Man convicted of Attempted Murder slapped with 11 drug related charges

ROAD TOWN, Tortola, VI- Senior Magistrate Tamia N. Richards said she denied bail to Virgin Islander Devon Dawson, who was released early from his 20-year sentence for Attempted Murder, because having in excess of $85,000 in drugs and thousands of cash despite his unemployment status “is no small feat.”

“That’s no small feat! He is actually dealing drugs, selling drugs. Cocaine is not harvested here; it is not grown here!” she told the e-sitting of the court during his maiden appearance on Wednesday afternoon, June 17, 2020.

11 charges

The 48-year-old resident of Pleasant Valley, Tortola, was charged with one count of possession of proceeds of criminal conduct, one count of cultivation of cannabis, six counts of possession of a controlled drug and three counts of possession of a controlled drug with intent to supply to another.

The magistrate said, while reading the charges, that the defendant had several clear plastic bags containing varying quantities of drugs. Some drugs were found in a bag he was carrying, and some were found in his bedroom in Pleasant Valley, along with $31,300.

In one bag, he had 75 grams of cocaine, in another, he had 43.6 grams of cocaine, in another he had 720 grams of cocaine, in another, he had 5.7 grams of crack cocaine, in another he had 100 grams of cannabis and 41.17 grams of cannabis in another bag.

He pleaded not guilty to all the offences.

Chase

Crown Counsel Annjel X. Flax said the defendant led police on a chase along the Paul P. Wattley Road after he decided to put his car in reverse in an attempt to escape from police who were carrying out routine traffic stops along the road.

Flax said the police report indicates that during the chase the defendant tossed a black bag over a wall.

The bag contained a number of transparent plastic bags with what appeared to be cannabis, crack and cocaine.

When he was questioned by police on the substances, the defendant said the items were his, “Can I have a break?” he allegedly asked.

Unmoved by his request, police arrested him and transported him to the Road Town Police Station where the suspected drugs were weighed in his presence.

Home Search

Members of the RVIPF later executed a search warrant on his home that he shared with his mother and other relatives.

Inside his locked room, the cash was found, along with 75 grams of suspected cocaine, 720 grams of suspected crack and some dried and growing cannabis plants.

When questioned, he allegedly said: “Everything in the yard and in the room I own up to.”

He, however, did not consent to an interview with police.

Bail Denied

Dawson's attorney Stephen R. Daniels, in his bail application, said the court could impose ‘suitable conditions’ and grant his client bail because he had nowhere to go and was not a flight risk.

He also pointed out Mr Dawson had only one passport.

Crown Counsel Ms Flax objected to bail, arguing that the offences were serious and he would likely re-offend if granted bail.

In the meantime, an application to further detain the $31,300 was made.

Dawson will be back before the court on July 22, 2020.

    Speaking voice of wisdom to you young people....let it be. Let it be a signal to all you young men. Let it be. These are different times. You have to grow up more quickly. Under so many sets of rules. But you are grown ups now, with best partners, best babies, best life here in the BVI. Go out fishing, go farming, fight for legalization. Take good care of the ones you love. Don't put yourself out there in the drug world. Don't get involved in situations that could cause you so much trouble. Let it be for now.     Because of his unemployment status! Not because you are not working for someone else means that you’re unemployed! The game is very hard work and a dangerous work which keeps one going 24/7 and for one to come to a conclusion that one is unemployed just because you’re not on a 9/5 clock leaves me with a whole lot of questions........

      The point was he has NO source of income. Not on a punch clock or his own business. So yes, the judge is correct. Lock his ass up. he already had a chance at early release and screwed that up real good.
