ROAD TOWN, Tortola, VI - Permanent Secretary in the Ministry of Natural Resources and Labour Mr Ronald F. Smith-Berkeley is appealing to the Scrub Island Resort workers who came forward to Virgin Islands News Online with allegations of mistreatment to make a formal report to his Ministry.

Responding to this news site's inquiries to the Office of the Minister of Labour, Mr Smith-Berkeley said he had absolutely no idea that there was an existing problem with workers at Scrub Island Resort.

"If persons do not make an official report we would not or cannot intervene on their behalf," he said, adding that he will ensure that he engages the complaining workers directly to ensure that their concerns are addressed in a timely manner.

He appealed to the disgruntled workers to visit him at his office and ask to speak to him directly. "I really want to listen to them and see how best we can have this resolved. I would personally sit and talk with them once they come directly to me," Mr Smith-Berkeley stated emphatically.

A senior officer within the office of the Premier and Minister of Finance Dr the Honourable D. Orlando Smith has also categorised the allegations as serious and advised that the affected persons seek to have an appointment by next Friday to have audience directly with the Premier.

Scrub Island workers go public over alleged mistreatment

SCRUB ISLAND, VI - An extremely wide and long blanket of complaints have been levelled against yet another of the Territory's popular tourist destinations by disgruntled employees. This resort is allegedly closely knitted to the National Democratic Party (NDP) and its Government affiliates.

"We come forward because we need to come out of the silence. They call one woman there Labour woman because she runs there all the time but she gets no justice. We made it clear that the next thing is that we going to the Governor because we can't go to Labour," stated an employee of Scrub Island.

Allegations of poor workers' relationships, abuse of power, unjustified firing, the non-payment of gratuity and discrimination are causing workers of Scrub Island to cry out for help without being further punished. This news site was approached by more than five persons who have all expressed a high level of frustration about the management of the popular tourist entity.

"They playing dirty ball right now, we are making certain moves and we going to throw back that same ball at them. That management must go," said another employee, who like the others, wished to remain anonymous.

"Don't get me wrong I love my job I have been there for a long time and it’s a wonderful place but with bad management," said one of the persons who spoke to this news site.

Among those who came forward were someone who was fired and others who were allegedly forced to resign under pressure. It is being alleged that one of the major problems is that the management hugs most of the members of government “from the head to the Permanent Secretaries, their partners, associates and affiliates”.

Workers allege non-payment of gratuity

According to an informed member of staff, workers should be getting gratuity which has some dependency on the rate of income of the resort. It is being claimed that because of the government systems of payment for services rendered, the accounts do not give a true reflection of income to allow payments of gratuity to workers.

Another issue among the workers is that of cheap labour. One of the persons explained that management is currently on a mission to allegedly wipe the workforce of VIslanders to employ persons from other countries. "They say why take one when you can get two for the price of one,” an employee alleged. The source explained that management has allegedly been getting rid of locals who they might have been paying $10 per hour and hiring two persons who they now pay $5 per hour.

"It is abuse to the highest level and it’s just not fair," said one of the persons.

Another person, who would have had dealings with the resort at very senior level, spoke of how they were allegedly pushed to the limit on a number of occasions. That person has since resigned but alleged that they were informed that they are not welcomed at the resort.

The entire episode that led to the worker's resignation was recorded as explained to this news site but will not be made public at this time.

Going into details on other matters raised by the frustrated employees would also point fingers to direct individuals who allegedly stand to lose their jobs with the company if identified. One person who was recently dismissed said it was proven that he lost his job with the company because he was sticking to the written rules and that his matter is currently before the Labour Department.

No faith in NDP Government

Going to the government for interventions is like “pouring water on ducks' back”, alleged the employees. According to them, one of the biggest supporters of the resort is the Government of the Virgin Islands. "Every one of their activities is held here. If you work here and don't know who is who in government something is definitely wrong with you,” one person alleged.

