UPDATE: Trial for burglary accused Doyle Guishard set for Jan. 2014
When Guishard appeared before the Magistrate’s Court on December 13, 2013 Magistrate Dr Velon John said he is expected to have an attorney by this time and the trial will proceed regardless.
According to the allegations read by Crown Counsel Leslie Ann Faulkner, the Virtual Complainant (VC) Alnando Fahie was in his bed on March 15, 2013 at about 12:30 A.M. when the three men allegedly entered his home in Vanterpool's Estate. Two mobile phones, along with a quantity of cash, were allegedly taken at gunpoint by the trio.
Guishard previously pleaded not guilty in another alleged burglary which occurred in Major Bay on December 16, 2010 on a yacht. The trial for this matter had already started twice before but is expected to be restarted for a third time under Magistrate John on March 4, 2014.
Evidence was previously given through video conference by the VC who lives abroad and is expected to be done in a similar manner when the trial is restarted.
Guishard was remanded to prison until the start of his first trial in January.

Garbage truck man & driver charged with aggravated burglary
ROAD TOWN, Tortola, VI – Two men, an Assistant Driver and a Garbage Truck Worker, were denied bail after being placed before the Magistrate’s Court today, September 17, 2013 and charged with the indictable offence of Aggravated Burglary.
The two men, Samuel Harris, 22, and Denzil Wheatley were not required to plea but were remanded to prison until Friday and are expected to return to court with their attorneys when the matter is expected to be called again.
Doyle Guishard was also placed before the court yesterday, September 16, 2013 on similar charges in relation to the same matter and was later remanded as well.
The offence was allegedly committed between March 13-16, 2013 at Vanterpool’s Estate in the home of Alnando Fahie and, according to the charges read by Senior Magistrate Tamia Richards, two mobile phones valued over $400 in addition to $265 in cash were also stolen from the residence.
According to the allegations read by Crown Counsel Leslie Ann Faulkner, Fahie was in his bed on March 15, 2013 at about 12:30 A.M. but was still awake when he heard a noise at the front section of the house.
Fahie reportedly did nothing at the time of hearing the noise but shortly after there was a pounding or booming sound at the front door and he then noticed that two men had entered the home and approached where he was and began demanding money.
One of the men reportedly approached with a gun and the other with a steel object.
The man with the gun allegedly said: “Where the money? Don’t’ look up. You think we playing?”
Fahie attempted to move at that time and the gentleman with the metal object allegedly struck him on his left arm. The two men then asked Fahie to roll over on his stomach and he complied and told them that there was money ($265) under his mattress. After taking two phones as well, the men reportedly made their escape from the home.
Fahie’s nephew had been alerted to the commotion unknowingly to the intruders while they were in the home and he observed when his uncle was face down on his stomach when one of the men pointed what appeared to be a gun at him (Fahie). The nephew also allegedly observed one of the men with a steel object when he was about the leave the home.
According to the allegations, CCT footage from a nearby convenience store also picked up three gentlemen [Wheatley, Guishard and Harris] walking towards Fahie’s residence; including one with a metal object. The footage also captured the same three men when they were leaving the direction of Fahie’s residence which was reportedly at the same time of the robbery.
Police were notified and an investigation was started where it was revealed that Fahie received a fractured left arm from the blow. Footage from the convenience store had been shown to Guishard and he allegedly identified himself and the two other accused.
Harris and Wheatley were later met by officers and informed of the report against them and made no reply. They were cautioned and asked to conduct audio/visual interviews but refused.
Crown Counsel Faulkner said the Crown was requesting that bail be refused to the men because they each had previous convictions for similar offences and also on the basis of the seriousness of the offence. She also noted that the alleged firearm was not recovered and during the commission of the offence, the victim allegedly suffered a broken arm.

It is still a choice to be gangster here, not an outright obligation. If you travel to places where people have to sell drugs, rob and kill to feed themselves and their children you would understand what a safe haven we reside in. Granted we need some major change in the way we go about business and perceive change but we're not dead yet!! And I refuse to play dead while you shift the onus to elected officials who've been in office for two years for several generations of poor judgment and lack of vision!!
