UPDATE: Raphael Fahie fined for police assault

ROAD TOWN, Tortola, VI – Former police officer, Raphael Fahie, 45, was found guilty today, March 24, 2014 of assaulting police in 2012. He was also found guilty of common assault, indecent language, resisting arrest and disorderly conduct all allegedly committed on June 28, 2012.

The charge of threatening language was dismissed after attorney Patrick Thompson made a successful no case submission in this regard.

Magistrate Dr Velon L. John said the entire atmosphere surrounding the circumstances of the incident that evening was punctuated with violence and stated that it was regrettable that the defendant’s sister or friend could not testify to corroborate his story.

In relation to Fahie’s testimony, John ruled that he was economical with the truth and said there was a diabolical contradiction discerned in the person of the defendant.

He pointed to Fahie’s testimony where he said that he was preparing dinner while at home at 10:30PM and his subsequent statement that he didn’t usually eat late at night hence his request at the police station was only for water.

Fahie was fined $200 on each of the five offences and instructed to make payment within 48 hours or face 14 days of imprisonment on each charge.

Raphael Fahie denies assaulting police, behaving disorderly

ROAD TOWN, Tortola, VI – The Crown presented its case against Raphael Fahie of East End, yesterday, February 26, 2014 with two police officers offering testimony against the defendant.

Fahie pleaded not guilty to charges of common assault, threatening language, indecent language, resisting arrest, disorderly conduct and assault on police all allegedly committed on June 28, 2012. He is represented by attorney Patrick Thompson. 

Officer Lenroy Samuel told the court that he was stationed at the East End Police station when a report was received regarding the defendant and accompanied two other officers to Fahie’s home to investigate the matter at Old Plantation around 10:00PM on the day in question. 

Samuel testified that Fahie was uncooperative when Police arrived and closed his door and went inside after they came. Officers left the residence and returned to the station. They returned and called the defendant who came and stood in the doorway. Officer Jerome Padmore told the defendant he was being arrested for destruction of property and he allegedly replied: “Ayo [expletive] better get off my place.” Padmore then informed the defendant it was an offence to use indecent language in the presence of police officers as they are executing their duties. 

The officers then left for members of the task force unit after observing certain behaviours of the defendant but when they returned he was absent. A search was conducted and he was discovered sitting on a wall in Long Look. He was cautioned and told he was being arrested. He allegedly replied: “Ayo putting ayo hands on me [expletive] arresting me. [Expletive] ayo turn coming.” 

Padmore then approached the defendant to effect an arrest but was allegedly pushed away by Fahie before he walked away. He was informed that he was resisting arrest and that this was an offence and was eventually subdued by members of the task force who accompanied him to the East End Police Station.  

While in a cell at the Police station Fahie, allegedly behaved in a boisterous manner and spoke in a loud tone while cursing and banging on the cell door. Due to the alleged disturbance created, officers went into the cell and placed the defendant into an inner smaller cell. While doing so, Fahie allegedly punched Officer Samuel in the mouth and kicked Officer Padmore in the waist. 

Later, at approximately 2:25AM, during a cell check the defendant allegedly told Officer Samuel, “I will kill you.” At the time, Officer Samuel said Fahie appeared enraged and uttered the words in a stern voice. 

The defence, in cross examination, established that Samuel was in a relationship with the defendant’s daughter who had made a report on the evening and questioned whether he felt this was the appropriate thing to do. 

It also emerged that Fahie was at home alone with a young toddler when Police first arrived at his home. The defence also charged that Fahie had requested water while incarcerated and was refused by officers. Officer Padmore testified that his personal safety and the security of the station was threatened when Fahie was banging on the cell door.

      not the island man fault you guys prefer to dress up in suite and tie and go sit trust companies instead of real studying and training for years remember police you have to complete training and get a written certificate trust company you could just walk out of collage and go so don't blame the islandmen blame your lazy backside and others !!!!!BOOOOOOO!!!!

    Just another case of disrespect. How dare he treat the police like that. They were doing their job. Someone made a complaint and they were doing their job to act upon that complaint. Now, it isn't clear, and I don't think from reading this that he was even taken into custody or charged for whatever it was that took the police to his door that day. No, it seems rather, he was ultimately arrested for refusing to co-operative with the police and choosing to instead spew out expletives, disrespect the law, refuse to answer their query and ignore their request by going indoors. The police did not disrepute his home or him, rather they returned to the station and discussed what to do. Why should the police just let it lay and leave him at peace? A legitimate complaint was laid and he was placing himself above the law. Now some of you are suggesting one of the returning officers is in a relationship with the man's daughter. Seems likely that they thought if this officer did the talking that the man would comply. He still wouldn't. The police left a second time. They decide that a non-compliant and defiant man with a complaint of destruction of property made upon him needs to be taken into custody and further assistance is required. His defiant self is to go about his day as though nothing is wrong and he has nothing to answer to. An arresting team pursues, he reacts with force, he continues to act belliterate and disrupt the station once taken into custody. He deserved everything he got! He nor anyone else should ever believe force minute that it is okay to behave like he did when dealing with the police. They did nothing wrong and acted professionally. Had he responded to the first officers in a civil manner he wouldn't be in such a mess. I'll even go further to suggest that a man who can behave like this is surely capable of destruction of property! It speaks to his character. I find it appalling the way the people in the BVI disrespect the law, the legal system and the members of the RVIPF. I want to live in a safe community and I appreciate the effort these men and women put into their job. Is sure isn't easy when they constantly deal with uncooperative community and individuals.

    The police them who ain't from like to show off themselves and expect that people must cooperate with their ignorance. If they go back to their own countries they can't behave like how they want to here in the BVI ,Raphie Boy don't mind them everything safe everyone have a turn to get in life and what goes around comes around if not sooner for sure later. Government need to start make them pay work permit and let see how much of them will join the force.

    I agree the po;ice does not know how to talk to the people. They harrass the local and expect respect. Training I look on when one did not know he was on Wickhams cay. All kind of communication and he did not know what street he was "de pon". If that is the training they have jack ass better than them.

    It is really unbecoming and distasteful how some of u people think. From what am reading here Mr. Fahie himself an ex-police and ex-customs officer was very disrespectful and uncooperative to the police who was executing their duty but yet some of you all have the nerve to supporting him with his lawless behavior and bashing the police for doing their work we are a hopeless society where law and order are no longer the norm but lawlessness and disrespect is the order of the day we really need to change our mentality and adopt a positive attitude the laws here are for all and sundry not only for those who comes in to live amongst us and the indigenous BVIslanders should show more respect for law and order and not to feel they are above the law

    Respect is earned but i find we used disrespect as a weapon.Either way it's wrong.If upset there are many other ways to deal with it.All police whether local or exp. are not the same we have some real RUDE local cops that disgraces us and some exp.doing the same but there are some Exp. that do their very best to defend us from the worst elements as well as some locals cops.They are all people with different ways. Wrong is wrong we are a better people than this. All this talk about island man makes us sound illiterate we need to stop.
