Kani Hazel charged for allegedly shooting Tereim Grant

ROAD TOWN, Tortola, VI- In the case of Kani Hazel vs Tereim Grant on February 23, 2017, the Magistrate's Court heard how a mother rushed to the rescue of her son who was shot and eventually collapsed before her eyes.

The incident allegedly occurred on June 30, 2016 in the Paraquita Bay community.

The charge of possession of a firearm with intent to endanger life was laid indictable against Hazel and he is to return to court on March 17, 2017.

Ms Denise Grant was reportedly alerted to what sounded like a gunshot. Peering out to confirm her curiosity, Hazel noticed her son Tereim wrestling with a man whom she allegedly told police was indeed Kani Hazel as she recognised his face.

Upon seeing his mother, Grant told her to call the ambulance as he was hurt and continued to struggle with the accused, allegedly trying to take away a gun from the accused to avoid further injuries. 

As the distraught woman went back into to her home to call the ambulance and police, the court was told her son followed shortly behind and subsequently collapsed in the house covered in blood.

This all reportedly happened around 4:00 AM on the day in question.

The police upon arrival found the victim with what appeared to be a gunshot wound and bleeding profusely. He was rushed to Peebles hospital where he was admitted.

Some distance away from the scene, police caught up with the accused man who denied ever having a gun or shooting or even being at Grant's residence that night. He reportedly had some injuries to the head and was also taken to Peebles Hospital for medical attention.

      For attempted murder the evidential bar is kind of high. You have to prove a clear intention to kill. It's even higher than what would be required for a murder charge where you would prove an intention to kill or do previous bodily harm. It would help if there of evidence of action plus words. For instance, if the accused had shouted while fired, " I am going to kill you", that would demonstrate clear intention. The charge they used is safer territory than attempted. He allegedly had a firearm and actually discharged it at someone. Much easier to prove than attempted murder. In other words, the likelihood of a conviction is greater; conviction and sentence is the ultimate aim of the prosecution. Hence, go with the safer charge.
