ROAD TOWN, Tortola, VI – Shortly after Virgin Islands News Online broke the news today, November 11, 2013 that Mr Alwyn James had been confirmed to the post of Deputy Commissioner of Police, the Royal Virgin Islands Police Force (RVIPF), issued a press release confirming the story.

Virgin Islands News Online was informed by its many sources that Mr James' confirmation to the post was made known to ranks of the RVIPF at the Commissioner's Parade on November 8, 2013 by Commissioner of Police, David Morris.

The RVIPF press release reported that Governor William Boyd McCleary confirmed Mr James to the post of Deputy Commissioner.

It said Deputy Commissioner James has been Acting in the rank since April last year, except for three months earlier this year, when he attended the internationally-acclaimed Strategic Command Course at the Police Staff College in Bramshill, England.

The press release further stated that Commissioner Morris greeted the announcement with pleasure, stating “We all congratulate Alwin on his recent substantive promotion. Personally, I am pleased to have the appointment confirmed, as the absence of any uncertainty about who would take up the post now allows us to continue to work together  to move the RVIPF forward”.

Deputy Commissioner James, according to the press release, remarked “I am honoured to be confirmed in the position of Deputy Commissioner and I thank my family, friends and colleagues for their support during my career. I look forward to giving my best to the people of the Territory. I pledge to continue my work in partnership with the other Law Enforcement Agencies in the Territory and the Region”.

Deputy Commissioner James has served in the RVIPF for 28 years and his last post was that of Superintendent in charge of the CID.

Mr Alwyn James has been confirmed as Deputy Commissioner of Police (DCOP) within the Royal Virgin Islands Police Force (RVIPF), sources have informed Virgin Islands News Online.

While the dates and other details surrounding the confirmation are not available at this time, several sources have confirmed that the announcement was made at the Commissioner’s Parade last Friday November 8, 2013 by Commissioner of Police Mr David Morris.

Mr Morris had reportedly spent some time congratulating Mr James on the confirmation as he was acting in the position for some time now.

    His Most Honorable Mr.Alwin James is a Citizen of Her Majesty's British Overseas Territory of the Virgin Islands[BVI] as defined In the V.I Constitution.

    We like to talk about freedom of speech and Constitution,but how many of us really respect the V.I Constitution and what Her Majesty,the Queen BESTOWED upon the people of Her V.I Constitution:

    The V.I Constitution does NOT define the "term local" to mean [a person who belongs to the Virgin Islands]

    However,Her Majesty-The Queen is the person who OWNS the BVI and She send Her GOVERNOR to be Her representative in Her BVI,and whether you like him or not,Mr.Alwin James is a Citizen of Her Majesty's BVI!

    And the Constitutional Authority for that declaration is clearly and crystaly written in the Her Majesty's V.I Constitution:

    This is what the Queen of Buckingham Palace declared on the 13th day of June 2007,at the Court at Bucking Palace UK:

    Her Majesty declared to Mr.Alwin James and ALL of Her other Citizens-The following:-

    Chapter 1 Interpretation 2 (2) V.I Constitution-She declared:-

    ""For the purposes of this Constitution,a person belongs to the Virgin Islands if that person-

    (i) is A British Overseas Territories Citizen (or a British Dependent Territories Citizen) by virtue of Birth,Registration or NATURALIZATION in the Virgin Islands or by virtue of descent from a father or mother who was born in the Virgin Islands"".

    Mr Alwin James had become a Citizen of Her Majesty's BVI,in 2003,in the BVI and when the New Constitution of 2007 took effect;he remained a Citizen of Her Majesty:

    Like all Naturalization Cirtificates issued before 13 June 2007,Mr.Alwin James' Naturalization Certificate should read the following:-

    ""The Secretary of State,in Exercise of the powers conferred by the British Nationality Act 1981,hereby grants this certificate of Naturalization to the person named below,[Alwin James] who SHALL be a Britsh Overseas Territories Citizen from the date of this Certificate"".

    Local or son of the soil?

    According to the V.I Constitution and upon the Instructions of the Her Majesty,through the Home Office-Secretary of State UK,Mr.Alwin James,The new Crowned DCP is a ""Local""He is a ""son of BVI soil"".

