ROAD TOWN, Tortola, VI – While the file is ready, a certain course of action is expected to be taken in the case against Jerome Allen and Davin Thaxter, the duo implicated in the firearm and ammunition bust aboard a Smith’s ferry August last year, announced Crown Counsel Valston Graham during the Magistrate’s Court sitting on Monday, January 23, 2012.

The men were expected to stand trial separately, but now the Crown Counsel has announced they will be tried together on March 2, 2012.

At a previous court appearance Allen, 41, has pleaded not guilty to one count of unlawful importation of a firearm, one count of unlawful importation of explosives, one count of unlawful possession of explosives and one count of possession of a prohibitive firearm.

He was offered bail in the sum of $50,000 signed surety, has to surrender his passport, and report to the Road Town Police Station daily between 6 a.m. and 6 p.m.

Meanwhile, Thaxter was charged with unlawful importation and possession of firearms and explosives. He was offered bail in the sum of $50,000 signed surety, surrender his passport, and report to the Road Town Police Station daily between 6 a.m. and 6 p.m.

According to court records, at around 4:30 p.m. on August 11, 2011, Bomba Charger departed Charlotte Amalie bound for Tortola. The vessel arrived around 5:45 at the Road Town jetty where Allen, who was a passenger, disembarked and proceeded to clear Customs and Immigration.

During a routine search of the vessel carried out by Customs officers and the K 9 Unit, they found a large Home Depot box containing an assault rifle, one Glock pistol, 250 live rounds of ammunition for the rifle and 21 live rounds for an AK 47 in one of the bathrooms.

When crew members were questioned, Thaxter came forward and stated that an individual asked him to hold the box until the vessel was docked and then would retrieve it. The Crown also has footage of Allen’s movement from Charlotte Amalie Ports Authority.

Allen is represented by Patrick Thompson and Thaxter by Herbert Mc. Kenzie, Orion Law Firm.

    Crown ask Davin how much was he offered or paid to break the laws outlined by customs to place all imported cargo in customs holding area to be decleared? I'm sure Smith's Ferry service instructed him to place all cargo in the designated area.
