'NDP Govt. reckless for disobeying Court!' - Bevis A. Sylvester
Mr. Sylvester vented his frustration earlier today September 2, 2014 in the conference room of the BVI Electricity Corporation (BVIEC) in the presence of the media, senior executives of the BVIEC and Delta Petroleum BVI and Caribbean as he sent a strong warning to the Government to honour the Order.
“This Order was brought by this government for us to agree to and we agreed to this Consent Order,” he said making clear that it was not the fault of the BVIEC.
Mr Sylvester said that he has had enough of waiting. “The Court said that we should be paid and we are still not paid. That is wrong, it is not right and I am saying to the Virgin Islands Government to address it and address it with expediency and don’t wait for the matter to go back to court on September 29 when the Appeal Court is sitting again after they have given order,” said Mr Sylvester.
“In all the contracts that we have done, which I have done, this is the fifth one, the fourth one hit me with a shock [as] it was my most challenging contract throughout the Region.”
“So I wonder why this one had to be so difficult after having three before,” he said. He said that Delta Petroleum’s management suffered through the fourth contract because of what he described as a malicious act of the Customs Department in the Virgin Islands.
“We suffered with this contract because of the malicious act by the Custom Department in the BVI,” he said as he explained that it was malicious because of the Court Order issued on January 15th. “And on December 24th, we transferred that product to BVIEC and to date we have not been paid for that fuel,” stressed Mr Sylvester.
He said that amount accounts for almost $700K of out of pocket monies for the fuel company. “I must say when you have a Consent Order by the Supreme Court and you decide to ignore it, it is tantamount to reckless behavior.”
Delta Petroleum has now signed its fifth consecutive contract with the BVIEC for the supply of fuel and according Mr Sylvester despite the challenges Delta Petroleum BVI has been able to perform despite the seizure of their tank.
The tank had been seized after the Customs Department had determined that Delta Petroleum had accessed it without permission and without Customs supervision.

What customs did is just saying to Delta, Government needed an additional discount so you can bet your bottom dollar that this is going back to the courts.
This government is saying that they don't thief, they emancipate. The past government said that they don't steal, they liberate. Delta is saying we don't steal, we generate.
Remember the Minister who said that it was a steal of a deal and the other Minister saying that it was a DONE deal?