It is also being claimed that government funds are being abused and misused for personal pleasures at Scrub Island. "They always there and when they come at whatever time or season, work related or not, they get the finest of treatment. They can call for a bottle of the most expensive wine and get it without going into their pockets. But the bill no matter how long it takes to get paid is from you and me tax payers money for the pleasure," was another serious allegation made by the upset Scrub Island employees.

A reaction was sought from the Premier’s Office on this allegation and though no one was willing to go on record, one source went as far as to say that several employees of Scrub Island have made an appointment to speak directly with the Premier. The source further said Government was treating the appointment as one of “urgency”.

Workers further alleged that on a number of occasions they filed complaints to Labour Department and were subjected to a high level of discrimination as a result. "You can’t go to [a certain government Minister] because the same day or night he would call them saying so and so person just complained that XYZ and you are a target by management after then," one person alleged.

Efforts were made to reach the Minister for Natural Resources and Labour, Hon. Kedrick D. Pickering for a comment, but this news site was told by his Secretary that he was out of office for the day.

Contact was made with a Mr Kenton Callwood of The Labour Department who said he was not aware of any complaints  from workers of Scrub Island Resort.

The concern of hiring locals at Scrub Island is serious. It is alleged that at the most recent interview for employment very few locals were hired and that the majority were expats. "Myron and them up and down saying that we got people but they are not doing anything to help these people. The other day they had a set of Tolans who came over to look for jobs, they hired Jamaicans. Ninety percent of the staff on scrub Island is Jamaicans,” the person asserted.

A complaint was also made about a person in management, who allegedly behaves inappropriately with guests by walking around the pool area and watching at ladies even while they are in the company of their husbands. "One lady said that she doesn't want to cause a conflict because she was leaving the next day, her husband said he is very rude to all the men that are there," another person stated. She further said that one woman even rebelled to the senior staff's lusting. "There had a point where a lady actually opened her legs to him (name called) because that's where he was watching."  

The Scrub Island workers also feel that the recently launched Staycation initiative by the BVI Tourist Board would be a failure as the Scrub Island management exhibits a high level of discrimination to locals. "The only people who gets discount there are the government people and the managers' friends. People would want to come in groups or couples and they don't budge the price, they put the same price tag like it’s tourists they are dealing with and that's not encouraging at all," one person alleged.

All of the workers agreed that the only time they get a listening ear is when they speak to Representative of the Third District, Honourable Julian Fraser, RA.

"We got to break the silence because it going to continue and nothing going to be done about it. It’s time we put it out there so that the people of the BVI, whether its government or opposition, the only person who does sit down and listen to our problems is Fraser (Hon). We can't go to nobody else and talk to because what is going to happen they going to go right back and tell the source because, like I say, Scrub Island is NDP."

Contacted, Hon. Fraser said he had been hearing about issues at Scrub for a long time, but in recent months he has been able to have meetings and conversations with a number of workers at the resort. During this time, he said, a number of concerns and complaints were raised, including allegations of impropriety.

“I have given the workers some suggestions as I endeavour to further our discussions, unfortunately however, the situation remains fluid as events continue to unfold with the recent termination of a staff. Nonetheless, as a leader I must act responsibly and remain objective by giving the management at Scrub the opportunity to present their side.”

Hon. Fraser also said it is his hope, and if it is the desire of the workers, that he will go to Scrub Island to meet the management for their side of the story within the coming weeks. “It is then and only then I will choose whether going public is in everyone's best interest.”

Scrub Island Resort's response to allegations

Responding to the allegations made against the management of Scrub Island, Its Managing Director (MD) Mr Martin Smith said he is convinced that the issues taken to the media was done by disgruntled persons who are no longer with the company after being dismissed for non-performance.

Speaking on the issue of gratuity he said that a committee was recently set up to deal with the subject and has since informed members of staff on the system of payment. He said that payments have not yet started because of the recent committee’s decision on how and when payments will be made.

