UPDATE: DR man fined for destroying ex-girlfriend’s cellphone

ROAD TOWN, Tortola, VI – Rueben Reyes, 26, of the Dominican Republic was fined for destroying his ex-girlfriend’s mobile phone after the two allegedly had an argument at a night club earlier this year, 2013.

When the defendant appeared before the Magistrate’s Court previously on May 17, 2013 he pleaded guilty to the offence of criminal damage and was placed on $35,000 bail. The phone was allegedly valued at $700.

Allegations: Crown Counsel Herbert Potter stated that the Virtual Complainant (VC) is the owner of a black and silver BlackBerry Bold mobile phone and was involved with the defendant but the relationship ended earlier in the year.

On March 10, 2013 at about 6:20 P.M., the VC and a friend were at a party and were in the vicinity of Club Diplomat drinking and listening to music while the defendant was also present. The VC and a friend were at the bar and she had her mobile phone, which was in a pink case at the time.

Later on the same day, the defendant signalled to the VC to come over but she refused. She subsequently made a check for her phone and discovered it missing. She then asked her friend to call the phone; while her friend was calling the phone, the VC allegedly saw the defendant with her phone in his hand and it was illuminated.

The VC then approached the defendant and demanded her phone but he allegedly refused to return it. An argument resulted and the defendant allegedly threw the phone against the wall.

The matter was later reported at the Road Town Police Station by the VC and the defendant was arrested and taken to the station. A search was conducted on the defendant’s person and the pink case was allegedly found. An audio-video interview was conducted with the defendant and he allegedly admitted to destroying the phone and was charged on the same day.

The VC visited the police station on March 26, 2013 and reported that the defendant had replaced her phone.

Reyes, in mitigation, confessed that he had damaged the phone and also said that he had given the VC a brand new mobile phone in front of Police Officers while the two were at the Police Station.

Senior Magistrate ruled that Reyes, who had been in the Territory for three years and was employed at a car wash, should be fined for the offence while explaining that there was a maximum sentence of five years imprisonment.

She said the court took Reyes early guilty plea and restitution of the mobile phone into consideration in coming to its decision.

Reyes was fined $1000 or an alternative of 2 months imprisonment in default of the fine. After stating that he could not pay any of the money immediately and required some time, he was given two weeks to pay the fine or face imprisonment.

Crown drops charge against DR man accused of 'fighting'

ROAD TOWN, Tortola, VI –Rueben Reyes of the Dominican Republic had one of two charges against him dropped when he appeared before the Magistrate’s Court last week.

Reyes pleaded guilty to criminal damage but not guilty to affray (being involved in a fight) when the charges were read to him by Senior Magistrate Tamia Richards on May 17, 2013.

The affray offence allegedly occurred on December 28, 2012 at Long Bush. According to the facts read in court, Reyes also allegedly destroyed a BlackBerry phone valued at $700.

Senior Crown Counsel Valston Graham said the Crown would not offer any evidence on the affray count and sought to clear the court’s calendar of a matter he suggested was less important than many of the others that currently clutter the court such as assault, theft and other aggravated offences.

The Spanish speaking Reyes, who required an interpreter during his hearing, said he has been in the Territory for three years. He also told the court he is currently employed at a car wash.

Reyes was placed on $35,000 bail and will return to court on May 31, 2013.

    You all making a joke of this but this could have ended up like another KAY KAY story - Murder. Ladies be careful who you pick up with and bring into your life. Some of these men are so jealous they will stop at nother until they kill you. Next thing, why he has to be in this country, a country so overrun by expatriates just to wash a car??? the Labour Department needs to take a look at what they are doing! strupps man!
