Pemberton gets 1 year for gun & explosives

ROAD TOWN, Tortola, VI - Thirty-year old Danny Pemberton, who faced fire arm and explosive charges stemming from 2010, was sentenced to serve a year in prison, when he appeared at the Magistrate’s Court today July, 11, 2012.

Represented by Stephen Daniels, it was put forward to Magistrate Valerie Stephens that upon the defendant’s guilty plea, he apologised for his actions and asked for justice with mercy.

Mr. Daniels, who continued to speak on behalf of his client, who is the father of 2, stated that if custodial sentencing fits his punishment it should be at the lower end of the scale.

In addressing the court, Mr. Daniel said that no evidence was formed against his client in relation to if the weapon was used or if he had any criminal intent to use the weapon.

The charges against Mr. Pemberton were: Possession of Fire arm, possession of explosives and possession of cannabis.

Magistrate Stephens, in taking into consideration all that was put forward to the court by Mr. Daniels, discharged the charge of cannabis put against Pemberton.

He then received his sentencing of 12 months on fire arm charges and three months on explosive charges to run concurrently from the date of remand.

It is alleged that Pemberton was stopped in Duffs Bottom on the evening of February 20, 2010, where a .380 pistol and seven matching rounds and eight grammes of cannabis were found in the centre console of a rental vehicle. It was alleged that .9 grammes of cannabis was also found in the defendant’s left rear pocket.

    12 months??? Seriously? It's not enough if we want people to stop carrying illegal firearms. This is not a deterrent. Also, wasn't this the fellow who tried to say the gun wasn't his and was in the rental vehicle. He's a liar and a law breaker AND he was driving around with a gun and ammunition. So much road rage out there he had to protect himself right??? Mandatory 5 years is what we need enforced if we want a stop to this problem. Maybe someone with a life may think twice about purchasing a gun. Maybe we'll save a life.

    Get over urselves people. You all want to crucify everyone for everything. For Godsakes it was .380 pistol, seven matching rounds and eight grams of cannabis. He didn't kill or harm anyone nor did he attempt to do so. These things were found during a routine traffic stop. His sentence is just. Cut the crap, you all want to give harsh sentences for every little thing. I do not know this man so please don't accuse me of such like you all tend to do when someone has a diff opinion than most of you

      I hope when someone guns down one of your family members you are first in the court house begging for mercy on their behalf as well. You sound like a real asshole! Let's not be harsh on people with guns, ammunition and drugs. wtf?
