Premier Smith says negotiations transparent in cruise pier development

ROAD TOWN, Tortola, VI – The National Democratic Party (NDP) Government has sought to shed some light in relation to negotiations for the Cruise Pier development project, assuring that all negotiations and subsequent decisions were made in a transparent manner.

During their most recent NDP radio programme aired last evening, March 18, 2013 on a local radio station, Premier Dr the Hon. D. Orlando Smith said, “It is important that we do what we must do in order to make sure that we maintain a position in the tourism industry.”

Premier Smith related that an important part of the tourism industry is the cruise industry and said the Territory has to ensure that the cruise industry continues to contribute as part of the overall tourism industry to the country so that we can maintain the standard of living that we have been accustomed to in the Virgin Islands.

The leader of the Administration also stated that it was important to recognise that the cruise industry itself (cruise liners) indicated that it was necessary to extend the dock if the Territory wanted to stay in the business. He said smaller ships that were coming to the Territory previously, were now being moved to the Mediterranean region and larger ships were now coming to the Virgin Islands and other parts of the Caribbean. “Therefore,” he added, “it was necessary for us to be able to extend the dock, in order to accommodate these larger ships.”

According to the Premier, “If we did not do that, we would not be able to accommodate larger ships and therefore our cruise tourism would suffer as a result.”

Regarding the process involved, Premier Smith emphasised, “for us it is important that whatever negotiations or agreement we enter into, it must be paramount that the BVI benefits to the greatest extent possible.”

He further disclosed, when the current administration got into office and looked at what was being discussed with Disney, it was decided that this was not sufficient so the situation was reviewed. Following the identification of Disney through a process of selection the decision was taken to the UK for ‘expert’ opinion but did not find favour.

A tender process was later conducted and tenders were received and reviewed by the Tender Board which was followed by a recommendation to Cabinet.

According to the Premier, the Cabinet then appointed a negotiating team which then met with both parties involved in the tender process at the time, holding discussions, which resulted in the selection of Tortola Pier Partners as the team selected to go forward with constructing the cruise pier project.

He added, "the negotiating team was selected by Cabinet and included experts, law firm Baker and Mackenzie from the UK and also included an accounting firm PWC from Trinidad.”

Premier Smith identified the final input as having come largely from these external partners and the negotiating team. He further indicated that negotiations took place without the influence of government Ministers. “The decisions, actually, were largely based on input from these external partners and members of the negotiating team…”

Moderator for the programme, Hon. Archibald C. Christian asked whether it was accurate to say that of the five Ministers of Government, there was no discussion with respect to who would have been chosen at any point in time… “it was all left to the recommendations of the external team.”

Premier Smith responded by saying, “Of course, that is the way negotiations took place, in the form of transparency and openness. We appointed a negotiating team [and] they did all the work and reported back to government.”

    Premier, the talk show is not enough for transparency. I believe if this was fair and transparent as you claim you should hold a public meeting and have written material from the starting line to the finish line of what took place with this project. The people of the BVI get very concerned about big projects like this and RCCL making a claim like that raises questions so as you have campaigned make it crystal clear to the BVI people what was done step by step with definitions of the process as well.

    This man is so far out of touch with reality it's a shame. This Proposition includes a further 25 million dollars for landside development, a 30 year lease of BV Islanders Wickhams Cay land to foreigners, and another 25 Million dollars for some community development, and all this joker could address is the pier extension.

    no one has ever said we do not need development at the cruise ship dock. the question is HOW as with everything else. Size? design? involvement? public meetings? economic projections? domestic priorities? other projects first? and what other RT development? getting Disney to spiff up main street? keep them away!

    Even with the US congress, there is a smaller findings committee and then it goes to the larger legislature for a vote. nothing is left for just the agenda-based committee to finalize. This is poor governing of the public.

      The people want leadership. They are fed up with the status qou. They were very hopeful that after the 2011 elections that the NDP would deliver transparency and government in the sunshine.

      But it remains clear the leadership is lacking in our land.

