ROAD TOWN, Tortola, VI- Information reaching our newsroom is that a vessel that sailed from St Martin has been detained by Her Majesty’s Customs for allegedly not having a cruise permit for Virgin Islands' waters.

According to reports, the vessel was detained this morning, November 17, 2016 at the Cruise Ship Dock on Wickham's Cay 1.

The boat with the words ‘sailingship-eldorado.com’ had several persons on board.

Commissioner of Customs Mr Wade Smith could not be reached for comment up to time of publication.

Several charter companies have been slapped with fines for breaching HM Customs and Immigration laws ever since HM Customs embarked on a campaign to clamp down on defaulters some months ago.

    These kind of seizure news makes me sick and want to throw up.. Where is the discetions.. The warning.. Making good news out of these situations.. Instead we constantly making bad news and bad relationship.. That's the way to say that they are working. Giving a stern warning is doing a better job.

        Well St. Marten coadt guard andvcustoms search you if you clean they scort you out. With s warning. Only in the BVI. We are so unfriendly, hostile, don't understand the importance of relationship... We act like we are in heaven. Scarless, sinless. Perfect.. We are will need the mercy of others at sometime

      I agree completely. All HM Customs has succeeded in doing is screwing up the holiday for a bunch of unwitting tourists, leaving a bad BVI taste in their mouths. As soon as the vessel returned, Customs could have done exactly the same thing.
      The officers in HM Customs uniforms are earning the title of "bullies", and they deserve it!

    Seems like Customs is trying their best to scare everyone out of the BVI. Word is travelling fast around the other Islands........" Don't even think about going there ."

    We all respect Customs for doing a great job, but recently they are going too far. Arresting vessels loaded with tourists is not necessary .

      They are protecting the boarders. These captains knows the law so why coming to someone else waters with out the proper documents. They would have never tried that in US waters trust me, the captain and everyone getting jail plus heavy fines.

      @ local: you can't even go from here to St. John without the proper documents: one thing for sure when it comes to the white folks we should simply let them do what they desire(toss the laws of this territory out the window) for the few pieces of silver...when anyone of us leaves this territory call BVI via boat or plane we must comply with all the rules and regulations BUT persons coming here are free to do as they wish: why the captain did not sail the same boat next door into USVI waters!!!!(with locals like you our people will always remain second class citzen in this BVI but the DEVIL is a liar) thank you customs....who vex vex

      Agreed. they should enforce the laws but they make it up as they go too. depends on the officer you talk to which law is real. this along with the labor department not letting people do any work on their own boats in the boat yard is already causing chat about telling guests to stay in the usvi and for off season work heading back to PR for hauling boats.

      @@ wize up: when my fellow black sisters and brothers are found in this territory's waters with out correct documentation they are detained at Her Majesty's Prison then departed and all these folks are seeking is a better life(spin my blog any which way you so desire) both parties entered this territory in contravention of the laws(I am challenging some us to enter the people's country unlawfully then blog the result).....keep the faith !

      What an asinine comment. Do you not know anything about how cruise businesses are ran? Quite obviously cruise passengers have the right to be here because when one signs up for a cruise one has to produce the correct documents for the countries one would be visiting. The cruiseships then have to send an itinerary of the passengers' information to each country. In fact, thanks to computers and the Internet, this is true for various modes of international transportation. Before you even leave your starting country, if you are legally authorised to be in your visiting country, Customs and Immigration of that country already know your name, age, birthday (everything that could be found on your passport), name of the transport vessel, if that country is your final destination (the name of the final destination if not), how long you are expecting to stay (according to the exit date on your ticket), if you missed your flight or boarded late, if you have been to their country before and a whole host of other information. When we travel we become numbers in a system.

    I was living in the Bahamas when they started changing their attitude negatively toward tourists and with in 3 years the place was empty, the word got round that if you go there you will be treated without respect and harassed.They went completely bankrupt and are still fighting that bad image, BVI be careful, with Cuba open and ready for tourist and many other places begging tourist to come we need to make the BVI an attractive destination.

