ROAD TOWN, Tortola, VI – A cousin, who was said to be very close to the late Kwanna Todd-Rhymer, and a male friend of Alcedo Tyson were two of the witnesses for the Crown as the murder trial entered day four in the High Court today, June 20, 2013.

The names of the witnesses would not be mentioned in this instance and hereon at the request of  Senior Crown Council Ms Leslie Ann Faulkner. 

A young man called to the witness box today spoke about his long relationship with the accused with whom he said he "cooled" a lot with over the sixteen-year period they had known each. He also spoke about the interaction between himself and Tyson on March 15 - 16, 2012.

Under oath, the witnessed said that on the night of March 15, 2012 himself, Tyson and another man had spent time together at a bar upstairs of the Brother's Gas station in Baughers Bay. The trio had then visited Perler's club, which is also located in Baughers Bay. The witness said he had seen Kwanna and her friends at Perler's.

He further testified that he and Tyson had later driven over to the Deuces night club with their friend's vehicle. The friend did not go with them, he alleged.

The witness told the court that once at Deuces he didn't recall seeing Tyson again and he had made several phone calls to Tyson’s mobile phone after security personnel had raised an alarm following the shooting. The witness said he ran out of the club and had allegedly seen Kwanna lying on the ground.

He further told the court that the friend's vehicle, which Tyson had driven him over to Deuces with, was nowhere to be seen.

The witness alleged that he had called the owner of the vehicle and then went to collect him on his motor cycle. They then went in search of the vehicle, which they allegedly discovered in the “church's parking lot” in the Long Bush area. Tyson, the witness alleged, was nowhere to be found.

He said they then went back to the scene of the murder.

The female cousin of Todd-Rhymer testified to allegedly witnessing the shooting on the morning of March 16, 2013.

The trial continues this afternoon as another eyewitness is scheduled to take the witness box.

UPDATE: Witness alleges seeing Tyson shoot ‘Kay Kay’

As she testified from Jamaica via live video/audio link, a tearful Shaneel Maxwell alleged she witnessed murder accused Alcedo Tyson discharge a gunshot from close range towards her late friend Kwanna Todd-Rhymer aka Kay Kay.

The eyewitness and Ms Todd-Rhymer were close friends, however, on the night of the alleged shooting they did not go clubbing together. Ms Maxwell told the court yesterday June 19, 2013 that she was a patron at three clubs on the night of March 15, 2012 but had seen her friend Kwanna Todd-Rhymer at two of those clubs, Perler's and Deuces.

The witness said that sometime around 4 A.M. on March 16, 2012 she had indicated to the victim that she was leaving the Deuces nightclub for her home. According to her, Ms Todd-Rhymer and another female walked out behind her as she was walking to her vehicle when she allegedly saw the accused run past her in the opposite direction.

She alleged that Tyson had a black object in his hand and shortly after he had passed her she heard an explosion. Looking around she allegedly saw Tyson standing over the body of Ms Todd-Rhymer. "Then I heard another explosion and I see like fireworks or fire coming from the black object again.”

"I know it was the person I met in UPs in April, Alcedo," she added as she wiped the tears from her eyes. She was confident of the shooter's identity as she said that he came from the direction where there were bright lights. "He ran back to the same direction he came from," Ms Maxwell testified.

Having allegedly witnessed the episode, Ms Maxwell said she then hurried off in her vehicle to Fort Hill to retrieve a photograph of Tyson via a Facebook account and returned to the scene of the crime to show it to the police.

Ms Maxwell said Alcedo Tyson was shown to her by one of her friends. The friend had allegedly inquired from Tyson what had happened to Kwanna's baby and he had allegedly responded, "That was so long ago and we do not have a child together."

She recalled seeing Tyson on a few occasions thereafter as he was ‘liming’ with his friends. The witness also said she saw Tyson in the CSY parking lot on the night of March 15, 2012.