As it relates to the level of employment of VIslanders, Mr Smith contended that records in the Labour Department would show that they have the highest number of locals as compared to any other resort in the Territory. “When people lose their jobs for a lack of performance there is the immediate feeling that I am being picked on because of where I come from or what I believe in which is absolute poppy cock,” said Mr Smith.

“In one department I have 12 employees 11 are locals, in another department I have 9 employees 7 are locals, in another department I have 9 employees 7 are locals, in the last four months or five months or six months I have promoted 1 BVIslander to be a supervisor. I have promoted another BVIslander from one position to be an assistant Manager; I promoted another individual from the entry level position now to be in a very prominent position on the Resort. We have a very, very good record and we are very proud of it,” asserted Mr Smith.

“One person or two people not doing their job cannot in anyway be allowed to lower the standard of the resort so the rest of the people don’t have jobs. We have a good track record and its public,” the Managing Director further emphasized.

He disputed the allegation that they have been making attempts to get rid of some people to make things cheaper as the resort has an established pay rate system which is strongly adhered to.  In addition, he said  Scrub Island runs advertisements all year long with Staycation packages, which do not discriminate in anyway.

On the allegations of the staff that is accused of being lustful to females and rude to male guests, Mr Smith said, “I cannot comment on wild accusations.”

Mr Smith did admit that Scrub Island Resort has had a quite a number of activities/meeting being held there but he was very strong in noting that all workers are paid their dues on time for service provided and they are not in any way made to wait for the business to receive payments from any given event be it government or otherwise.  “We don’t pay based on when we get paid we pay based on when somebody works. Gratuity is paid every two weeks. If someone has a banquet and they leave a tip of $500 or whatever, that tip is on their pay cheque, no exceptions.”

The Managing Director said Scrub Island Resort is a community driven property which is very proud of what it does and staff can attest to the fact that it is committed to hiring people from the Virgin Island since it has a phenomenal staff. “Our staff gives us high ratings, which we are proud of.”

Mr Smith also said it was important that the company maintain a good relationship with whichever government is in power at any given time.

It smells of made up over the top cannot be proven allegations of disgruntled lazy non performing locals who are looking for another entilement of a handout..       Theres no doubt that the entire company needs to be looked at as well as the bank and the government. I was an employee and way to much shady stuff went on with the finances and government. Like always where there is smoke there is fire and in this case its an WILDFIRE. Look into where D. Potter went to college. She is the Daughter of a government official who moved to the US was provided housing by the management company was provided transportation by the management company and for that they were allowed to build on the beaches. They need to contact the old GMs and Director of Operations to get the truth as there is so much truth to this story and the management company is all behind it.

        smdh you are the damn fool. If you qualify for a $10 an hour job you won't have to apply for a $5 an hour job that's the point. It all boils down to value. Will another company value that employee or are they a slacker looking an easy way out? If they are qualified or a $10 job they can go elsewhere and get it with ease. BVI has no shortage of hospitality jobs, I pick up a Beacon today and it's packed with vacancies. don't tell me no crap. Most of these complainers are people who know they can't make it elsewhere so they cause as much confusion as possible hoping labor will come to the rescue. it's pure foolishness. BVI doesn't have slavery especially with locals. Expats get treated bad because of their position, they don't have free movement (legally) for employment. locals do and they can get up and either seek work elsewhere or start their own business. the bottom line is, we have the choice but we always value 'jobs' over 'opportunity'. A company hire who they want and that's that. if they don't like your performance you have to go. Not because a company making money adn doing good business means they should pay you top dollar. Your salary should commensurate with your responsibilities and performance. Your salary is not based on how much the company makes, it's based on what your level of contribution is. You can't expect $50k a year to answer the phone and mop the floors all day. that's just an example.

