PO Tranquille hearing for May 21, 2014

ROAD TOWN, Tortola, VI - Attorney at Law Mr Ruggles Ferguson who is representing Police Officer Nicholas Tranquille in the civil case against Commissioner of Police David Morris has confirmed that the hearing will commence on May 21, 2014.

Justice Vicki Ann Ellis will be presiding over the hearing. Ferguson told this news site on April 27, 2014 in an exclusive interview that Justice ‎ Ellis had granted leave for them to file for judicial review, a process which has been completed.

He said all other legal requirements that were set out by Justice Ellis were all done in the specific timeframe given. This he said will see the hearing commencing as scheduled for May 21, 2014.

The root of the civil matter is embedded in the fact that PC Tranquille in October 2013, applied to CoP Morris to exercise his power of promotion. PC Tranquille’s contention was that he sat and passed the examination for promotion to the rank of sergeant pursuant to fourth standing order M74. The application was made on October 4, 2013.

CoP Morris allegedly refused to exercise his power on the ground that the post promotion policy which requires that an applicant for promotion takes and passes a written examination supersedes his power under 4th standing order M74.

PC Tranquille had reportedly filed an affidavit of wrongful reversal in rank against CoP Morris, after he allegedly received a letter in October, 2013 from the Human Resources Manager of the RVIPF dated September 2013, informing him that he was reverted from the rank of Acting Sergeant back to his substantive rank of Constable.

    COP Morris just have sgt Mason writing policies and causing the government to get law sue. As Mr. Morris said its not he the officers sueing is his office but before this year end he getting more law sue coming for him.

    It has been 2yrs since the case Fahie and Williams vs the AG and COP, yet the officers cant get justice not a word from Justice Ellis. What u waiting on Mc Cleary to leave, they cant do u nothing release the decision in the case now. Justice is needed for Fahie, his family and colleagues who stood by him and Williams. The truth is the truth.

    Sue they backside too much nonsense going on in that police force now with Morris and his deputy James they feel that can rule with their dictatorship style of leadership but as someone earlier suggested the fire now start to burn it will get stronger and out of control someone have to stop this runaway train. Morris your policies which is of none effect cannot supercedes the FSO. All those policies are in contravention of section 6 (2) of the police act chapter 165. You have absolutely no authority to authorize Carl Mason to write policies for the force so therefore all those policies are null and void

      Always remember that the author of the policy is not the person who writes it, but the person who affixes his or her signature to the final draft of the policy. Example an Attorney writes a "will" for a client, after the will is completed and the client sign the will, is the will the attorney's will or that of the maker? Another example. When a complainant attends the station and gives a statement to the police, on conclusion of the statement, the complainant signs the statement. Is the statement that of the police who recorded the statement, or the complainant after he affixes his signature to the statement? So you are a bit off when you said the CoP is in contravention of a Section 6 (2) of the Police Act 165.

    what is wrong doesn’t make a difference here, what makes a difference is making it right, and that’s the Tranquille we know. Go Tranco we are with you all the way. To Morris and the reminder of BVI Police SMT, you guys don’t have a clue what you have just unearthed. All that is left to say, you guys barked up the wrong tree.