Prior to Ms Maxwell's testimony, the court spent an extended time going through the video footage captured by surveillance cameras at the Deuces night club in the early morning hours of March 16, 2013. Tyson was seen standing in one position in the night club for most of the time and occasionally being on his mobile phone. Kwanna Todd-Rhymer was also seen in the club and so was the alleged eyewitness Ms Maxwell and others.

While the footage did not capture the actual shooting incidents, it gave a clear picture to moments leading up to the incident and what appeared to have been indications of the shooting, which was allegedly witnessed by a man who was on the balcony of the nightclub at the time.

The video also shows that Tyson had briefly stopped at Ms Todd-Rhymer as she was in the CSY dock parking lot that fateful morning. The video footage evidence was led by Detective Sergeant Jason Harford.

Chief Medical Examiner from Florida, NY, Dr Bruce Alan Hymer, the pathologist who performed the post-mortem on Kwanna Todd-Rhymer's body, also commenced his testimony in the High court of the Virgin Islands yesterday. He confirmed that the woman had sustained two gunshot wounds; one to the neck and the other to the abdomen. He told the court that about one litre of blood had accumulated around the victim's lungs and heart as a consequence of the wounds.

Tyson murder trial interrupted after fire alarm goes off

- court evacuated, however, fire personnel said alarm may have been accidentally triggered

ROAD TOWN, Tortola, VI- The murder trial involving Alcedo Tyson was briefly interrupted this morning, June 19, 2013 due to an emergency evacuation of the High Court building after the fire alarm went off suddenly at approximately 9:50 A.M.

Fire and Rescue Service officers responded promptly, however, it was discovered that someone may have pulled the emergency switch by accident.

At the time of the alarm going off, Detective Sergeant Jason Harford was giving evidence in the trial for the murder of Ms Kwanna Todd-Rhymer. The video footage captured in the nightclub where Todd-Rhymer visited on the night she was killed was being shown to the court.

Things returned to normalcy at approximately 10:15 A.M. when the fire department declared the building safe.

Meanwhile, Police are alleging to be in possession of video footage taken on March 16, 2012 by surveillance cameras and that certain persons, including the accused Alcedo Tyson, were positively identified.

Todd-Rhymer was killed in the early morning hours of March 16, 2012 shortly after exiting a nightclub at Baughers Bay. She was allegedly shot more than once by her ex-boyfriend Tyson who was reportedly seen stalking her earlier in the night.

The video recordings were admitted into evidence following testimony by one Crisostomo Corpuz, the technician for security surveillances who had installed the devices on the nightclub. He told the court that he had retrieved the recordings and had turned them over to the Royal Virgin Islands Police Force (RVIPF) at their request.

Detective Sergeant Harford told the court he viewed the recordings well over a hundred times and had positively identified Tyson, the deceased Kwanna Todd-Rhymer, Shinelle Maxwell, Marvel George, Kittly Ward-Libard, among others.

Harford began giving evidence in the matter yesterday June 18, 2013. He told the court that during a search at the home of the murder accused police had recovered a mobile telephone, which they positively linked to Tyson, and it has a message from a mobile number linked to the victim. The message allegedly reads, "So you refused my drink?" There was no reply to the message, according to Harford.

While the investigating officers did not find the accused at his home, they came into contact with him at the Road Town Police station where he had turned himself in. He was allegedly accompanied by his mother.

The investigating officer also told the court that Tyson had repeatedly declined to cooperate with the investigating team and was allegedly in the habit of only responding when asked his name, address and a few other questions classified as formal or basic questions. The accused had also allegedly refused to respond to the offer of participating in an identification parade.