Too many of us go with the flow because 'our party' or the party of our fathers/mothers said so. Where is informed decision-making in this?     I've been fired too from scrub island n @ liar MS that's not true about performance all u managers is who not performing all you like to listen to hear say n deal with matter individual instead having both person @ the sme time n Harrigan ,HR worst he's a yes man under boy I went to labour n I got no justice so it's true ndp is for scrub I spoke with every one who under the labour department even mrs George's only the governor left for me to go to n I will unfair n wicked set of managers n I know other staff too who I've been dismiss unfairly n K C all u lie how much time when VIP was in power u both was sent to the resort n all you only sit for5 mins an come collect all u lunch n on the boat which was ready for the half hour when u all arrived on the hour liar all u wicked a staff was dismiss early I which she go vino an tell them her conditions n the terms she was fired oh boy!

    What these workers have disclosed is nothing but the truth!... They treat those workers like crap and I've seen it with my own set of eyes! There was this one older lady that worked there and a manager came down hard on her for not picking up a cigarrete bud she passed! There is this guy that barely says morning or Afternoon to these employees! his morals are backwards that's why his wife does what she wants and can't be bothered with him! She isn't even on island! The claims with cutting pay is even more true!

    Scrub Island Resort is a Marriott's Autograph Collection and allegedly treating their Human Resources in that manner. As a silver member of Marriott's I am very disappointed and I hope that this matter is investigated by Marriott's. not a good image foe Marriott's at all.

    M..... and his right had man bin....is to shellfish for them self kind of poeple I worked for scrub almost a yr a resigned from a job to work for them,pay in mind I live vg I used to have to spend like $120 a week just to get to work and for some reason no matter how much good I did was never enough for them I was dues for vacation and no mater how many times I requested it I was denied but every te they deny my request some one else gets to go in my department which was marina and out, so I asked if I can get the vacation money then and just take vacation when ever they say no to that too so after the fourth request still denied so I had enough of ther bs and just resigned because te way it was heading I would of end up balo,I might not of born here but I was raised and did some of my schooling here,the bvi govt really need check these people out,and I'm not doing this to try get my job back either cause I'm doing a lot better me and my bro have some a boat that Scrub Island calls when there boat are broken,those to get to see me from tone to time and the guilt and the shamness in their face when they see my over there the try to look long talk but I prove to them I could do better ha "I ain't got no worries"

    After reading these comments I'm not surprised.

    And to imagine the NDP government actually wanted to have much more hotels in this territory knowing fully well that hotels are all about whites and whites alone and all others- non-whites- will face discrimination as long as they work in them.

    We cannot expect persons who have done nothing to foster better race relations in the places where they've spent their formal years to all of a sudden come here and have tongue-in-cheek types of relations -especially employer-employee- with our people.

    These people are fighting for their genetic survival and to maintain that power equation-white power/non-white powerless and as such, it means that since blacks are their greatest genetical threat in terms of skin coloration, they must face the harshest of the brutalities afforded to non-whites in all areas of people activity especially employment.

    Have you people not realized yet that fewer and fewer of our people who have whites as bosses are ever happy at their places of employment? And the society still wonder why our people are running helter- skelter to be employed by the government!

    I think this is where government should step in and start to have conferences with these white employers that do business here and bring along psychiatrists-why, hell to include the billionaire one-to help them get comfortable with their numbers as a global minority collective on the planet and their skin-coloration.

    Perhaps then we can see a change in the manner in which they treat our people. Until those conferences are held don't expect any changes in attitude towards blacks from these people. You people would be wasting your time.

    We as the black collective must learn to understand when a global power collective states that they can't change their behavior of genetic survival tactics toward black people globally and Virgin Islanders(British) locally, that is exactly what they mean: THEY'RE NOT GOING TO CHANGE!

        I'm a white person living here 15 years and I've never seen a people more rude and racist in my life than the black community here to the white people. Asking someone to work hard and do their jobs to a higher level of expectation is not racism, but since that's been the battle cry for so long, why not keep using it! The government will come to rescue them!
        Nobody is keeping the BVI down more than it's own people.

    with any conflict like this, there is always an element of truth on each side. But any bit of truth against local workers and how they are treated is still not good. The allegations do not surprise me in general. The idea of cheaper labour, elitist abuse and inconsistencies in management have always been a worry from the beginning. because it is an island and a favourite of government also leads to questions of fairness.

