Edmund G. Maduro blasts new gun law

- criticises recently passed gun law as having too much overreach; says innocent fishermen have now become the target of the law

ROAD TOWN, Tortola, VI – Radio talk show host Edmund G. Maduro said illiteracy is running the country since laws are being passed with no proper guidance as to the overreach effects that they may have.

Maduro made the statement with regards to the March 23, 2015 passage of the Firearm and Air Guns Amendment Act in the House of Assembly. He discussed the issue on his EGM Show on ZROD 103.7 FM last night June 18, 2015.

Prohibited are all shotguns and paint ball guns, also any firearm made up in the form of a propelling pen or pencil, capable of being used for discharging gas, bullets, shot, dye or pyrotechnic flares or is capable of discharging any irritant in liquid, powder, gas or chemical form, any pyrotechnic flare or dye, or any article known as a paint ball.

Prohibited also is any firearm that appears to be some other article such as a walking stick, cane or key ring in order to disguise or conceal the fact that it is a firearm, and any cannon or other weapon which will expel a projectile by the action of an explosive or other propellant, even if it is intended for life saving or distress signalling purposes.

Prohibited also is any device known as a powerhead that can be attached to the end of a spear gun and is designed to propel a projectile by means of an explosive and any electrical weapon such as that which is commonly known as Taser.

However, according to the Royal Virgin Islands Police Force, owners can apply to the Commissioner of Police for an exemption under section 7(2) of the Firearms and Air Guns (Amendment) Act 2015. Exemption can also be granted by the National Security Council.

Does common sense prevail anymore?

“We have a law that was recently passed and we have a Premier that is telling us that for the sole purpose of trying to control crime. How many crimes with these flare guns are being reported in the BVI?” Mr Maduro said.

“So a man innocently could have these flares. The police could now take him up and lock him away for five years and charge him a fine of $80,000. And you want to tell me that this is good governance?”

The talk show host and recent Territorial At Large candidate said there are rules and regulations that permit local fishing and other boats to carry flares and other things for which laws are made and they could be faced with a crime. “Are these leaders men of God or men of something else? Does common sense prevail anymore?” he asked.

"We have drawn hook, line and sinker from an Australian law without ensuring the protection of our people," he said. “Did they read the law that was passed? Are we saying that our elected representatives and our leaders are illiterate and they can’t read? Do they read these laws before they pass them?” asked Maduro.

"Illiteracy is running this country of ours. There is no wisdom," he said. He asked how it is that government could include a provision in the law that could see innocent, legitimate boatmen and fishermen becoming targets under the new law.

    I'm turned off by his personal attacks but the critique of the bill is correct. The bill does seem far -reaching. And there seems to be no provision in place for person to apply to have licensed weapons, so its not really a "gun law" more so than it is a violation of a person's right to bear arms (legally).

      "CAN" apply does not mean that it will be granted. If the CoP wakes up on the wrong side of the bed, he can decide to deny every single application without justification. Allowances for these exemptions were not clearly stated in the law. The law is crap and does not serve its intended purpose.

      and how much time and effort is that going to take? And how much is it going to cost? And what do you do with your formerly legal contraband while you are waiting? And why should the fishermen and boaters and others with reasonable uses for reasonable tools be burdened with all that red tape? Just amend the law with a little common sense.

      I shouldn't have to apply and go thru red tape for use my flare gun. Is this a revenue generating law or a crime prevention law? My spear gun & my flare gun stay in my boat.

      How practical do you think it would be for EVERY vessel that comes into our waters to apply for an exemption? Not very. This amendment is just another over-reaching, knee-jerk response to pacify certain members of the community. Can you say 125cc restriction?

      Is an "exemption" the same this as having a license. What legal status is having an exemption to the law? Is it legal or just decriminalized?

    With the presence of so many illegal weapons on our streets we must wonder where they come from ax we do not have a gun or bullet factory here. I hope I am not talking too much as with technology even a child can construct such but with the laws lately it gonna have a lot of setbacks and it gonna affect us all.

    Aren't licensed boats required to carry signal flares? Did anyone check on that? They can be life savers in an emergency. I'm thinking they may be required by one branch of the government and outlawed by another :)

      So with one swipe of the pen, our whole marine industry is illegal, because you now cannot set sail WITH OR WITHOUT a flare gun, by law!
      I guess this is one way of ensuring the cruise ships never come to the BVI, as they will all have them on board, BY LAW.

    Don,t you see that the premier and his men are trying to make this territory a police state run by a dictatorship? I agree that we need a gun law, but they are going too far. Why do they have to always copy from other places? Why didn't,t they pass the gun law before the children of their strong supporters were tried? Wise up people. These laws are only for some of us not their friends and supporters.