Birds of a feather flock together i'm not offended by what he saying. i mean people who actually get sweet ting and so forth see it different. When you aint experienced and basically WIFELESS you tend to hold onto to the first thing you get, then when she wants to leave or you turn out to be WHACK and she wants to bounce sometimes the mind can't handle it. Then you will have so called friends booting up your head with nonsense like "DON'T TAKE THAT" while they snickering on the side waiting to see something pop off...some will provide you with the weapon and help you escape from the scene just so they could see you in your dramatic situation. People seek entertainment by any means.       Oh, so a man allegedly stewing in jealousy thinking on getting a gun and blowing his ex's brains out is going to stop and answer her text? Maybe some would, some wouldn't. But failure to respond is far from a plea to innocence. In fact he had already shown disdain by refusing a drink from her. He was allegdly pissed off and stewing in the green pot of envy. Whether he intended to kill her from the onset or knew of the gun in the car and stood there playing out giving up his life for the pleasure of taking hers is unknown because he is to chicken to man up and confess to his alleged murderous crime. Despite there being eye witnesses to his evil deed. Stop sticking your head in the ground and making excuses for your friend. He is gu**ty beyond belief and her family should not even be ridiculed going through this circus trying to prove otherwise. Oh, but I suppose, she, a young 20 yr old woman had soooo many enemies on Tortola that wanted to gun her down. Another venomous enemy that happened to be at the same club that night. The same night where the asp showed almost the same time as she. The same night he stood staring at her, was seen running toward her, allegedly seen shooting her not once but twice, was seen running away. But no, it wasn't he. It was the other person who hated enough to kill and his somewhere in the sidelines taking aim at the same time her jealous ex stood in front of her with a gun pointed at her. LOL., you'd be a better friend to support him to confess and beg forgiveness for his alleged jealous rage and to visit him in jail where he,s going to spend the rest of his l**E.

    Reading these got me felling hurt, and I don't even know the young lady like that. You could of slap off the girl or even chuck her off. Not saying that would of been right, but lord allegedly a whole homicide on your hands. If you didn't do it then who did. I hope you can cope with knowing you been up the hill for a very good while.     The first time i hear about this same young lady told her story corret me if im wrong she say she didnt see who shot her friend but she saw tyson in the parking lot and she saw him jump in to a jeep and and it drive off but he wasnt driving. how much story dose this one case has! then if he was running from the bright light area the video would have pick he up and when he was running back to the bright light area some one else or the same video would have pick him up again im sorry for her lost but the witness and police need to get they story together cuz to me he look like he might walk i wouldnt want that cuz that heartless if he did do it or if he put some one else to do. only god give life no one else should think they can play god and take life! im just saying!

    There were nights when i had to pick up Kk and keep by me after him putting hands on her, because of jealousy.
    There were time I drop her off by the station to report what happen.
    The said night in question at paula bar someone close to me had to stop T**** from hitting her and ask your friends to take you home.
    It seem that was cool to k*** KK but God will deal with you.

    From what I heard, this young lady was nothing ez...DON'T GET ME WRONG, THIS TRAGEDY SHOULD NOT HAVE HAPPENED but if he has a good lawyer, who can pull all her texts to Alcedo and his facebook page for messages, even after him cutting her @$$ a few times YOU ALL WILL BE SHOCKED....In my book, partna wasnt stable anyhow and the school children say SHE KEPT FRIGGING UP HIS HEAD, hannin him str8. leave him, back wid him...causing probs with the other chicks dem. Any time the lawyer DIG DEEP, you all will see she was not a saint and she gave him pressure til I think he just snapped. The BVI police system is weak as u cans see so far in da trial. partna just may walk and leave the BVI to start life ova and if he is found guilty, what is 25 yrs for him in jail? he wasnt doing much on the outside anyhow. lacking wife? he will get that in jail,..lacking food...no sah,,,good food, ayer aint see his hair plait up looking like a toss in jail. He look better since in jail than when he was out. Ayer hurt up ayer head. He a nuckle head yes but in the eyes of the law INNOCENT UNTIL PROVEN GUILTY. Only punishment he will get is on judgement day and guess wa? Even God loves him still.
