Kenyetta Boynes sentenced to 6 years, 7 months

-after pleading guilty to gun, ammo & narcotics charges

ROAD TOWN, Tortola, VI – Kenyetta Boynes was this afternoon March 27, 2015 sentenced to a total of six years, seven months for gun, ammunition and narcotics charges when he appeared before the Magistrate’s Court.

For possession of a prohibited weapon Boynes received a six-year sentence while for possession of explosives he received a three-month sentence.

For unlawful possession of cannabis, Boynes was sentenced to four months in prison which combined totalled six years seven months. The sentences are to run consecutively.

On the morning of January 26, 2015 Kenyetta Boynes appeared before Senior Magistrate Tamia Richards at the Magistrate's Court at John's Hole where he had pleaded guilty the charges of unlawful possession of ‎16.5 grams of cannabis, an AK 47 assault rifle and possession of 17 rounds of ammunition.

The court heard that on December 18, 2014  officers of the Royal Virgin Islands Police Force (RVIPF) moved in on Boynes at his Lower Estate home where he was informed of the search warrant.

In executing the warrant Boynes pointed the officers to his bedroom and above an AC unit they found a bag containing which was later confirmed to be cannabis. The court heard that it was Boynes himself who told a Police Officer, "That's weed, that's mine."

Later that same morning at around 7:30 am Boynes was led by Police Officers to the family business where it was said he was the main man and a search unearthed the weapon, ammunition, a bag and clothing which were found concealed in the ceiling above a conference room/office area.

When the find was shown to Boynes he made no response and he was cautioned and taken to the Road Town Police Station.

The find included ‎clothing, 4 rolls of 7.62 ammunition and a magazine which had 13 rounds of ammunition. One round was in breach in the magazine.

The court also heard that the accused admitted to the drugs, arms and ammunition being his. He had told police that he had found the guns and ammunition in a ghut in Huntum's Ghut prior, and that he had played around with it and had decided to keep it but had never shot anyone with it.

He also told the interviewing officers that some of the rounds had fallen out in the bag which he had put the gun in.

    Sad--My advice to you cous-----Use this opportunity to make yourself a better man--You have enough time to focus on your degree, do some serious studies, try to get a degree--your parents will support you if you show them the seriousness and the commitment.--leave the rude boy things behind--drop some friends.

    It's ppl like you always trying to blame people for influencing him that have him the way he is I am not sorry for him he seems like he can not learn acting like he run the world and don't need noone...he had his fair share of time to learn his lesson I hope they b**t him up there since he thinks he is a bad man with his crawny m*ga self

    good point-Plant-- all the young men should use their time to study. I would also advice them to practice blowing a wind instrument. But there seems to be no place in the BVI for wind instrument no more (brass players)---in-spite of all the govt scholarships..no brass for calypso show in VG---Why Mr. Minister. Why? No BVI brass band in VG Why Mr. Minister?--brass is part of our culture--more than culture, part of our history--more than history--something for our young people to do. Make it interesting again.. bring back brass-a-rama. a band from the College, one from each high School. inspire and motivate the youths. These young people on these committee don`t have a clue--Mr. Minister we need Brian Penn or Kenny in Banco- As it is now, it seems like Tax payers money are wasted.

    I know I may get licks for this but I will say it anyway.. here in the BVI when you are a "bad boy" you are a hero. The girls love you, your parents defend you, the public fear you, politician moan over you when you end up in prison and no one believe you did the crime. When as a people we sto supporting wrong we will see progress.

    My comment is simply one who is trying to make sense of the justice system of the BVI. I am someone who is always interested in the goings on in the place of my birth. Below I have posted a link to the sentencing procedures from a website I found that is available to the public in the event questionable legal issues or even misconduct is suggested in the courts system of the UK. There are also examples of cases that I copied and pasted for you to examine. Check it out for your self. The reason for this is that I have been following several cases in Tortola BVI and have found so many inconsistencies in the procedures of the justice system that should be following that of the Royal Crown. Check it out for yourself. I am interested to know how can a young man named Cordell receive less of a sentence than the young man Boynes when he was found with more firearms, unlicensed/registered and more rounds of ammunition in he possession? This makes no sense to me. Opinions don't matter, facts are facts and in the legal system that's all that matters. look at the cases below and judge for your self.

    Relevant Sentencing Case Law

    Hudson [1998] 1 Cr.App.R.(S.) 124
    G plea to possessing a firearm without a certificate. D arrested on suspicion of assault. On searching his house police find a loaded sawn-off shotgun and cartridges. D said he bought the gun for protection. It was established the gun had never been fired. 5 years reduced to 4 years imprisonment.

    Addison [1998] 1 Cr.App.R.(S.) 119
    G plea to possessing a firearm without certificate x 4, possession of a shortened firearm without a certificate x 2 and possession of ammunition without a certificate. Police search of D's work place and home address resulted in finds of six firearms in working order and ammunition. 5 years to 4 years imprisonment.

    Holmes [1999] 2 Cr.App.R.(S.) 383
    G plea before a magistrates' court possession of a firearm whilst a prohibited person, possession of a shortened shotgun without a certificate, and possession of a loaded shotgun in a public place. Police find a loaded sawn off shotgun and ammunition in a hire car that was traced back to D. Sentenced to two and a half years imprisonment.

    Herbert [2001] 1Cr.App.R.(S.) 21
    G plea to possessing a shortened shotgun and to possessing a firearm before expiration of five years from release form prison. A search a D's address revealed a sawn-off shotgun hidden in a bed with a number of live cartridges. D claimed to be 'minding' items for a man he was terrified of and received £50. At Newton hearing, basis rejected. 4 years imprisonment upheld although there was no evidence of any contemplated offence the court was entitled to assume that it was for an unlawful use should the occasion arise

    Beaumont [2004] 1 Cr.App.R.(S) 393
    G plea in the Magistrates' Court to possessing a firearm without a certificate, ammunition without a certificate and possession of cannabis. Police search of D's house and D seen to conceal a package that contained a single barrel 12 bore shotgun with barrel cut down. 23 cartridges also found. D said bought them for £100 and intended to wall mount gun. Held that there was nothing to suggest intention to use items in a violent way. 3 years reduced to 2 years imprisonment.

    Scully [2006] EWCA Crim 466
    G plea to possession of a firearm without a certificate x 2, possession of ammunition without a certificate, possession of expanding ammunition and possession of Class A and C drugs. Police had arrested D at his home address in relation to another matter when they find firearms, ammunition and drugs. Also found was a silencer. A sentence of three years imposed.