    5,721 employed by Government
    Hotel and Restaurant 3,530
    Fishing Industry 18.
    Now how is the Present Government going to Fix this.

    I have read the comments and Mr. Smith reply. My advice is always tell the truth, never deal with the staff in a manner they will hated you. People are people everywhere,all they wanted is to be employed in a place that show love and acceptance, young people are even more needy, because as a manager you have to help them gain experience which will allow them to grow. Many managers in Tortola make some of the worst mistake in their time of management that they themselves show the incompentence of everyday comman sense. Managers should not be dealing with things angry, but many of them cannot deal with conflit in their own homes but they come to interviews and fake every thing. Managers must use the principles of moral and ethical values, but some do not know what that mean, if an employee stand up against a manager they first thing comes to mind is to get evern. They close their eyes to the understanding of the golden rule" Do unto others as you would have them do unto you'.

    There is more truth of what is going on at Scrub and the goverment need not to get into it unless there is evidence that there has been grusome effect on the employees right.The employees need to be compensated for the alleged unfair treatment and dismissal. However many managers today have done a lot of unfair treatment to employees and many walk away for reasons such as " they will send us home", there is too much stress.

    I must commend the employees for fight a good fight. We become part of a problem for two reason, one to solve it or to condone it. A famous philisopher says " Be the change you want to see in this world". Never should one see wrong and do nothing about it, you allow wrong to go on and fester into bigger problem. Scrub Island Management I call on you to solve the problem, don't come on the news and pretend there is no problem, get with the employees and solve it, it help to retain and regain good moral and ethical status.

    There was the best housekeeper the best of the best. Whenever she is on duty no complain from guest. Guest always gie good comment about her, and they fire the girl for nothing. That is curel. m & b terminate the lady because she get injury on the boat last November . No severance pay, insurance did not cove her, she gets nothing labor does nothing . Minister Frazer please am asking you to try and see if you can get intouch with that lady. She work with the company since they launch in 2010. She will tell you everything from begining. Right now I believe the matter will be in court soon. listen to the staff not management, and if they know what staff make compain they either fire them or force them to resign.

      The sad fact is that most staff don't comprehend the following:
      They are given a job to perform a certain function
      If they don't perform that function then they need to be replaced
      Scrub Island like all other businesses is there to make money, staff are required to help make that money, if they can't help the business make money they are not required.
      Staff were not employed because Scrub Island or any other business is just being generous to hand out money.

      In other words do your jobs like you are expected to and you wont have problems.

      This is how they treat workers in third world countries. When you allow employers to import the cheapest workers from Philippines and India to compete with local workers, then you must expect that Philippines and India values and culture will also be imported and established here: poverty, crime, prostitution and sex work, and yes, even terrorism are part of the culture in Philippines and India.

      And so if we continue to import cheap labour and cheap culture and values from these places, our precious BVI which was always a place of peace, love, pride and respect will be a place that first world countries will not welcome, visit or want anything to do with. BVIslanders have always been welcomed the world over. Can the same be said of India or Philippines nationals?

      GOVERNMENT: is it really worth jeopardizing the BVI`s reputation and status just to satisfy the greedy and unscrupulous demands for cheap labour without regard for the social cost of that labour?

      WHO DO YOU, THE ELECTED GOVERNMENT, REALLY REPRESENT? AND WHO DO YOU THINK YOU ARE FOOLING?

    I'm only offering the real explanation as to WHY these people can't change. Today, a Scrub, tomorrow another trust company, the other day, a "Dix", next month, somewhere else. In other words, these problems are "systemic"-a power struggle is in play and the only ones who are unaware as to what's going on is our people.

    White folks are in the know as to what the real games are about and that is why they've been so successful globally regardless if they're in locales even when they're the numerical minority.