    To call him an Expat,is misleading and DISCRIMINATORY!

    I worked with Mr.Alwin James,on the frontline as a detective and during his reign as head detective,he was considered by top defense attorneys and Queen's Counsel, as the best Criminal Investor,that the RVIPF has even seen.
    Because he was not born in the BVI of BVI parents,you are discriminating against a fellow Caribbean-Born officer,who served Her Majesty,for almost 30 years of his life?

    Shame on ah you!

      i read this blog from knight rider 5 times for the morning before going to work and i feel i was in a classroom getting lecture from a law teacher.
      i want to see a lawyer with a law degree explain citizenship rights and identification in the way this man explain it directly from the constitution and from the uk secretary of state.
      in the usa if a haitian get us citizen by naturalisation and any other us citizen call that haitian u haitian with discrimination in mind that haitian american can take legal action.
      my advice to dcp james is that if any body look at you face to face and call you expat or island man you can sue them for discrimination.it is ok to call him expat in a blog,we hiding in a shadow,thats fine,he cannot take action

      mildred i agree with you but mr hill only acted for a few weeks,alwin acted for 18 months,,let us see how mr hill performing first and i am sure his performance will analise by the governor and others,for now we giving our views on the appointment of mr james as dcp,and while some of us say he is a islandman,expat,downislandman,not from heh,doh belong heh,we reading that the man is a citizen in the constitution;when uk citizen get appointed we making noise now a bvi citizen get appointed we making noise still.the governor should get a citizen from the plannet mars,jupiter or from the whole galaxy.we dont know who we really want.i wish mr hill good luck,hope he get appointed as a citizen

    I was born in the usvi, my mother is a bvi citizen , my father is a citizen of antigua. after birth my mother return to bvi with me as a baby and register me as her child and i become a bvi citizen by registration in the constitution.when i was about 2 years my father also took me to st vincent and register me as his child and i become a vincentian by registration.i live in the bvi. I was born in usvi but I am a citizen of BVI and St.Vincent.My bvi citizenship came under the v.i constitution. so if mr James was born in Dominica and he become naturalise under the same v.i constitution,is he not a bvislander?I blame government and lawmakers for all this fighting and insults over who born here and who come here.government should pass a law that after a person become a citizen,calling that person expat and islandman is a offence punishable with prisonment.for 28 yrs a man work for the government and he is a citizen but because he was born in dominica we there bringing down the man saying he not from here.this country is sick and everybody who reside in the bvi should go for mental check up.we doh even know is citizen & who is expat.

      born in the usvi; you miss out a very important point, and i say again very important....the white folk are welcome in the bvi with open arms while our black caribbean brothers and sisters given a hard time as to where thier are from BUT mr white walks in and do as he or she wish and we simply smile in them face, next thing them buy the lands and we can no long get to the beach and that is all well and good BUT our fellow RACE should not have nothing in the BVI...what a shame !!!!....in the event some dont know the BV Islands also went to other countries to look work all our caribbean black sisters and brothers are doing is seeking work to help their family

    Dear Vino:

    Your famous news site and meaningful bloggs are being viewed by senior queen's counsel as far as the UK and Australia and that is why whenever I blogg on your free and democratic news site to be published in Her Majesty's free and democratic BVI,I do it on a point of law without resentment,animosity,but with happiness.

    I say that in my opening statement, because my mom and I read and debated a blogg from a Blogger[Observer] who blogged on another headline topic with c.o.p's parade and the Blogger accused me of "will die an unhappy death" with animosity and resentment, simply because I called on COP Morris to obey section 75 of the Police Act,and ensure that police officers receive medical attention,to be paid from the consolidated fund,according to BVI law: The evil enemie "observer" wants revenge and wants me to die!

    My mom will confirm,that only unhappiness that I live with as a retired policeman,is whenever I read of a violent Crime against my people in the BVI,it angers me as a trained and qualified detective,that I am not part of the investigation,to help catch the Criminals who are terrorizing my BVI people..

