'NDP Govt. reckless for disobeying Court!' - Bevis A. Sylvester

-says Government failed to pay company $700K as per Court Consent Order; calls for matter to be addressed with expediency

ROAD TOWN, Tortola, VI - “I am saying that anyone, any being, any government body, any person who disobeys a Consent Order is reckless and I say it without refute because the court is the highest body when it relates to matters of the judiciary,” said Regional General Manager for Delta Petroleum Mr Bevis A. Sylvester as he blasted the Customs Department of the Government of the Virgin Islands which to-date has not honoured a Consent Order of the Supreme Court.

Mr. Sylvester vented his frustration earlier today September 2, 2014 in the conference room of the BVI Electricity Corporation (BVIEC) in the presence of the media, senior executives of the BVIEC and Delta Petroleum BVI and Caribbean as he sent a strong warning to the Government to honour the Order.

“This Order was brought by this government for us to agree to and we agreed to this Consent Order,” he said making clear that it was not the fault of the BVIEC.

Mr Sylvester said that he has had enough of waiting. “The Court said that we should be paid and we are still not paid. That is wrong, it is not right and I am saying to the Virgin Islands Government to address it and address it with expediency and don’t wait for the matter to go back to court on September 29 when the Appeal Court is sitting again after they have given order,” said Mr Sylvester.

“In all the contracts that we have done, which I have done, this is the fifth one, the fourth one hit me with a shock [as] it was my most challenging contract throughout the Region.”

“So I wonder why this one had to be so difficult after having three before,” he said. He said that Delta Petroleum’s management suffered through the fourth contract because of what he described as a malicious act of the Customs Department in the Virgin Islands.

“We suffered with this contract because of the malicious act by the Custom Department in the BVI,” he said as he explained that it was malicious because of the Court Order issued on January 15th. “And on December 24th, we transferred that product to BVIEC and to date we have not been paid for that fuel,” stressed Mr Sylvester.

He said that amount accounts for almost $700K of out of pocket monies for the fuel company. “I must say when you have a Consent Order by the Supreme Court and you decide to ignore it, it is tantamount to reckless behavior.”

Delta Petroleum has now signed its fifth consecutive contract with the BVIEC for the supply of fuel and according Mr Sylvester despite the challenges Delta Petroleum BVI has been able to perform despite the seizure of their tank.

The tank had been seized after the Customs Department had determined that Delta Petroleum had accessed it without permission and without Customs supervision.

      Just because he is speaking about NDP you raking up all the old story about him well he has already paid for his wrong doing he served his time in prison. This NDP government and people like you feels you are untouchable but wait it will not be long, time will tell the tales

    Is this a sign that the customs has no authority to do what is right in protecting the territory? Now the government can be rediculed because the court saw it fit to give a verdict in favor of who was seen as the perpetrator? Tell us the people what is happening.

      If customs was right the ruling will not be against them. Remember the resident judge here ruled in favor of government/customs but delta appealed that ruling and the appeal court overturn the first ruling and ruled in favor of delta so what are you really saying? Some of those heads of department must know the law before they go and do things contrary to it.

    What customs did is just saying to Delta, Government needed an additional discount so you can bet your bottom dollar that this is going back to the courts.

    This government is saying that they don't thief, they emancipate. The past government said that they don't steal, they liberate. Delta is saying we don't steal, we generate.

    Remember the Minister who said that it was a steal of a deal and the other Minister saying that it was a DONE deal?

    Government's blatant disregard for laws are reminiscent of the terrible position that President Bush put the U.S. in during his terms in office. And it has fostered a more partisan build up in their politics as a result. How far down this divided road does the HoA have to go before the people vote them all out and start over with a fresh change?

    The Bible don't lie " A profit has no honour in his own country", if it was a wishy washing man from abroad all you would have lapped it up. I am not for or against Bevis, what I know about him is that he's a fighter and bold enough to take the highest authority to court, how many of us would have the guts. There's a right and a wrong - Our Court System is one of the best in the World and their Order should be so respected - don't you all think that the Court reviewed, analysed and judged the situation? Stop being so darn close minded and vindictive people, its time to catch up with world commerce and how corporations are run. What we need in the BVI are more fighters like Bevis, fight for what you think is right. Schuupppps!!!!!!

    Bevis is doing good. All through the Caribbean Bevis has Delta on the top winning the different tenders to supply fuel. But in his home the BVI they want to kill him for his past that the same the NDP had a hand in. Time will tell for these bad, wicked & evil NDP.
