Penn’s lawyer seeking a stay for his retrial!

ROAD TOWN, Tortola, VI – The lawyer retained in Andre Penn’s case – a former legislator who allegedly molested his guardian – is seeking a stay on his retrial citing the abuse of process.

At a report hearing this morning February 27, 2012 in the High Court, Patrick Thompson indicated that he will be making an application for the stay, and is also applying for a preliminary application. However, efforts to get a better understanding of the legal jargon proved futile.

Thompson has one month to file both applications, with the written application to stay the trial to be filed in two weeks.

Furthermore, this news agency understands that Rita Olivetti has instructed members of the media not to publish any details of the offenses that Penn allegedly committed. The reason behind this order Virgin Islands News Online understands is to control the publicity that comes with the case.

The former legislator, on March 2, 2011 – was found guilty of having sexual intercourse with a girl under the age of 13, buggery and indecent assault. He was serving 12 years. Following the Court of Appeal hearing on January 17, 2012, the decision was overturned and a new trial was ordered.

On January 18, 2012 he was granted $50,000. His next court appearance is on May 8, 2012.

    It was an order of the Appeal Court that this man's case be re-tried so how come he's asking that it be stayed? If his re-trial is stayed, then might as well the Court of Appeal had quashed his conviction and set him free! This is just pure crap!

    What in the hell is wrong with all these men allegedly raping little girls? A woman is too much for them to manipulate so they prey on the weak and innocent. They should all be sent to an island where no one is there but them and they can feed on each other. They are all a bunch of punks and I for one would love to beat the hell out of them and I am sure many feel this way. This is SICK SICK SICK!