    My fight with public administration:I won all my administrative cases against the COP and the Governor at the time,because I took my caese to the Foreign and Commonwealth office-UK and to Her Majesty-The Queen of Buckingham Palace. I am a happy pensioner!

    But because I am a person who was shot and gunned-down in the line of duty,with bullet fragment inside my body and the amount of near-death situation I was involve in while serving Her Majesty in the BVI,together with detective Alwin James,I am not fairful of the threats of persons like ""observer"".

    My life as a detective,was a life of threats.

    I am protected by the power of the Holy Spirit,and I believe that the angels protected me for all these years as a police officer in the BVI,that is why I was not killed in the line of duty.

    Similarly with Mr Alwin James,the most outstanding and brave police detective that the rvipf has ever produced,and obviously because of my oath made to Her Majesty,even after retirement I cannot reveal the many operations conducted by this soldier detective James,who today,people want to crucify him for his appointment to a higher rank on the single basis that he was born in the Commonwealth of Dominica-The Nature Island of the Caribbean:

    This is a man who lead a group of brave detectives to crack-down on armed robbers who were terrorizing Her Majesty's citizens in the BVI,and lead many,many secret missions to protect Her Majesty's Territory from external aggression and attacks; today,because the same man was promoted you want to rediclue him,because he was born in Dominica? That is your only reason?

    Let us read the section in the V.I Constitution,which empowered His Excellency the Governor,to appoint "local,son of the soil-BV-Islander/Citizen Alwin James to the post of DCP.

    Section 97 (1) of Her Majesty's V.I Constitution states:-

    "" Power to make appointments to offices in the Police Force and to remove and to exercise disciplinary control over persons holding or acting in such offices shall vest in the GOVERNOR,acting in accordance with the Advice of the Police Service Commission;but the GOVERNOR,acting in his or her discretion,may act otherwise than in accordance with that advice if he or she determines that compliance with that advice would prejudice Her Majesty's Service"".

    The Governor in his discretionary wisdom,was satisfied that BVI-Citizen Alwin James was suitable and qualified for the post of DCP,and that his appointment,would NOT Prejudice Her Majesty's Public Service!

    I now challenge those who oppose Mr James' appointment,to submit to His Excellency the Governor,"credible evidence" that the appointment of BVI-Citizen Alwin James,will,would,shall or may Prejedice Her Majesty's Public Service and Her Majesty's Police Force:

    Mr Alwin James, was properly and Constitutionally appointed by The Governor,on behalf of Her Majesty-The Queen,in Her Majesty's BVI Police Force.........................What is the force about?

    This police force really need investigating tell the people of the bvi how your Dominicans thieving the money slash exhibit in the force and you allow them to pay it back in installments and when a local does anything which doesn't match up to a crime of such they are dismissed or suspended and all you do is send your people on vacation and when they return they return you put them in another department and the government talking piss about all in the police force has equal opportunity

    Inspector rider,all what you say about dcp james i know is true and i can understand why you will support the appointment of a man who you and him and others had declare war on dem criminals in the 90's and during that time gunmen attack ah you and george got shot and another time you got shot,so yes you know the caliba of alwin and he is your boss from the days of the war zone on the streets of tortola.

    A friend of mine who is a queen's counsel in the UK called me to ask for an update on the bloggs with the appointment of Honorable Alwin James,a distinguish citizen of Her Majesty's BVI.

    It is now 6pm Caribbean time and 11pm UK time.I read the bloggs on this free and democratic news site,which was published in free and democratic BVI for all to read:

    But on a more serious note,let enjoy some freedom to blogg:

    By now my fellow BVI Citizens recognized that Mr.Alwin James is the first BVI Citizen to be appointed as DCP since 2002/2003,when fellow BVI Citizen Mr Reynell Frazer was appointed DCP.

    In recent times in the BVI,we had DCP Philsbert Alfred a citizen of Dominica in 2006/2007 I believe and then we had DCP Mr David Morris a citizen of the United Kingdom,from June/July 2010..OK

    Neither Mr Alfred nor Mr.Morris,prior to becoming DCP had served in the force,from Constable to Gazetted rank,but they were qualified for the post,hence they were appointed by the Governor on behalf of Her Majesty.

