ROAD TOWN, Tortola, VI- After being remanded to the Peebles Hospital for medical evaluation, Elrys Todman appeared at the Magistrates Court today, August 13, 2012, where he was instructed by Magistrate Tamia Richards, that the request for his case to be a

Mr. Todman was remanded to the Peebles Hospital for an assessment to be done, after he appeared in court on July 19, 2012, after his lawyer, Mari-lou Creque requested that his case in the court be postponed to a much later date, to give him time to gain medical attention overseas.

The medical report given to the court by the Peebles Hospital, stated that Mr. Todman is not in need of any major medication that requires him to leave the country. The report further stated that Mr. Todman has a mood disorder, and he should remain in group therapy and on his medication, within the territory.

Mr. Todman is facing charges of alleged criminal trespassing, resisting of arrest and assault of a police officer and burglary.

Magistrate Richards noted that the bail requirements that were laid upon Mr. Todman would be increased from $20,000 to $45,000, with two sureties and he has to continue taking medicine and attending group session.

The crown was represented by Leslie-Ann Faulkner.

Mr. Todman will return to court on October 16, 2012 for trial.

In a previous court hearing, Ms. Creque requested for the case to be adjourned for several months for the accused to attend a mental health facility in Santo Domingo, in the Dominican Republic, where he would be under keen observation and receive treatment for his mental disabilities.

Mr. Stephen Daniels, who was holding for Ms. Creque at the time, informed the court that there is also an existing matter in the High Court that involves the defendant being charged with another alleged burglary incident. He added that the court where Justice Albert Redhead presided gave the defendant time to attend the facility, and the case would resume upon his return.

      Hummm, I read this story the last time and I am feeling like this Miss have something against this young man. Why she put up his bail when I understand the person for the property is not charging him with anything. This young man may have problems but I do not think they are handeling it in the right way. Next thing you know she send him Balsam Ghut (where she likes to send all of our local young men) and he will get even worst. I feel for this young man mother cause they have her like yoyo..one judge says something and the other over rule...struppssss..no wonder some of our trouble young people don't know if they coming or going...who is really looking out for our trouble young youths of today? certainly not the justice system...like they get brownie points when they send them to over crowded Balsam Ghut.

    Tortola don't need any crazy house. Govt shouldn't have to be caught up with that expense. It's time for families and churches to seek help for these people.

      Help where? That is what the Gov. is for. They must provide Hospitals, Police, Fire Stations and such for their citizens. They must also provide qualified people to run these facilities. Let's stop calling it a Crazy House and be more politically correct and sensitive to these issues . It is a Mental Institution or Mental Hospital. The people are Mentally or Emotionally Challenged or Impaired.

    I don't understand if a judgement was handed down in court by another judge to get help, how Richards could over turn it. Sometimes I wonder about her. This boy needs help and she well know Tortola dont have any facilities to help him. All they going to do is poke him up with injections which will make his situation worst. As far as I undertand that other incident she talking about, no one filed any charges against him for he did not break and enter or took anything. It's right there in her book...she just Jokey...I know if he was my son, I would have fight her on this decision..Like she have something against our local men..You never hear her give a word of advise to anyone of them...

      Like all you does be in the court when Ms. Richards giving her decisions. The High Court has its own jurisdiction and she has hers. She dealt with what was before her -- a crazy man who needed attention before he goes to Santo Domingo. So how you saying Richards overturning Redhead's decision? All you just like to talk 'thud' when you weren't there? According to the ole people, "DarkVader, wweere you there? The first time ah crazy man crack yoh a stick when you walking in the street for no reason or start limbing off your limbs with weapon in brown paper bag for no reason, then you will say: "Barry said you will hear then."

        Yes, for your information I was there..were you? Stuppssss...Papers from his physo..stated that he is having problems not his lawyer. The suggestion was that he goes to this facility in Santo Domingo that will help him..not just send him there to have fun. We have no facilities here to make him better MYPEOLA or the suggetion to send him would not have been mentioned. Who really needs the stick now..for you lack understanding of this case and sounds like the cray one to me. TO: Pistol Pete, read again if you can..she clearly states there is another incident pending that he had to appear in court for...geezzeeee...

          You see, some write without understanding. I was there with his mother and I know what went on. Todman has cases before the Magistrate's court, a different jurisdiction to the High Court. The Magistrate is not denying his mother from taking him overseas. All she did in denying Creque's application is to say after he has concluded his case before her court, he may be taken to Timbuktu. Further, the Magistrate had said that she got a letter from Dr. Samuels who stated that Mr. Todman was fit at the time to proceed with his court case. Magistrate Richards is within her right to deal with the case before her once she is satisfied from Dr. Samuel's report. It is not right to have people with mental problems walking with sane people. They may mistake your child for a 'pitbull' and whop him/her. Remember the case in St. Thomas where the crazy man limbed off the white people on Vessup Beach and proceeded to eat one's hand? These are serious cases and yes, Tortola does need a 'crazy house.' In the meantime, let the Court do its job without your interference.

      What other incident she spoke about idiot? So you can go court, plead crazy and because your lawyer say you are crazy the Magistrate must take his untrained opinion and set this man free to go off to "Santo Domingo". You cannot come and say Judge SAY, evidence must be offered up. It must have been the lawyer did not offer any trained person's mental evaluation in the matter.
