Top Cop advises public on election offences

The Commissioner reminds the public that during the hours when the polls are open on polling day, no person shall assemble or congregate within 100 yards of any building that is designated as a polling station.
ROAD TOWN, Tortola, VI - The public is being reminded of the provisions of the Elections Act 1994 that must be strictly adhered to particularly as it relates to the prevention of voter intimidation and the protection of election officers, observers, and candidates at the polling stations.

In light of this, Commissioner of Police Reynell Frazer stated that officers are prepared to apprehend any violators of the law in order to ensure, as far as possible, the integrity of the electoral process.

The Commissioner reminds the public that during the hours when the polls are open on polling day, no person shall assemble or congregate within 100 yards of any building that is designated as a polling station.

He notes that it is an offence under the Act to sell, offer for sale or give away intoxicating liquor at any premises where a liquor licence has been issued under the Liquor Licence Ordinance between the opening and the closing of the poll on polling day.

He notes that it is also an offence under the Act to furnish or supply any loudspeaker, streamer, banner, flag, ribbon, label or badge with the intent to carry, wear or use on any vehicle that would distinguish anyone as a supporter of any candidate or political party on polling day.

A person is guilty of an offence of bribery if he or she directly or indirectly gives, lends, offers or makes such agreements or promises to procure any money, valuable consideration, office, place, employment, gift or loan in order to induce a voter to vote, refrain from voting or return a person to office. The same applies to those who provide food, drink and entertainment for the purpose of influencing a voter.

Any person, directly or indirectly, inflicts or threatens to inflict force of any kind on a person whether temporal or spiritual against a person in order to induce or compel such person to vote or refrain from voting or impedes or prevents the free exercise of the right to vote, will also guilty of the offence under the Elections Act.