    I am in the view that with the knowledge that "Color Blind" possesses , he or she will be able to hold conferences soon to help all of the population to become "color blind". For you see, events happening all around suggests that "color" does come into play but with "CB's" expertise , we will all be able to finally say "kumbaya" and perhaps color blindingly "get along"!

    p.s....if only the white numerical minority population in the territory obliges!

    The Human resources Manager there is a "yes" man only to please management, even when he was working at Rite Way in the same position. He do not risk looking out for the staff concerns for his bosses to get angry at him either. He will faster join the bandwagon and fire you with some little excuse that seems legit. It doesn't make sense taking your concerns to him either because you will only create a disaster for yourself, thats if he study you at all which he is famous at when you turn your back. Bet every one there will agree. Mr. H is a nice man otherwise, but not as a people's person on the work place when shi*t hit the fan.

    We had a Human Resources Manager by the name of Vanessa Paul, she was the best Scrub ever had but I guess she was getting to close to the staff so she had to go. Mr. H is not for the staff at all so he needs to go. Please go and look for Vanessa and bring her back

    The unfairness from the management is truly disgraceful - The staff are really on stage when it comes to the guests, but now the public knows all the s*** that does be going on backstage. The staff of Scrub Island are all humans who took on a position at Scrub to provide for their needs, not to be treated like MESS!!!

    I know for sure cooperate is going to be taking a visit to the island.

    The Marriott is about top quality service - they not going to stand for this nonsense which would lower their quality of service - happy staff gives the utmost service possible - In order for the workers to perform their jobs well they must be treated with respect, should know that the supervisor/manager is guiding them to do the right thing and not be STOLEN from.

    M.....n needs to STOP the boating company he has running and start fixing the actual boats that is used to transfer guest back and for from Tortola. EVERYONE (Staff) knows that what he is doing is wrong, no one talks about it because they all know he has privilege to fire them in an instant.

    The resort is certified as a 5 star resort not a 1 class dip S***!!

    This story is not all about people from the islands or black and white. It is just about the staffs being able to feel comfortable in a work place u spend most of ur time. We all know that the corperate office will try and defend the big bosses down here but there is a lot of things that your MDr and Resort Manager are not telling you. Ask your MD who the 2 boats down in the marina with Scrub logo really belong too, also ask him wat B&B stand for and who's trade license is being used to do private charters. Is this not a conflict of interest???? You guys are putting ur trust in a man that is all about making money for himself. His mouth is sweet so he will charm u guys with anything. Wake up President and Vice President!!!!!!!! There is only so much the government can side u with remember in the next 2 years they will be be looking for votes from the people. Wat is in the dark must one day come to light. The staffs are not trying to bring down there work place but just want the public to be aware of wat is really going on over here. Wake up BVI we are not the only outer island resort that have experience problems like this!!!!!!!!!!

      The employee handbook that they handed out clearly pointed out personal hygiene regulations. Doesnt that apply to management also? This in.... dude be coming on the boat among staffs and guests smell like the ram goat from up humptum ghaut. I know this aint got much to do with this post but I do hope he will read it and receive a reality check!

    This is for the mangers that know they were on there way out of Scrub but they decided to carry news to the MD and other big bosses on their staff to kep there job. Your time is coming. Stop going around calling your staffs name wen u don't know s--t. They need to just hit u guys with a hard lawsuit.

    Study says, employees leave the company, not because of the company but mainly because of Immediate SUpervisor or Manager. In addition, if there's a turnover problem, look first to your managers and supervisors.

    it is allged that if a Scrub employee makes a mistake on what he/she does, he/she is easily get fired by the Management. No first warning or up until second warning. Fired right away. Not considering, teaching such employee to correct his/her mistake and/or give continuous training so as to improve workmanship. Sometimes, when an employee just follows the company policy but not in accordance with Manager's personal interest, he/she's get fired.That's ridiculous! Looks like some Managers prioritize personal interest that company interest.
