PO Joseph ‘Quincy’ Phillips accused of biting a minor
The incident had allegedly occurred in November 2011 and the case was file by the then minor’s father Mr Willis Barry. The trial commenced yesterday with two officers of the Royal Virgin Islands Police Force taking the witness box under oath. One was Frank Devonish.
The two witnesses were called by the Prosecution led by Mr Hubert Potter however at the stages of cross examination the Attorney at Law representing the accused Ms Valerie Stephens-Gordon was not satisfied that she could have effectively proven her client’s innocence given the fact that two key pieces of material evidence were not present to be admitted into evidence.
While cross examining Mr Devonish, Ms Stephen-Gordon had cause to repeatedly inform the court of her attempts to test the veracity of the witness as there were much waffling and stuttering as he was responding to questions being asked of him.
This was especially so as he was given photographs of the key evidence as opposed to the actual material evidence, those being a T-shirt and vest which allegedly carried what were said to have been imprints of teeth marks according to one witness and a tear according to another.
The matter was adjourned and is set to come up again, tentatively, on October 31, 2014 at which time the defense lawyer has indicated that she would need to have witness Devonish returned to the witness box.
The allegation is one of common assault.
