Filipino couple & Health Authority to settle “missing” baby dilemma

ROAD TOWN, Tortola, VI – Hopefully an amicable financial settlement will be met between a Filipino couple, whose baby was accidently cremated at the hospital morgue, and the BVI Health Services Authority (BVIHSA), an official close to the negotiation related to Virgin Islands News Online yesterday Tuesday, November 15, 2011.

The couple has secured the services of a lawyer and so has the BVIHSA.

“A figure has not been set as yet but hopefully a figure acceptable by both parties can be achieved without any fuss, or any publicity,” the official disclosed.

When asked if the attorneys met for a preliminary meeting, the official said, “No, but I think they are working on that.”

The sordid details surrounding the baby being cremated first came to light on Monday October 17, 2011 via online newspapers and television station of a body missing from Peebles Hospital morgue. However, the same day, a cryptic press release from the BVIHSA was issued - baffling many.

It was three days later when BVIHSA released a statement and apologised on the matter, which stated that an investigation in collaboration with the Royal Virgin Islands Police Force revealed that the body was accidentally removed from the morgue and cremated due to a procedural error.

“Having identified this unprecedented error, measures have been immediately implemented to ensure that there is never a repeat of a similar incident...the BVI Health Services Authority’s board, management and staff deeply regret the tragic loss and expressed their condolences; thoughts and prayers for the wellbeing of the parents and family,” the release had stated.

It was through Bishop John Cline Virgin Islands News Online was informed that the body of the infant went missing after the mother gave birth on October 9, 2011 but only to learn that the female baby died two hours later as a result of complications. However, when a Pathologist arrived in the Territory on Wednesday, October 12, 2011 to conduct a post mortem, the body of the infant could not be found at the morgue.

After several days of searching, the couple was informed on Sunday, October 16 by hospital officials that the baby might have been cremated by accident. It is alleged that when the parents asked for the ashes they were informed that the hospital did not have it because it may have been thrown away.

    Baby died due to complications. Could not find cause of death due to wrongful cremation. Wanted ashes to rest their souls. Ashes was thrown away. That's a lot of coincidences. One word, malpractice.

    Imagine receiving monies for a baby that was already dead. I dont see how this is going to bring back the dead baby. Some people like to take every opportunity to swindle Government for money. Greed!

      That is not the point, the parents know that money will not bring back their baby, however, to ensure something like this does not happen again, this is a very good option to ensure strick measures should be put in place to avoid this misfortunate situation. It happens all over the world and the parents should not feel guilty for going this route and by the way, the Government I am sure has insurance to cover these types of law suits! Pray for all involved that Justice prevails!

    @ Schupes You really sound ignorant making that type of comment. I do not think that it is wrong for these people to pursue legal action and seek compensation for this matter, nor do I think their motives are propelled by greed. No amount of money can possibly be enough for the loss of a child, however, I think it is appropriate to hit them where it hurts, which is in their pocket to ensure that they put the necessary policies/measures in place to prevent these things from happening again. Too many times "incidents" happen as harsh as this and they are brushed under the rug, which is why they continue to happen. They have to be accountable. If I were them, I would not accept a simple "sorry", but you on the other hand can accept one if you happen to be in their shoes (God forbid it). Stop the negativity and think before you type. Amen.
