Gov Jaspert allegedly refuses 14-day quarantine on return from COVID infected UK!

- Under new protocol following the new strain of COVID-19 found in UK, VI now requires 14 days quarantine; Controversial Governor demanding 4 days

ROAD TOWN, Tortola, VI- In another move that demonstrates the controversial Governor Augustus J. U. Jaspert aka 'Gus' is reckless, his disregard for the rule of law and his normal blatant violations of the Virgin Islands (VI) constitution, even with a few days left on the job, the Governor is allegedly refusing to comply with COVID-19 policies.

Following a new strain of COVID-19 found in the United Kingdom (UK), the Cabinet of the VI agreed that anyone under the approved categories coming from the UK must go through a 14-day quarantine.

Mr Jaspert just returned to Tortola last evening, January 7, 2021, from the UK where he spent his Christmas holidays.

The protocols do not apply to Governor Jaspert?

Sources in the Governor’s office familiar with the issues; however, have told our newsroom that Mr Jaspert is demanding that he only stays “4 days in quarantine”, which is a violation of the Territory’s protocol.

The Officer noted that the outgoing Jaspert can potentially expose staff of the Governor’s Office and other civil servants to COVID-19, even if his PCR test shows negative after the 4 days.

Efforts to get a response from the Governor's Office proved futile up to time of publication.

14-day mandatory quarantine in effect- Hon Malone

Minister for Health and Social Development, Honourable Carvin Malone (AL), when asked when the 14-day travel requirement for persons with a UK travel history would be effective, said, "now in effect".

Hon Malone subsequently released a statement today, January 8, 2021, on the quarantine requirement.

He said the United Kingdom in the protection of its very own citizens has implemented strict curfews and protocols aimed at containing the spread of this new strain which has resulted in lives being affected.

"We have seen where countries surrounding the United Kingdom have closed their borders and have implemented measures to curtail immigration to and from the United Kingdom."

"We have seen where in the Caribbean; a number of countries have already placed bans on visitors coming from the United Kingdom," Hon Malone stated, adding that if we are to protect our citizens, we have to implement whatever measure is required in order to further protect visitors and residents.

"As a result of what is happening globally with this new strain of COVID-19, as a Cabinet, on 7 January 2021, we decided that effective immediately, all persons approved to travel to the BVI originating or transiting through the Dominican Republic or the United Kingdom are required to undergo mandatory 14-day quarantine on arrival provided they undergo a five-day rt-PCR testing regimen, prior to arrival, and on days 0, 7 and 14.

"We decided in light of the new strain of COVID-19 prevalent in the United Kingdom (UK), to implement a travel ban effective Monday, 11th January 2021 of persons travelling from the UK to the British Virgin Islands except for Nationals, Belongers, Residents, work permit holders, persons permitted to reside in the Territory, diplomats and persons employed by Government and Statutory agencies."

VI Gov't will not 'endanger' lives

Hon Malone emphasised that the 14-day quarantine for anyone coming from the United Kingdom is important, "so that we do not endanger the lives and livelihood of the people of the Virgin Islands who is looking to this Government to keep them safe."

He noted that anyone coming from the United Kingdom is required to present a negative COVID-19 test result prior to entry in the Territory of the Virgin Islands.

"Persons are subject to the necessary fourteen (14) day quarantine requirement once arriving in the Territory from the United Kingdom, which is considered a high-risk country.

"In this regard, persons will also be subject to follow-up testing upon arrival in the Virgin Islands, as well as a quarantine exit test at the end of the fourteen (14) day quarantine period."

Everyone must adhere to protocols-Premier Fahie

Premier and Minister of Finance, Hon Andrew A. Fahie (R1) when contacted on the matter said the Government of the Virgin Islands expects that anyone in authority would adhere to the protocols approved by the Cabinet of the Virgin Islands.

"This is important to protect the safety of the people of the Virgin Islands.

"Together, we have worked very hard to get this Territory to this phase we are at and we will continue to take all precautionary measures to keep us all safe," Premier Fahie said.

Trump-like Governor

Many residents see this behaviour as having no regard for the rule of law or the lives of the people of the VI. One resident, who did not want her name to be used for this article, claimed: “it seems like we have another Donald Trump-like person on our hands”.

Many in the political class had wished for the governor not to return; however, some noted he seems the be like Donald Trump and it unwilling to demit office, even as he has become the most unpopular and controversial figure in the VI social and political space.

Some in the media profession have blasted him over the last year for his meaningless press conferences and interfering in the work of the local democratically elected government.

Many residents were concerned that Mr Jaspert, who is a UK civil servant appointed through the Foreign and Commonwealth Office, spent over $90,000 on a top of the line Range Rover using taxpayers funds in the middle of a pandemic last year.

His critics have frowned on the spending, nothing that the Territory gets little to nothing from the UK.

Unpopular Governor

Mr Jaspert, who has become unpopular for saying that the Virgin Islands should not expect any reparations for the evil acts of slavery and has defended the keep of names of landmarks named after perpetrators of slavery, torture, murder, rape, plunder and genocide, came to the Virgin Islands in 2017 and had requested an extension for an additional year.

