UPDATE: Elston McLean fined for damaging wife’s car

- reprimanded & discharged for drug possession

ROAD TOWN, Tortola, VI – Senior Magistrate Tamia Richards stated in a recent ruling that the court was not interested in instituting a sentence of imprisonment upon accused drug trafficker, Elston McLean.

McLean, of Soldier's Hill was allegedly discovered with marijuana and cocaine on June 3, 2012.

Magistrate Richards said McLean, who had been charged with criminal damage and unlawful possession of a controlled substance, had made efforts towards rehabilitation through his attendance at the Sandy Lane Centre. His actions, she added, were further mitigated by an early guilty plea in the matter.

The offence of unlawful possession of a controlled substance carries a maximum sentence of three years with a fine of $100,000.

Magistrate Richards fined the defendant $500 or an alternative of 30 days imprisonment for criminal damage. She also stated that there would be no order as to compensation on the criminal damage charge.

When the defendant was asked about payment, he informed the court that he did not have enough and requested additional time. He was given two weeks to make the full payment or face the possibility of imprisonment.

It was alleged that on February 13, 2012 ranks from the Road Town Police Station responded to a domestic dispute with McLean of Soldiers Hill, and his wife in the vicinity of the Elmore Stoutt High School.

Officers allegedly met a parked jeep in the vicinity of the UPs Cineplex with a female sitting in the vehicle.

The virtual complainant (VC) told officers that she met with her husband after work on the said day. While driving to Road Town an argument allegedly ensued with the defendant, who started to get aggressive with her. She allegedly asked him to leave the vehicle and he began using indecent language.

The VC said she told her husband that she was going to the police station to report the matter and while she proceeded to do so he broke off the fingertip gear stick valued at $550 and a right side wing mirror valued at $450.

McLean said he had compensated his wife for the damages.

Meanwhile, McLean was convicted and reprimanded on the drug possession charge, which meant that he would not be serving a custodial sentence for the conviction.

The defendant was represented by attorney, Ruthilia Maximea.

ROAD TOWN, Tortola, VI – Crown Counsel Sarah Benjamin yesterday, October 3, 2012, requested more time to examine the files in the matter of Elston Mclean as she claimed she had just recently received disclosure on the matter.

Mclean, who was charged with criminal damage in addition to drug possession, was represented by Ruthilia Maximea.

The accused is charged with the unlawful possession of a controlled substance (marijuana and cocaine) which was allegedly discovered on June 3, 2012. He explained to the court that after examining the charges he felt it was necessary to secure legal representation, which he had not previously sought for the drug related offence.

Crown Counsel Benjamin told the court that the files indicated there was a pending analysis of the drugs allegedly found on the accused. Benjamin said there was no indication that the substance was tested and requested an extension in the matter since she was unsure of when the analyst would be in the jurisdiction but would make enquiries.

Mclean had pleaded guilty to the charge of damage to property when he appeared before the court on February 29, 2012. He related to the court that he had met with his wife and had compensated her for the damage caused to the vehicle. Magistrate Tamia Richards asked that his claim be submitted to the court in writing.

The defendant further noted that he was conducting sessions at the Sandy Lane Centre in relation to the matter.

Officers arriving at the scene observed that the mirror was damaged. The defendant reportedly arrived on the scene a short while after and asked to speak to his wife.

Mr Mclean subsequently apologised and was charged in the matter.

He was asked to return to court on November 28, 2012 for report.