    So you are trying to tell me that Baker and McKenzie law firm out of the United Kingdom as well as PWC accounting firm out of Trinidad; companies with years of experience chose a company that has zero, zip, or no experience in the project at hand over a company that has years of experience in completing such projects? Now its either there is some kind of under-handedness influencing the selection or the aforementioned firms have no credibility when it comes to aiding in fair negotiation and selection processes. These firms should be ashamed of themselves for assisting in such an unsound and buffoonery of a selection! Pure nonsense in my opinion and i am sure many others share the same sentiments!

      Please explain why it's unsound and buffoonery? The firms should be ashamed because they made a decision that you don't like? What is your expertise in this area may I ask? You have got to be kidding man. There is no pleasing you guys and that's why the Premier is wasting his times trying to explain. No matter what information they provide you will find a way to make it seem unfair. They brought independent firms in to make the decisions for this very reason. First you all said the Government choose the companies unfairly. Then you found out it wasn't Government that choose them, Government issued contracts to two internationally recognized firms to conduct the process and they were the ones that advised Government to choose TPP. Now with that information you stop blaming Government and are now blaming the two companies saying they should be ashamed of themselves. You should be ashamed of your self for mentioning such drivel. What is transparency and accountability if every step that's taken is looked upon as a game? So let's pay attention. First, it was Mark and Claude giving TPP the nod. Then it was Premier and Cabinet unfairly choosing TPP. Then we found out it was done through independent firms, now the firms are unprofessional. When UK approves it, then we will say UK should be ashamed of themselves. lol... unbelievable!

        So you are basically telling me that you feel the process was done fairly? And that if you were involved with the selection you would choose a company with NO track record of doing such a project over a company that has been involved in projects like this over many years. Is this what you are saying as an intellectual person?

        Your name is facts.. here are some facts..... the same person Mr. Cline who was linked with TPPG when they were first selected is the same person that was on the "TEAM" used to "FAIRLY" select a group to win the bidding after the first bidding process was scrapped. Now; if Mr. Cline was linked with TPPG when they were chosen for the job in the first bidding process do you honestly feel that he should be on any sort of team that could fairly select a company for the project for the second bidding process?

          When this thing first came out I did my research. These guys have lots of ties within the industry having worked in it for decades. At the end of the day the UK are not stupid and should have all necessary information before they approve/disapprove. Whether we agree on something is not the point but telling blatant lies is not nice. To say these people don't have experience is a blatant and cowardly lie. Let me hear your response now after checking the facts. All of this information was put out at the public meeting on the cay so everybody could do their own research on the man himself and his company and partners. It was all put out there for us.

            @facts did you look at the website? How can you call yourself facts and not be aware of the facts yourself? On the website i clearly shows that they have a lot of concepts yes! hence there name "idea"; they give you the design and visuals... just like and architect can.... but you cannot live in an architectural plan just as you can't sit on a bench or take a ride on one of the proposed trollies/trains that "idea" has in their conceptual visual renderings of what the Tortola cruise pier can look like! and that my friend is real facts!

              Hahaha! facts need to go and sit down as upBVI has pointed out and I checked the site myself; they are all conceptual drawings and they are basically baiting. Let's just face it, the people agree that the cruise ship pier needs developing but do not like the blatant CONFLICTS OF INTERESTS and are skeptical as to HOW along with the TERMS of development will be done.

              regardless of whether they are conceptual or not, the ideas are totally inappropriate for most of the sites mentioned. So the issue is are their ideas good for the territory and I say NO! They are moving forward on a sketch and a watercolour drawing and not on anything remotely realistic.

    Obviously the people of the BVI do not feel that this was as "transparent" as the government believes it to be. Time to step back and look at it again. While on the subject of transparency, the airport boondoggle has been awfully quiet lately. Where is that money going to come from and what airlines,by name, have offered any type of a service commitment?? Is that crickets I hear chirping???

      the question is more who will do the arresting? the foxes are in the hen house and I can't see them arresting themselves. Because no one is holding them accountable. that is up to the people to make noise and hold them to their election promises of helping the territory infrastructure first. This is all so self serving and narrow-minded.