The UK appointed Governor was also accused of interfering with the legislative branch earlier this year when he tried to dictate to the House of Assembly (HoA) to meet so he would not miss the deadline for the laying of the BVI Airways Report in the HoA.

Veteran legislator Honourable Julian Fraser RA (R3) subsequently brought a motion to the HoA seeking to have the Governor reprimanded for the delay of the report; however, the motion was defeated.

Antagonistic Augustus

Meanwhile, Governor Jaspert has also infuriated Government and elected members of the House of Assembly over his reported attempts to cause a strain in the relationship between the elected Government and the electorates.

He also drew backlash when he brought unsubstantiated claims to the public that there were victimisation and irregularities in the civil service.

      Because he is the Governor of the territory of the UK known as the VI. VI does not have independence from the UK. VI is part of the UK. How is it that so many people including af have forgotten this? If the people of the VI want independence they can have it. But, for now, you are a territory of the VI with a Governor an in the case of this one an excellent Governor. A necessary Governor it would seem from what I have heard af doing, planning and promoting in the last year.

    The VI prides itself on the rule of law. No one is above the law, neither the Governor nor the Premier nor the homies hanging on the block. If government leaders want the public to follow the rules, they must set the personal example and lead from the front. The do as I not as I do is elitist, poor leadership and counter to good order and discipline. Covid-19 is a deadly disease and every VI resident, including the Governor, must model the behaviour to contain, prevent and mitigate the spread of the deadly disease. If the report is true, the Governor is posing a risk to the health, safety, security, life and well-being of all VI residents. If the Governor does not want to adhere to the established protocols, perhaps, he should rush back soonest to the UK where there is no Covid-19 nor the new strain of Covid-19. Wanna be prima donnas should not be welcomed in the VI. The FCO needs to recall AJU Jaspert now.     Those who violate a country's rules are usually arrested and charged. Do we think for a second that the commissioner of police would arrest this law-breaking gov.? No way. What if it was a local.....of course.
    This is a call to action my friends. We must demonstrate our disapproval of this governor with every legal means available such as shutting down the whole governmental apparatus until he's removed. Yes it would be painful for us locals but the cost is an absolutely justifiable means.

    The government decided to change the quarantine protocols the same day as the Governor returns, without warning, thereby catching people in transit after they left their country of departure. The civilized world does not do this. When the Governor’s flight left the UK the quarantine period was 4 days, no country implements a law without a notice period.

    According to the Virgin Islands Constitution 2007 which is the law of THIS territory:

    Assent to Bills
    79.—(1) A Bill passed by the House of Assembly shall become a law when—
    (a) the Governor has assented to it in Her Majesty’s name and on Her Majesty’s behalf and
    has signed it in token of such assent; or
    (b) Her Majesty has given Her assent to it through a Secretary of State and the Governor has
    signified such assent by proclamation published in the Gazette.

    In other words, just because HOA wake up from a long sleep and declare something with zero notice does not mean that it becomes law. This is not a dictatorship. There is a constitution and all patriotic people would adhere to the Law of the land. As such:
    1. Has the bill as proposed by HOA on January 7th been assented to by the Governor?
    2. Has the assented bill been published in the Gazette?

    Ayo looking at all these things as formalities, when only a few days ago the entire world saw what happens when people disregard the rule of law because 'dem feel so to do'.

    The majority on here who flapping gums need to sit down and READ THE CONSTITUTION and UNDERSTAND how legislation applies in this territory, lest they wake one day after setting precedent that the Government of the day can just make proclamations without checks and balances and find themselves on the unfavoured side of whichever Government of the day is in power. Then they will want to cry foul.... The law is the law and principle is principle REGARDLESS of personalities involved. And if you can't understand that, then Heaven help you and may you reap what you sow with your biased attitudes.

    The Governor in his capacity would have Diplomatic immunity while he is serving in the territory. However, he should not be so arrogant and flout the laws of the territory openly. With such behavior, he is sending a clear signal to the government that they could do whatever they like, he is not complying with the law. What is good for the goose should be good for the gander. I do hope that this action by the governor will not be repeated by anyone whether the person is from here or any other country. Since the UK has a very high infectious rate of the new strain of the COVID-19 virus, I think the government here should ensure that every returning individual Must comply with the quarantine regulations.

    if its the law the ALL people...government officials and everyone should abide by the rule.of law.
    question though...if a tourist from uk comes here...are they still 1r days or the 4 days.?
    I do know that the ministry of health can...if they so wish...make exceptions to these laws/ protocols. certain persons visiting from Panama for instance were granted exemption from ANY quarantine is my understanding..
    just i terested to know the answer though to the above question.

    Huge coincidence that this 14 day rule was put into effect just as the governor was returning home. Anyways does it really matter? A day earlier and he would only have had to quarantine for 4 days. Leave the guy alone, it’s not like he’s going to be rushing out to Crystals.

    Sometimes we need to read and understand before we all look like fools...The 14 days mandatory started on the 8th January... the Governor returned on the 7th January he is with in his rights for the 4 days quarantine...wish really shouldn't be ..it's a joke..