      Why don't you try going to Cuba without the proper documentation and see what happens. No one is saying not to come to the BVI. They are simply saying to get the proper documents, which are very simply to attain. the BVI has been to free for far too long. It is high time somebody tighten up before it is too late.

      @ Bahamas. What is wrong with following the darn rules. ever went to st.thomas and didn't have the correct papers or incomplete manifest? Its an automatic $3000.00 fine, no discretion. All who in the boating business knows this and they do not take that chance, but come to the BVI and do all the shit they want because of what? Tourist dollar? Good behavior?

    I understand what you are saying and I agree; countries that thrive on tourism should be careful with the way they treat tourist else there can be dire consequences. However, I disagree with calling what Customs is doing, harassment. In fact, I disagree with all who take this approach. Silly me didn't even know the laws of my own country because I thought for years people who sailed here were authorised to be here and checked in once they got into our waters. I thought it was only natural since that seems to be the law for basically every other place on Earth with water boarders. Clearly what we have been perceiving as magnanimous hospitality have been perceived as opportunity for others to play us as fools. A charter ship clearly indicates that other countries are habitually packaging and selling our tourism. How else could they have had the galls to bring tourists here without our permission for a day trip? Much less not know of our updated laws?

    I highly doubt if it were reversed we'd be allowed to wander into St.Martin/St.Maarten undeclared for a day trip, never in actually procure a charter for profit. Yet still people penalize the BVI for standing up for themselves? Name me one foreign country on this planet where any of you can waltz in and out of as you like. Yet still the BVI is being irrational?St.Martin/St.Maarten have been incorporated into their European countries so they are no longer colonies but districts of France and Holland respectively where as the Virgin Islands is still an Overseas Territory which makes us a self-governing colony. I assure you, neither France nor Holland would allow anyone to unlawfully enter their waters and stay, not even the British and if we made a habit to do what they did not only would we have to hear about it but so would the UK. We are left here to deal with a lot of tourism woes on our own and I am shocked to see how many people think we should be the footstools of the Caribbean. I want you all to do me a favour and Google "The Spanish Virgin Islands" as well as sailing charters from our closest island neighbours and see how our name and reputation gets appropriated constantly for the gain of everyone but us. How people stay in the USVI but sail and dive in the VI and never spend a dime here. I glad that these people enjoy their time when they come. We are fortunate to have this kind of beauty in our everyday life and I'm glad to share it but how is what they are doing fair to us? Why should everyone but us profit off of us? I say let these people learn our laws and fall in line just as we are expected to do when we visit their countries. Right is right and wrong is wrong and it is wrong to enter another country and not declare yourselves. Evidence for this being that had they been a charter flight, they'd have landed at Terrence B. with documents in hand and no fuss therefore why should the rules be any different for waterways?

    Lastly, I would like to point out that in this world where any and everyone is prone to terrorist attacks, we have a right to know who is in our waters, what their intentions are for being here and how long they are expecting to be here.

      I totally agree with you and I am also very familiar with our laws. I just checked their webpage and this is what I found ****Tickets from 69,00 USD. Enjoy the early morning on board the elegant schooner Eldorado for a wind powered sailing adventure with spectacular views over the BVI´s island world and a refreshing bath in crystal clear water while at anchor in a protected bay of Pieter Island. **** So they are selling tours here in the BVI. Do they have a Trade Licence? Does all the Crew has Work permits? Having no Cruising permit is may be the least of their problem. What about National Park Permits?

    Where and how man come up with this Crazy thing that this part of Jah Sea is BVI Boundary and this part is USVI Boundary. This is St Martin Boundary.. God never set no boundary for open sea. Open sea is for all to enjoy . Now if one wants to enter Land one will need permission..

    BVI does NOT have a good website ANYWHERE to tell people the rules ONLINE. It's all written down on a piece of paper somewhere. The only place you will find the laws online is tourism web sites and yachting websites. NOTHING FROM BVI GOVERNMENT that tells a person exactly what is needed at port of entry.
    Government needs to implement a dedicated boating, customs website.

    It is well known by ALL world sailor's that ALL boats that travel in & out of any country or territory must clear in and out of customs. Great job!!! If some are let to pass, the officers are breaking the law!!
