimidation because the BVI is a small territory and then she thinks we must bow but I believe that government is of law and not of man,” Mr Maduro stated.

While charging that that VI has been complying with the laws governing Financial Services over the many years, Mr Maduro feels VIslanders should come together and let the Premier of the VI, Prime Minister of the United Kingdom and the President of the USA know that what is being requested is unconstitutional. 

In the expressed opinion of Mr Maduro, should the British government allow the VI to bow to the US request, the many spin off effects would include a steady decline in investors, increased unemployment and social ills to the territory. 

Mr Maduro further stated that it appears the Premier of the VI has not read the constitution of the Territory and that it is something he should do otherwise BVIslanders should seek to have another election. He noted that only a fool would allow the US to destroy their business especially in the case of the VI where 60% of its revenue comes from investments made in the Financial Services by off-shore businesses.

    I agree with Edmund even if we do not get new elections we should petition for a recall of at least two ministers and we all know who they are!!!

    The BVI is in one hell of a mess. The NDP and bad polices are eroding our financial base and now we are blacklisted!!! God forbid the other two years left of the NDP.

    Government involvement should be a no no! Educate on what the US wants but I should not have to give local government infotmation. Also why incur additional costs by being a conduit.

      You and Edmund are two idiots.. It don;t matter what government in power or who makes up the government. FATCA is imposed on the ENTIRE world. Stop being led like a fool and find out what is really going on. Do you really think people who are US persons will get away with not declaring their income and paying taxes in the US for ever? This is the problem in the BVI. The majority of you fools wont educate yourselves and want others to lead you. My god when are we going to wake up in this place??!!!1

    If only poor Edmund had a clue. FATCA has nothing to do with BVIslanders and their constitutional rights!! Any US Citizens in BVI or anywhere else in the world are liable to taxes on their income in accordance with the US Laws. This has nothing to do with constitutional rights Maduro, find another fight. Instead of finding someone with the relevant knowledge to get on your show and explain what's going on you go foaming at the mouth like a poison dog sounding like an idiot. USA, EUR, UK are all putting something similar in place to collect taxes from their citizens which by the way is nothing new. Our Financial Services depend on it as many of the transactions pass through US institutions. US are not using Government as a police maduro, Government has simply agreed to set up the facility through which the necessary reporting, especially as it relates to Financial Services can be done. Please do your research instead of sounding like a flaming j@ck@$$. FATCA and the IGA has NOTHING to do with BVI Constitution Edmund!!!! US Citizens all know their tax requirements and if they don't want to pay they could simply renounce their citizenship like many have already done with the FATCA coming on stream. I can't believe what I just read here. WOW!