    Now we have a Citizen of the BVI,Mr Alwin James,who first join the force sometime around 1983/1984,and this gentleman grew up in the force and went up the ranks,based on high quality performance in police work,and during his service to Her Majesty,he idenfied himself with the good citizens of the BVI,and he also become a citizen,and was recognized by the Secretary of State,Home Office-United Kingdom.

    Shouldnt we all be happy,that a Qualified Citizen of Her Majesty's BVI,is our new DCP?

    As a citizen myself,I am happy!,but she is happy.We are ALL HAPPY!

    The RVIPF as the rest of the civil service is a bloated, dysfunctional royal mess. It is a splinted perhaps by design organization; there is a tug-o-war among UK, other Caribbean nationals and local officers. Any organization with this type of disunity cannot function effectively. Its reporting chain may be a partial contribution to the problem.

    The RVIPF mission to protect and secure the local community yet its control is not in local hands; control falls under the Governor’s purview, not the Premier’s. This reporting requirement delivers some interesting decisions. For example, no one on the RVIPF was qualified to be Deputy Commissioner, not even Vere Brown, the current Commissioner of Antigua and Barbuda Police Force and a long-serving member of the RVIPF. Yet the current Comish appointment to the Dep Comish position completed, members of the RVIPF appeared to be qualified to be Dep Comish. The plan was crystal clear if you are not qualified to be Dep Comish you a cannot be qualified for Comish. Who to blame for these dealings? As the song say Ting te Talk.

    If one were to believe what one reads and what is being played out, then Malone, Barry, and Frazer did a poor job in running the force, failing to develop any effective succession planning. This could be true but a hard pill to swallow. What is true is if looks like a duck, waddles like a duck and acts like a duck it is a duck.

    James served the RVIPF faithfully for the past 28 years and is well-deserving of the appointment. My comments are aimed at the dysfunctional system(s) that has a strangled hold on the BVI and its growth and development. There cannot be pride and professionalism in an organization if there are no confidence in the process; it is just a job. Congratulations Dep Comish. You excelled and succeeded in spite of the dysfunction.

    My parents are british virgin islanders,I was born in usa,we all reside in the bronx n.y usa,but i feel disgracefully ashamed to learn that a caribbean man who lived and worked in the bvi,become a citizen of that country,join your military force from a young age,grow up in ranks and is now yr deputy in your military force and to realise that bvi cannot appreciate what is service of defense of a people and of a country is a disgraceful shame.I say may be its ignorance,lack of education,or may be outright dumbness-------------------------------------------------
    The u s a welcome people from all over the world to join its population through green card and other means of residency.many of those visitors to the usa become citizens and are seen as citizens-----------------------
    Roadtown tortola is the size of the smallest shopping mall in the usa,so everyone see everyone everyday and would probably greet each other.In the usa you see your nextdoor neighbor once a year-----------
    I expect bvi residence to be living in harmony and if a virgin islander achieve something,like what this man achieve,i expect to read congratulatory speeches from the Premier,the governor,the chief state prosecutor,attorney general and others------------------------------------------------------------------------------
    Instead,i am reading notes from writers basically pulling down a military personel who according to one writer,defended the virgin islands from aggression and attacks.they fought down crimes and criminals and invaders---------------------This new military chief is in my view a hero of statue who gave selfless service to his country in situations where he and his officers could have been killed doing their job of protecting citizens and country---------------------------------------------------------------------------------------------
    If he was in the us army,this man would have received many badges of honor for bravery------------------
    He would be a leutenant or a general in the military----------------------------------------------------------The virgin islands will get no where,if you dont change your attitude towards other negro caribbean brothers who went to bvi and reside peacefully amongst you-------------------------------------------------------------------

    My brother/sister, just a point of clarification. The Dep Comish served in and is serving in the Royal Virgin Island Police Force. Though police officers put themselves in harm way, they are police officers, not soldiers, airmen, marines, sailors or coast guardsmen. In the USA and elsewhere the police and military serve different roles.

