Officer accused of slapping youth who called him 'punk'

ROAD TOWN, Tortola, VI – A young man charged with resisting arrest, assault on a Police Officer and using indecent language will return to court on January 20, 2016 for continuation.

Estefan Jefferson appeared yesterday December 2, 2015 before Magistrate Ayana Baptiste-DaBreo where testimony in the case continued.

Tendering his testimony via video conferencing yesterday was Police Officer Michael Isles of the Royal Virgin Islands Police Force (RVIPF) who testified that the defendant shoved him in the face and verbally assaulted him as he resisted arrest during a raid on a property.

The Police Officer also testified that he had to get help in subduing the defendant following the alleged shove. He said too that at the time he had a concealed service issued weapon which he did not un-holster.

However, defence attorney Michael Maduro put to the defendant that his gun was drawn and that he provoked the defendant to anger.

“I am putting to you that you had your weapon in your hand and that you told the defendant that ‘y’all feel y’all is bad man.’”

The court heard that the defendant then allegedly called the Police Officer a ‘punk’. The Police Officer is alleged to have said “I will show you who is a punk” and allegedly slapped the defendant after the defendant allegedly used indecent language on him.

Officer Isles denied this via his video testimony.

“I am putting to you that the defendant was provoked by your actions,” said Maduro. This Officer Isles denied.

Prosecuting, attorney Angel Flax-Solomon asked how it was that Isles could both be investigating officer and virtual complainant on the same matter.

Maduro said that Isles had a duty to remove himself from the investigation. However, Isles begged to differ, saying that there was nothing wrong with his being on the case and also being the Virtual Complainant.

    This prosecutor sounds like she works for the defense by implying that the officer cant be both complainant and investigator. If an officer is assaulted and he makes the arrest there is nothing wrong with being the investigator, thhe file is done and sent to the DPP for instructions.

        No conflict of interest there. Suspect assaults police, police arrests and charges suspect. End of story. That is how policing works. Was the officer supposed to let the guy walk off then call the station then he would have truly been a "punk".

    How can anything change in this society when we promote and support this sh*t? Some of these young men have no respect at all for anyone, much less authority. Some Police can be ridiculous with their attitudes at times but they are authority. We blame police for upsurge in crime but if I was a Police I would just these little vagabonds run while and wreak havoc until we wake up and stop defending them.

    These young guys are out of control. He needed more than slap..he needed a good Friday crucification.. Because they can do what they want in their parents house. Disrespect their parents. Don't help and get 3 meals a day...Spoil rotten. They think big responsible men are little boy..Jail him bombo..
