Rabsatt sentenced to 8 years in prison!

ROAD TOWN, Tortola, VI - Calvin Rabsatt, 66, who admitted to raping a minor, was this morning Monday October 24, 2011, sentenced to eight years imprisonment for rape, and nine months each for two counts of indecent assault.

The sentences are to run concurrently and were handed down by Justice Indra Hariprashad-Charles in the High Court. His sentences commence from the day of his incarceration, October 6, 2011.

According to Justice Charles, the whole situation was an unfortunate one as the victim "is a baby carrying a baby", and will be a mother in two months. She also added that the VC is psychologically scarred and contemplated running away.

On Tuesday October 18, 2011 when his sentencing was initially scheduled, Rabsatt collapsed in the High Court prisoner’s dock, before he could have been sentenced.

Mr. Rabsatt recently pleaded guilty to having sex with a 15 year-old sometime in February of this year. Prior to that, on at least two occasions he allegedly fondled her.

The Crown contended that the Virtual Complainant (VC) lived with Mr. Rabsatt and his wife, however, because of a rift between the couple – the teenager stayed with him. And sometime in January 2010, while the VC was watching television in his bedroom Mr. Rabsatt sat next to her on the bed and touched her hands, legs, stomach and her private part.

Then one day in January 2011, the VC was again watching television in Mr. Rabsatt’s room only this time he inserted a finger into her private part.

Meanwhile, the rape happened sometime in February 2011 around 11 pm when the defendant entered his bedroom and stripped down to his underwear, he then wrapped a towel around himself and sat next to the VC on the bed.

The court heard that Mr. Rabsatt cupped the VC’s private parts and began to rub it. Feeling uneasy she got off the bed and made an excuse to leave. He grabbed her as she was about to leave the room and proceeded to have sex with her.

The defendant’s action came to light after the VC started vomiting and getting diarrhoea, which prompted Mr. Rabsatt’s wife and the VC’s aunt took her to the hospital. When examined, it was discovered that the VC was nine weeks pregnant.

      yes i agree that he is nasty but the young lady is to be blamed also she liked having sex with him if she didnot like it she would have screamed tell someone and not stay there and get pregnant for him and i am still wondering if is his child i hope that they investigate that also.

        Ken you are such an idiot! How can a child be blamed for an adult raping her? You seem to be an uncivilized neanderthal who does not understand common human decency! Adults are supposed to nurture and protect children not use them to satisfy their sick fantasies!

        Ken, you will never understand the behaviors of a sexually abused child. I read these comments all the time and I am glad that these young ladies are finally finding the courage to come forward. I don't care what happened to make them come forward ... I am proud of them that because they finally speak up they are taking those pedifiles off the street and away from our precious sons and daughters ... so she has saved the life of many young children by her act of braveness. She could have liked about who she was pregnant for or not knowing who raped her .. where would that have left all of our children? ... at risk ... The ridiculous comments that I read about the victim children will cause those who are currently in a sexually abusive situation to hide and not come forth for fear of what the public will say. Whether she likes to have sex or not, he was WRONG for what he did. It is important that as a community we take the time to read and educated ourselves on the sexual behaviors of young girls AND boys who are sexually abused, then we won't have to read about comments where fingers are pointed at the victims.

    I hope he's alright and not playing tricks, but i can help but think that this could be his way of trying to sway his way into a lesser sentence, you can't put nothing pass this man.

    if one carefully reads the chronology of events he did not need "strength" for the little girl. whether he co-oerced her or threatened her is another story. but over the course of several months he fondled her etc and it only came to light when she got sick ...... this big hard back man must do his time no doubt but i cannot help but feel that as a society we are failing our young girls ..... TOO MANY of these types of incidents are being reported and more often than not it appears these young girls willingly take part. what is it that we have failed to do why these girls don't report these reprobrates immediately? it's all well and good to cuss and chastise but an ounce of prevention is FAR better than a pound of cure. we need to treasure our children and PROTECT them

    He hope that this isin't a prank to make that Judge feel that he isint fit to go to Balsam Ghut. The truth still remains that the man did the crime and he must so kind of time. Judge don't let this behaviour make you soft. A eighteen months is reasonable for him and when he comes out he should do communinty service for six months. That sentence is fair for him. Send you message your Honour that we are not tolerating this kind of crimes in our territory. You have a responsibility to this country and please carry it out regardless. Showing mercy is a good thing,but sending a message is better.

    this is nonsense this mamn need 7 yrs each for each incounter an 10 for underage rapeing ... tha shoulda been my sister or somebody ... an i sure he faking it cuz the judge woulda say he old an he cant stay there for long ... why them didnt prosecute he since he old ... if he old enough to have sex an know bout fingering then he should b able to spend 24 yrs in jail ... if he goin live to see tha ...hmm #ThatsBullS

      He is charged with rape and indecent assault, the latter having a 7 year sentence. So, your count is obviosult wrong. Good job judge. Send the message out that even at 66, and sick, you can go to jail.

    he needs to do his time no question about that but I cant help but wonder that girl was willingly giving it away to the man. I think she only told because she got pregnant to get the heat off herself. I sympathize with her that she is pregnant at this age. I hope that all works out.