    I agree with you that the Dep Comish would have served well and contributed much to any military organization. Additionally, I'm also on board that he served the BVI faithfully and is qualified and deserving of the promotion.

    However, in my blog above I blasted the dysfunctional system.

    Congratulations to mr James for a wondeful career and long service to our bvi and thanks to the former officer who reminded us of your many leadership role in your fight to make us safe in bvi while you and your men were in the danger ready and willing to die for country. your hard work have paid off so its time to harvest.those who sat down fat and lazy in office and waited to be promoted under the concept of ah bahn hiere let them keep waiting.you didnt bahn hiere,but according to the supreme law of the land the constitution,you from hiere so u hav a right to work and to feed your family hiere in the country where u belong.please do a good job like u did when you and yr officers safegarded the streets of roadtown as detectives.

    I am pleased with the support that Mr.Alwin James is receiving from the many good citizens of the BVI and one person even classify Mr.James as a military COMBATANT.

    The intelligent Blogger,I suspect, might have thought that we have a military unit in Her Majesty's BVI Police, but in reality,the blogger is correct.

    Section 4 (1) subsection (c) of the Police Act,Cap 165 laws of the Virgin Islands,defines one of many Objects of the force as it relates to duty to preserve Her Majesty's Peace.

    Section 4(1) (c) states:-

    """ The object of the force is- [THE DEFENCE OF THE TERRITORY FROM EXTERNAL AGGRESSION OR THREAT THEREOF"""] Only Police have power in law to defend Her Majesty's BVI.

    This is a very serious responsibility by Her Majesty's Police Officers:

    And you can classify Mr Alwin James,in the rankings of- US Army General Norman Schwarzkopf.

    The General had lead US troops in Operation desert storm/Operation desert shield after Iraq had invaded Kuwait.

    Similarly,General Alwin James,lead brave detectives to 'defend Her Majesty's BVI' from both external and internal aggression,against Her Majesty's Citizens.

    He lead the WAR in the fight against violent crimes in the BVI.

    It was a war against crime in the 1990's-and up.He saw his men get gunned-downed in the line of duty..

    And you are correct blogger: Some of the coward officers reported sick,stayed away from work,to avoid facing the armed robbers,but General James was there day and night,rain or sun ready to lead his troops,in defence of Her Majesty's BVI,and to protect Her Majesty's Citizen!

    Today,some of you who do not know anything about the ["unblemmished track-record"] of Mr James,talking a collective bunch of NONESENSE!

    About Mr James from Dominica?

    Did he serve the people of Dominica in the Dominica Police Force? No!

    Mr James have never protected the Citizens of Dominica residing in Dominica:He protected the Citizens of Her Majesty's BVI,residing in the BVI.

    When I will have visited Buckingham Palace,next week, I will tell Her Majesty,That His Excellency the Governor,of Her BVI appointed a brave DCP to serve Her Citizens in the BVI...

    cplleague, me son,you tired giving dis ppl the truth in the bvi law.ease up colleague,dis ppl see police as nobody.in america,wen u defend country u is a hero.in bvi is about where born,not wat u do.de queen respect police but nah dese ppl.nelson mandela martin luta king face alot of tribulation for the truth of freedom.I mean more you give history of events on the dcp u give on law,u give facts.colleague,you always say once u not committing a offence or breaking the law u will say what u have to say lawfully.colleague you hurting some people with the truth.colleague,stop hurting the ppl with the truth

    Section 7 of the Police Act,Cap.165,laws of the Virgin Islands defines the functions of the deputy Commission.

    Her Majesty's Statutory law states:-Section 7,

    ""The Functions of the Deputy Commissioner is to act as assistant to the Commissioner in the performance of his functions and for that purpose,may-

    (a) when authorised by the Commissioner;or

    (b) if authorised by the Governor,in the tempory absence or incapcity of the Commissioner,do or perform or order to be done or performed any act or thing that may be lawfully done or performed or ordered to be done or performed by the Commissioner"".

    Congratulations to Mr Alwin James:

    You are equipt with Her Majesty's laws.

    DCP; Go now and perform your statutory duties! Make Her Majesty proud.
